NS-822 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING THE ROBERTSON 3 RANCH MASTER PLAN, MP 02-03 ON 398 ACRES FOR PROPERTY GENERALLY LOCATED NORTH OF EL CAMINO 4 REAL, EAST OF TAMARACK AVENUE, EAST AND WEST OF COLLEGE BOULEVARD, AND EAST AND WEST OF CANNON 5 ROAD IN LOCAL FACILITIES MANAGEMENT ZONE 14. CASE NAME: ROBERTSON RANCH MASTER PLAN 6 CASE NO.: MP 02-03 7 The City Council of the City of Carlsbad, California, does ordain as follows: 8 WHEREAS, the Robertson Ranch Master Plan is in conformance with the City 9 of Carlsbad Habitat Management Plan for the subject property as well as current City 10 ordinances; and WHEREAS, the City Council did on the Ui-h day of Npvember 12 2006 hold a duly noticed public hearing as prescribed by law to consider said request; and 13 WHEREAS, said application constitutes a request for a Master Plan as shown 14 on Exhibit "MP 02-03" dated May 31,2006, incorporated by reference; and 15 WHEREAS, on May 31, 2006, June 21, 2006 and September 20, 2006, the 16 Carlsbad Planning Commission held duly noticed public hearings to consider the proposed 17 Robertson Ranch Master Plan (MP 02-03) and adopted Planning Commission Resolution No. 18 6106 recommending approval of MP 02-03. NOW, THEREFORE, the City Council of the City of Carlsbad does ordain as follows: JW-l 22 SECTION I: That the findings and conditions of the Planning Commission in 23 Planning Commission Resolution No. 6106 shall also constitute the findings and conditions of 24 the City Council except that Condition No. 22 shall not be adopted and a new condition shall 25 be adopted as follows: 26 Condition 22. In conjunction with the submittal with the first Tentative Map for the West Village, the developer of the West Village shall coordinate with the Colony 27 HOA or its designated representatives to determine what methods of traffic calming, if any, are acceptable to the residents according to the procedures in the 7.8 then-current Residential Traffic Manaaement Proaram (RTMPV Such traffic 1 calming measures shall be finally determined by the City Engineer and shall be designed and secured by the developer prior to the recordation of the first Final 2 Map with in the West Village. Such traffic calming measures shall be installed prior to the extension of Glasgow Drive and Edinburgh Drive. 3 In addition, and not in lieu of the above obligation, prior to the approval of the first 4 Final Map in the West Village, the developer shall also prepare, to the satisfaction of the City Engineer, a "Master Plan" of traffic calming measures for the Colony 5 neighborhood supplemental to the measures secured above. These supplemental measures may include any approved traffic calming measures found in the then-6 current version of the Traffic Calming Tool Box of the RTMP that can be feasibly be constructed within the existing right of way of the Colony residential streets. The developer shall enter into secured Development Improvement Agreement with the City guaranteeing construction of the approved supplemental traffic calming measures. The form of the security and the agreement shall be approved by the n City Attorney and in an amount established by the City Engineer. Individual traffic calming measures shall be installed by the developer as directed by the City Engineer. Upon completion of any traffic calming improvements, the amount of the security may be reduced commensurate to the value of the remaining improvements in the traffic calming "Master Plan". The provisions of this agreement shall expire five years after occupancy of the final unit or building within 12 the West Village or ten years from the recordation of the first Final Map within the West Village, which ever first occurs. Any remaining security shall be returned to 13 the developer upon expiration of the agreement. 14 SECTION II: That Master Plan MP 02-03 dated May 31,2006, attached and incorporated 15 herein by reference, and incorporating all recommended changes included in Planning 16 Commission Resolution No. 6106, is approved. The Master Plan shall constitute the 17 development plan for the property and all development within the plan area shall conform to 18 the plan.19 K EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be 22 published at least once in a publication of general circulation in the City of Carlsbad within 23 fifteen days after its adoption. 24 25 26 /// 27 /// 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 7,8 INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City Council on the 14th day of November . 2006, and thereafter.
