CS-174 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING CHAPTER 2.16, SECTIONS 2.16.050, 2.16.060, AND 2.16.085 OF THE CARLSBAD MUNICIPAL CODE RELATED TO THE BOARD OF LIBRARY TRUSTEES The City Council of the City of Carlsbad, California, does ordain as follows: SECTION 1: That Chapter 2.16, Sections title of the Carlsbad Municipal Code is amended to read as follows: Chapter 2.16 - BOARD OF LIBRARY TRUSTEES 9 Sections: 2.16.005 -Created. 2.16.010 - Membership—Appointment—Terms 11 2.16.025 - Monthly meetings 2.16.030 - Special meetings 12 2.16.035 -Quorum 2.16.040-President 2.16.045 - Record of proceedings 2.16.050 - Rules, regulations and bylaws for the Administration of the Board 2.16.055 - Administration of trusts—Receipt, holding and disposal of property 15 2.16.060 - Recommendations to city council 2.16.070 - Purchase of real property—Erection or rental and equipment of buildings or rooms 16 2.16.075 - State publications 2.16.080 - Borrowing library materials ^'^ 2.16.085 - Incidental powers of board 2.16.090 - Annual report 2.16.095 - Safety, preservation and application df funds not payable into library trust fund 19 2.16.105 - Free use of library by residents and nonresident taxpayers—Exclusions 2.16.110 - Contracts for lending books with neighboring municipalities or county- 20 Compensation 2.16.115- Title to property 22 SECTION 2: That Chapter 2.16, Sections 2.16.050 ofthe Carlsbad Municipal Code is 23 amended to read as follows 24 2.16.050 - Rules, regulations and bylaws for the Administration of the Board The board of library trustees may make and enforce all rules, regulations and bylaws necessary 25 for the administration of the board of library trustees and all property belonging thereto. 26 27 28 EXHIBIT 1 1 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 3: That Chapter 2.16, Sections 2.16.060 ofthe Carlsbad Municipal Code is 2 amended to read as follows: 3 2.16.060 - Recommendations to city council The board of library trustees may make recommendations to the city council and advise the city 4 council in matters pertaining to the following: (1) The duties and powers of the librarian and other library employees; 5 (2) The number of employees; (3) The purchase of equipment, real estate and buildings; 5 (4) The advisability and desirability of facilities of the city library; (5) The amounts of moneys required to operate the library; 7 (6) Policies related to the administration of the city library. 8 9 10 11 SECTION 4: That Chapter 2.16, Sections 2.16.085 ofthe Carlsbad Municipal Code is 12 amended to read as follows: 2.16.085 - Incidental powers of board The board of library trustees may do and perform any and all other acts and things necessary or proper to carry out the provisions of this chapter. The board of library trustees shall further have the power to promulgate and adopt rules and regulations pertaining to the city library. EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption and the City Clerk shall certify the adoption of this ordinance and cause it to be published at least once in a newspaper of general circulation in the City of Carlsbad within fifteen days after its adoption. /// /// /// /// /// /// /// 3 1 INTRODUCED AND FIRST READ at a Regular Meeting of the Carlsbad City Council on 2 the 13th day of March 2012, and thereafter. 3 PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the 4 City of Carlsbad on the 27th day of March 2012 by the following vote to wit: 5 6 AYES: Council Members Hall, Kulchin, Blackburn, Douglas, Packard. 7 NOES: None. 8 ABSENT: None. ^ ABSTAIN: None. 10 11 12 13 ( V(l«.^^ Q.
