ORDINANCE OF THE COSTA REAL MUNICIPAL WATER DISTRICT ESTABLISHING FEES FOR ENGINEERING SERVICES
WHEREAS, the Costa Real Municipal Water District provides
engineering services to the public in connection with the
development of real property within the District; and
WHEREAS, such engineering services include the review and approval of water facilities, including reservoirs, water transmission line installation, replacement and relocation in
connection with the subdivision review process of the City of
Carlsbad; and
WHEREAS, the City of Carlsbad does not routinely currently
charge subdividers and other developers of property a fee for such engineering services; and
I WHEREAS, the District has historically accepted deposits
from developers based upon the estimated cost of the engineerin!
services to be provided; and
WHEREAS, such a system of deposits is administratively
burdensome and unwieldy; and
WHEREAS, the District has estimated, based on past experience, the actual cost of providing engineering plan
checking and construction inspection services for projects of
various sizes; a summary of the information on which this
estimate is based has been available to the public for not less than ten (10) days;
NOW, THEREFORE, BE IT ORDAINED by the Board of Directors of the Costa Real Municipal Water District as follows:
Section 1: Amendment of Administrative Code. Article 9 shall be added to the Administrative Code of the Costa Real Municipal Water District to read as follows:
Article 9. Engineering Services Fees.

9.1. Policy. The Engineering Department shall
provide plan checking and construction inspection services for water facility services to be constructed

I and added to the water system of the District at a charge not to exceed the estimated cost of providing such services.
9.2. Fees. The following fees shall be charged, based upon the estimated construction costs of the water facilities only, as determined by the District Engineer or his designee upon review of the plans submitted in connection with any type of development within the District:

I 9.3 Adjustment of Fees By Resolution. The District shall periodically review the fees charged for
engineering services described above to insure that the
fixed fees do not exceed the estimated costs of
providing the services, and are fair and appropriate. Adjustments to the above schedule of fees may be made at any time by resolution.
9.4 When Paid. Fees shall be payable after submission of plans for plan check, and pri-or to
completion of plan check and approval of plans by the
District Engineer.
9.5 Fees Paid to City of Carlsbad. In the event the City of Carlsbad collects fees for water facility plan checking and inspection services, the District Engineer may reduce the fees collected hereunder, based upon the work actually to be performed by District forces. Those submitting requests for services under this Article shall provide evidence of any such payments.
Section 2. Effective Date. This Ordinance shall take effect on the 30th day following its adoption.
