CS-195 2 II AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING CHAPTER 1.20 OF 3 II THE CARLSBAD MUNICIPAL CODE REGARDING REGULAR MEETINGS 4 — 5 6 7 8 NOW, THEREFORE, the City Council of the City of Carlsbad ordains as follows: SECTION 1: That section 1.20.010 of the Carlsbad Municipal Code is 9 11 amended to read as follows: 10 11 12 16 1.20.010 - Regular meetings. The city council shall hold regular meetings on the dates and times specified by resolution of the city council. If by reason of fire, flood or other emergency, it is 13 II unsafe to meet in the council chambers, the meetings may be held for the duration of the emergency at such other place as is designated by the mayor, or, if he should fail to act, by three members of the city council. When the day for any 15 II regular meeting falls on a legal holiday, such meeting shall be held at the same hour and place on the next succeeding day not a holiday or such other time as designated by the city council. II SECTION 2: That section 1.20.020 ofthe Carlsbad Municipal Code is 18 amended to read as follows 19 " 20 1.20.020 - Special meetings. 21 11 Special meetings may be called at any time by the mayor or three members of the city council by delivering personally or by mail, facsimile, or electronic mail, written notice to each council member and to each local newspaper of general circulation, 23 II radio or television station having filed written request for such notice. Such notice must be delivered personally, or by mail, facsimile, or electronic mail, at least twenty-four hours before the time of such meeting as specified in the notice. The 25 II notice ofthe special meeting shall also be placed on the city's website. The call and notice shall specify the time and place of the special meeting and the business to II be transacted. No other business shall be considered at such meetings. Such written notice may be dispensed with as to any council member who at or prior to the time the meeting convenes files with the city clerk a written waiver of notice. 28 II Such waiver may be given by telegram, facsimile, or electronic mail. Such written notice may also be dispensed with as to any council member who is actually present at the time it convenes. The call and notice shall be posted at least twenty- 2 four hours prior to the special meeting on the council chambers door. 3 SECTION 3: That section 1.20.060(f) ofthe Carlsbad Municipal Code 8 18 19 20 21 22 23 26 27 28 is amended to read as follows: 1.20.060 - Council agenda. (f) At least 72 hours before a regular meeting, the city clerk shall post an agenda containing a brief general description of each item of business to be transacted or 7 II discussed at the meeting, including items to be discussed in closed session. A brief general description of an item generally need not exceed 20 words. The agenda shall specify the time and location of the regular meeting and shall be posted at City 9 II Hall and at the meeting place if not City Hall. The agenda shall also be placed on the city's website. The city clerk shall prepare and file a signed declaration of the time and place of posting and a certified copy of the posted agenda. Except as 11 II provided in subsection (h) of this section no business shall be transacted or discussed at the meeting on any item not appearing on the posted agenda.
