HomeMy WebLinkAbout2016-08-23; City Council; CS-305; AN ORDINANCE AMENDING TITLE 10, CHAPTER 10.44, SECTION 10.44.070 OF THE CARLSBAD MUNICIPAL CODE ESTABLISHING A PRIMA FACIE SPEED LIMIT UPON A PORTION OF LA COSTA AVEEXHIBIT 1 1 ORDINANCE NO.CS-305 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA,AMENDING TITLE 10,CHAPTER 10.44,SECTION 3 10.44.070 OF THE CARLSBAD MUNICIPAL CODE ESTABLISHING A 4 PRIMA FACIE SPEED LIMIT UPON A PORTION OF LA COSTA AVENUE. 5 6 NOW,THEREFORE,the City Council of the City of Carlsbad,California,hereby 7 ordains as follows that: 8 1.Title 10, Chapter 10.44 of the Carlsbad Municipal Code is amended by the revision of 9 Section 10.44.070 to read as follows: 10 "10.44.070 La Costa Avenue: 11 a)Upon La Costa Avenue from El Camino Real to a point 1,000 feet easterly the prima facie speed limit shall be 35 12 miles per hour. 13 b)Upon La Costa Avenue from a point 1,000 feet easterly of El Camino Real to its intersection with Rancho Santa Fe 14 Road shall be 40 miles per hour. c)Upon La Costa Avenue from Rancho Santa Fe Road to its 15 intersection with Camino de los Coches shall be 45 miles 16 per hour. d)Upon La Costa Avenue from Interstate Highway 5 to its 17 intersection with El Camino Real the prima facie speed limit shall be 55 miles per hour. 18 e)Upon La Costa Avenue from Camino de los Coches to Circulo Sequoia the prima facie speed limit shall be 35 19 miles per hour." 20 EFFECTIVE DATE:This Ordinance shall be effective 30 days after its adoption, and 21 the City Clerk shall certify the adoption of this Ordinance and cause the full text of the Ordinance or 22 a summary of the Ordinance prepared by the City Attorney to be published at least once in a 23 newspaper of general circulation in the City of Carlsbad within 15 days after its adoption. 24 ///25 26 27 28 1 INTRODUCED AND FIRST READ at a Regular Meeting of the Carlsbad City Council on the 2 26th day of July, 2016, and thereafter 3 PASSED AND ADOPTED at a Regular Meeting of the City Council of the City of Carlsbad, 4 California, on the 23rd day of August ,2016, by the following vote, to wit: 5 AYES:Hall, Wood, Schumacher, Blackburn, Packard. 6 NOES:None. 7 8 ABSENT:None. 9 10 11 APPROVED AS TO FORM AND LEGALITY: 12 13 _ 14 —— CELIA BREWER,ity Attorney 15 1/AfrMATT HALL, Mayor 16 17 ATTEST: 18 19 C (c...1. — BARBARA ENGLES6N, City Clerk 20 (SEAL) 21 22 23 24 25 26 27 28
