2 AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, ADOPTING A VEHICLE WEIGHT
3 LIMIT ON THE ENCINAS CREEK BRIDGE, SOUTHBOUND
CARLSBAD BOULEVARD.

WHEREAS, The Carlsbad Municipal Code authorizes the City Council to adopt an

urgency ordinance by a majority vote and make it effective immediately when a delay would
c
adversely affect the public health, safety or general welfare, now therefore,
The City Council of the City of Carlsbad, California, hereby ordains as follows:
8 "The City Council of the City of Carlsbad finds that Encinas Creek
Bridge is in a weakened condition. Upon the advice of the California
Department of Transportation (CALTRANS), it has determined that a
vehicular weight limit shall be placed on the Encinas Creek Bridge,
located on Southbound Carlsbad Boulevard between Palomar Airport
Road and Poinsettia Lane as follows and as shown in Exhibit "A":

14 This section is to be in effect for ninety (90) days from its adoption
and provided CALTRANS finds that the weight limits should be
continued, this section shall remain in effect until the Encinas Creek
Bridge is repaired and shall be automatically repealed and of no
further force and effect upon the filing of a notice of completion of the
repair."
This ordinance is hereby declared to be an urgency ordinance adopted as an emergency
18 measure to protect the public health, safety and welfare pursuant to Carlsbad Municipal Code
19 Section 1 .20.160 and shall take effect immediately upon its adoption.
20 The City Clerk shall certify the adoption of this ordinance and cause it to be published at
21
least once in a newspaper of general circulation in the City of Carlsbad within fifteen (15) days after
22 its adoption.

Council on the 2nd day of December, 2008, by the following vote to wit:
