AN ORDINANCE OF THE CARLSBAD MUNICIPAL WATER DISTRICT
ESTABLISHING STANDARD REQULREMENTS FOR WHOLESALE CONNEC
TION SYSTEM AND TO REPEAL SECTION 4 laF ORDINANCE NO. 10.

WHEREAS , THE CARLSBAD MUNICIPAL WATER DISTRICT ,
hereinafter referred to as "the district" is organized under the Municipal Water District Act of 1911 , as amended; and
WHEREAS, Section 71614 of the Municipal Water District Law of 191 1 provides that the Board of Directors of a municipal water district, shall have the power to fix the rates at which water shall be sold, and to establish different rates for different classes or conditions of service; provided that rates shall be uniform for like classes or conditions of ser-
vice throughout the district; and
WHEREAS, the Board of Directors has made a study of other distr, bution systems, the relationship between this district and wholesale water
agencies within the district, and has considered the problems relative to
providing wholesale connections and maintaining the integrity of the distric
distribution system; and
WHEREAS, the Board of Directors deems it expedient, proper and
necessary that the Board establish standards to guide the Board in determ
what constitutes a wholesale connection;
I NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRE( OF THE CARLSBAD MUNICIPAL WATER DISTRICT AS FOLLOWS:
1. (Repeal) Section 4 of Ordinance No. 10 of this district relating 1 wholesale connections is hereby repealed.
2. That wholesale connections will be granted to existing agencies falling within one of the categories provided in Section 3 of Ordinance No.
or to newly organized agencies established and prepared to serve water to
potential users within a primary distribution area as established in the ma
water distribution system of the district, provided that at the time of the
connection, said agency shall have existing and ready for use a distributio~
system satisfactorily designed and located to serve an area properly subdi
vided and in a condition to be owned by fifty potential retail water consume Said distribution system must be owned by the agency, functioning and real for use. The minimum size meter at such a connection shall be a 6" com, meter to be installed to the specific ations of the district. The Board of Directors reserves the right to grant a wholesale connection to an agency 7 does not qualify under the foregoing, provided said failure to qualify is cau by factors beyond the control of said agency, such as geographic location a economic feasibility. Any deviation from the above standard shall be app~ by the Board by resolution.
rn 3. Upon application by an agency as above defined, the Board of Directors will review plans and specifications for any distribution system
and shall approve or disapprove the same for qualification as a wholesale
distribution system and, if approved, a wholesale connection will be grantt
upon completion of the system in accordance with the plans and specificatic

of the Carlsbad Municipal Water District, at a regular meeting held on the 16th day of June, 1964, by the following vote:
