I AN ORDINANCE OF THE CARLSBAD MUNICIPAL WATER DISTRICT
TO ESTABLISH AND TO DEFINE TYPES AND CONDITIONS OF WATER
DELIVERY; TO PR.OVIDE R/IETHOD OF ESTABLISHING AND FIXING
R.ATES AND CHARGES FOR WATER DELIVERED; TO PROVIDE METHOE FOR EXTENSION OF DISTRICT'S FACILITIES; AND TO PARTIALLY
REPEAL ORDINANCES 10, 12, 14, 16 and 21.
WHEREAS, Carlsbad Municipal Water District, hereinafter called I' District", is organized under the Municipal Water District Law of 1911;
and
WHEREAS, said Municipal Water District Law provides method by
which District shall establish types and conditions of service, fix rates anc
charges, provide method of extension of facilities and repeal existing ordinances as necessary; and
WHER,EAS, present conditions render existing Ordinances No. 10,
12, 14, 16 and 21 partially ineffectual; and
WHEREAS, the Board of Directors of Carlsbad Municipal Water District deems it expedient, proper and necessary to establish and define types and conditions of water delivery, provide method of fixing rates and
charges, provide for extension of facilities, and to repeal certain existing
ordinances; I NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
DIRECTORS OF THE CARLSBAD MUNICIPAL WATER DISTRICT AS
FOLLOWS:
ARTICLE I (REPEAL). That Ordinances No. 10, 12, 14, 16 and 2
be, and hereby are, repealed in so far as they are inconsistent herewith.
ARTICLE I1 (DEFINITIONS). That the meaning of words and termj
used in this Ordinance and in subsequent Ordinances and Resolutions shall,
unless the context specifically indicates otherwise, be as follows:
Section 1. District" shall mean Carlsbad Municipal Water Distri
Section 2. "Board" shall mean Board of Directors of Carlsbad

Section 3. Connection'' shall mean metered water service from II
District facilities.
A. Wholesale Connection'' shall mean connection to serve a I'
Mutual Co. Public Agency or Municipal Corporation which
is a holder of Certificate of Convenience issued by California
Public Utilities Commission and which otherwise meets re-
quirements of Article No. IX of this Ordinance. I B. Retail Connection" '1
1. Individual" - A connection to serve a single, domestic I'
dwelling and/or other use including agriculture.
2. "Multiple" - A single connection to serve a multiple
dwelling building or multiple buildings designed as
dwelling units.
3. Condominium'' - A connection to serve a joint owner- ''
ship property which contains single ownership properties within its boundaries.
4. "Mobile Home Park" - A connection to serve property
which is used for the parking of mobile homes or house trailers.

5. "Camp Park" - A connection to serve property which is
used for available space for tents, campers, trailers,
or other like temporary domestic usage for periods of
not more than fifteen days per use.
6. Construction" - A temporary connection to serve a con- 11
struction project, - i. e. building construction, grading
operation, road construction.
7. Special'' - Any connection which presents an unusual II
condition not above defined.
Section 4. User'' shall mean any legal entity being served water I'
District through a "Connection".
Section 5. Facility" shall mean any physical feature (such as 11
Reservoir, tank, pipeline) designed to store or transmit and/or distribute
water to "User".
Section 6. Extension'' shall mean any addition to a "Facility".
ARTICLE I11 (RATES and CHARGES). That rates and charges for
all water delivered by District shall be fixed, and may be changed as nece
by R,esolution of the Board.

ARTICLE IV (APPLICATION FOR SERVICE). That installation of
connection will be effectuated upon District's receipt of a properly execute
application (application form to be furnished by District) accompanied by
User's deposit in the amount of the estimated costs of connection installati
ARTICLE V (FACILITY EXTENSION). That District facilities ma
be extended by other than District by written agreement between District a
User; that District may, from time to time, adopt, by Resolution, rules
relating to facility extensions by others than the District.

ARTICLE VI (FLOW CONTROL). That during times of shortage,
threatened shortage, of supply, the District will apportion available water among its wholesale and retail consumers in accordance with the provisio~
of the Municipal Water District Law of 1911, assigning priorities to dome;
and other uses as may be found necessary by the Board of Directors of the
District after due process.
AR.TICLE VI1 (METER TEST). That if a User questions the accur
of a meter and makes the required de osit, a test will be made. The dep shall be $15. 00 for any meter up to 2"and $30. 00 for any meter above 2".

ARTICLE VI11 (AUTHORIZED USAGE). That, except by contract1 agreement with the District, water through any connections shall be used 1
for property and purposes described in application. 1 ARTICLE IX (WHOLESALE SERVICE QUALIFICATION). That
wholesale connections will be granted to existing agencies falling within 01:
of the categories provided in ARTICLE 11, Section 3A above, or to newly
organized agencies established and prepared to serve water to all potentia
users within a primary distribution area as established in the master watc distribution system of the District, provided that at the time of the connec said agency shall have existing and ready for use a distribution system

reserves the right to grant a wholesale connection to an agency which does
qualify under the foregoing, provided said failure to qualify is caused by fa

will review plans and specifications for any distribution system and shall
approve or disapprove the same for qualification as a wholesale distributio
system and, if approved, a wholesale connection will be granted upon comg
tion of the system in accordance with the plans and specifications. Custor being served through connections not qualifying as wholesale shall be billec
the prevailing retail rate even though they might qualify for wholesale rater
otherwise.
ARTICLE X (RULES AND R,EGULATIONS). That the Board of
Directors may establish rules and regulations as will augment provisions c
this Ordinance.
ARTICLE XI. That this Ordinance may, as deemed necessary, be amended by Ordinance or Resolution by Board of Directors.
