BE IT ORDAINED BY THE BOARD OF DIRECTORS 0.F CARLSBAD MU
'WATER DISTRICT AS FOLLOWS:
SECTION 1. SECTION 17B (2) (a) OF ORDINAN.CE No, lo ADDED To
AMENDED.
Section 17% (2)(a) of Ordinance No. 10 is hereby amended and added to
follows :
(a). If the installation is made upon a cash basis., the district will agree to pay to smh applicant or applicants or to
their heirs, executors, or assigns, fifty per cent (50700)
of the actual water consumption charge received by
the district from the sale and d.elivery of water through facilities as described in sub-section (7) hereinafter ; provided however, that the SUM to be refunded in any one year shall not exceed twenty per cent (2070) of the total actual cost of installation and construction of the pipe line which has been determined to be part of the distribution system of the District;
that such basic payments shall continue fo r a period of ten (10) years, or until the actual cost of the
construction and installation of that part of the line
which has been determined to be part of the district's basic distribution system, as set forth hereinabove, 'has been paid, whichever event occurs first.
SECTION 2. SECTION 17 B (2) (b) of ORDINANCE 10 ADDED TO AND AMENDED.
Section 17B (2) (b) of Ordinance No. 10 is hereby amended and added to
as follows :
(b). If the installation is made.under the Improvement Act of 1911, Division 7 of the Streets and Highways Code, the district will agree to pay to the owner oni owners of the property assessed within the district, said payment.s running with the land at all times
mentioned herein, fifty per cent (5070) of the actual
water consumption charges received by the district
from the sale and delivery of water through said
provided however, that the sum to be refunded in any one year shall not exceed twenty per cent (2070) of

Carlsbad Municipal 'Water District, at a special meeting held on the 28t
of October, 195.8, by the following vote:
