AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER 10.44,
SECTION 10.44.520 OF THE CARLSBAD MUNICIPAL CODE BY
4 INCREASING THE PRIMA FACIE SPEED LIMIT TO 45 MILE PER
HOUR UPON BATIQUITOS DRIVE FROM POINSETTIA LANE TO
5 GOLDEN STAR LANE AND TO 40 MILE PER HOUR UPON
BATIQUITOS DRIVE FROM GOLDEN STAR LANE TO AVIARA
6 PARKWAY.
7 The City Council of the City of Carlsbad, California, hereby ordains as follows:
8 SECTION 1: That Title 10, Chapter 10.44 of the Carlsbad Municipal Code is amended
9 by the revision of Section 10.44.520 to read as follows:
10 "10.44.520 Batiauitos Drive:
11 a. Upon Batitquitos Drive from Aviara Parkway to its intersection
with Golden Star Lane, the prima facie speed limit shall be
12 forty miles per hour.
b. Upon Batiquitos Drive from Kestrel Drive to its intersection
13 with Golden Star Lane, the prima facie speed limit shall be
forty-five miles per hour.
14 c. Upon Batiquitos Drive from Poinsettia Lane to its intersection
with Kestrel Drive, the prima facie speed limit shall be forty-
15 five miles per hour.
d. Upon Batiquitos Drive from Poinsettia Lane to its intersection
16 with Camino del las Ondas, the prima facie speed limit shall
be thirty miles per hour."17
EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption; and18
the City Clerk shall certify the adoption of this ordinance and cause it to be published at least once in
a newspaper of general circulation in the City of Carlsbad within fifteen (15) days after its adoption.

INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City Council on
the 14th day of September 2010, and thereafter.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the
City of Carlsbad on the 28th day of September 2010 by the following vote to wit:
AYES: Council Members Lewis, Hall, Packard and Blackburn.
NOES: None.
ABSENT: Council Member Kulchin.
ABSTAIN: None.
