CS-093 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AUTHORIZING AN AMENDMENT TO THE 3 CONTRACT BETWEEN THE CITY COUNCIL AND THE BOARD OF 4 ADMINISTRATION OF THE CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM 5 WHEREAS, the City Council authorized the City to initiate an amendment of the 6 City's contract with CalPERS to provide a 2nd tier retirement plan that includes the 2% at 7 50 retirement benefit (Section 21362) and Three Year Final Compensation benefit o 9 (Section 20037) for employees entering membership for the first time in a City of 10 Carlsbad safety classification effective October 4, 2010. 11 NOW, THEREFORE, the City Council of the City of Carlsbad ordains as follows: 12 That an amendment to the contract between the City Council of the City of 13 Carlsbad and the Board of Administration of the California Public Employees' 14 Retirement System is hereby authorized, a copy of said amendment marked "Exhibit" to Resolution No. 2010-171 16 The Mayor of the City of Carlsbad is hereby authorized, empowered, and 17 directed to execute said amendment for and on behalf of said Agency. 18 This ordinance shall be effective thirty days after the date of its adoption; and the 20 City Clerk shall certify the adoption of this ordinance and cause it to be published at 21 least once in a newspaper of general circulation in the City of Carlsbad within fifteen 22 days after its adoption. 23 /// 24 /// 25 /// 26 /// 27 28 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City Council on the dav29tb of .TIINF. 2010, and thereafter PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of Carlsbad on the 27th day of July , 2010, by the following vote: AYES: Council Members Lewis, Kulchin, Hall and Packard.
