Declaration of Policy. California Water Sections 375 et seq. permit public entities which supply wat retail to adopt and enforce a water conservation pr.ogrz reduce the quantity of water used by the people therein fo purpose of conserving the water supplies of such public en The Board hereby establishes a comprehensive water conserv program pursuant to California Water Code Sections 375 et based upon the need to conserve water supplies and to avo. minimize the effects of any future shortage. SECTION 2. Findinqs. The Board finds and determines tl water shortage could exist based upon the occurence of or more of the following conditions: (A) A general water supply shortage due to increased del or limited supplies. I (B) Distribution or storage facilities of San Diego Cou: Water Authority or other agencies become inadequate. (C) A major failure of the supply, storage and distribut facilities of the Metropolitan Water District of Southern California, the San Diego County Water Aut1 ity, or of the Carlsbad Municipal Water District occ The Board also finds and determines that the condit prevailing in the San Diego County area require that the F resources available be put to maximum beneficial use to extent to which they are capable, and that the wastc unreasonable use, or unreasonable method of use, of wate. prevented and that the conservation of such water be encoux with a view to the maximum reasonable and beneficial use thc in the interests of the people of the Carlsbad Municipal b District and for the public welfare. SECTION 3. CEOA Exemption. The Carlsbad Municipal F District finds that this Ordinance and actions taken herez pursuant to this Ordinance are exempt from the California E ronmental Quality Act as specific actions necessary to prever mitigate an emergency pursuant to Public Resources Code Sec 21080(b)(4) and the California Environmental Quality Act Gu lines Section 15269(c). The Manager of the District is he authorized and directed to file a Notice of Exemption as so0 possible following adoption of this Ordinance. I . .. SECTION 4. ApDlication. The provisions of this Ord shall apply to all persons, customers, and property served b Carlsbad Municipal Water District. I SECTION 5. Authorization. The Carlsbad Municipal District's General Manager, or a designated representativc hereby authorized and directed to implement the provisior this Ordinance. SECTION 6. Water Conservation Staqes. No customer of Carlsbad Municipal Water District shall knowingly make, ci use, or permit the use of water supplied by the District residential, commercial, industrial, agricultural, governme1 or any other purpose in a manner contrary to any provisic this Ordinance, in an amount in excess of the amounts autho: by this Ordinance, or during any period of time other thar periods of time specified in this Ordinance. At no time I water be wasted or used unreasonably. The following stages : take effect upon declaration as herein provided. (A) STAGE 1 - VOLUNTARY COMPLIANCE - WATER WATCH. (Dl STAGE 4 - MANDATORY COMPLIANCE - WATER EMERGENCY. 4 applies when a major failure of any supply or di bution facility, whether temporary or permanent, o in the water distribution system of the State Project, Metropolitan Water District, San Diego C Water Authority, or Carlsbad Municipal Water Dis facilities. During STAGE 4, the following F conservation measures shall apply EXCEPT WHEN RECL WATER IS USED: 1. All outdoor irrigation of vegetation is prohib UNLESS RECLAIMED WATER IS AVAILABLE AND PERMIT 2. Use of water for agricultural or commercial nu purposes, except for livestock watering prohibited, UNLESS RECLAIMED WATER IS AVAILABL PERMITTED. 3. Washing of autos, trucks, trailers, boats, planes and other types of mobile equipmen prohibited, EXCEPT WHEN RECLAIMED WATER IS . No water shall be used for air conditic PUToses, UNLESS RECLAIMED WATER IS AVAILABLI PERMITTED. SECTION 7. Mandatory Conservation Phase ImDlementation. Thereafter, the Manager may order that appropriate stage of water conservation be implemente terminated in accordance with the applicable provision of Ordinance. The declaration of any stage beyond STAGE 1 shal made by public announcement and notice shall be publish minimum of three (3) consecutive times in a newspaper of gel circulation. The stage designated shall become effec I -6- 1 immediately upon announcement. The declaration of any beyond STAGE 1 shall be reported to the Board of Directors a next regular meeting. The Board of Directors shall ther ratify the declaration, rescind the declaration, or direci declaration of a different stage. SECTION 8. Penalty. As provided in Water Code Section any violation of this Ordinance is a misdemeanor. conviction thereof such person shall be punished by impriso in the county jail for not more than 30 days, or by fin< exceeding one thousand dollars ($l,OOO), or by both.
