Contractor acknowledges that California Government Code sections 12650 et seq., the False Claims Act, provides for civil penalties where a person knowingly submits a false claim to a public entity. These provisions include false claims made with deliberate ignorance of the false information or in reckless disregard of the truth or falsity of the information. The provisions of Carlsbad Municipal Code sections 3.32.025, 3.32.026, 3.32.027 and 3.32.028 pertaining to false claims are incorporated herein by reference. The certificates shall indicate coverage during the period of the contract and must be furnished to the City prior to the start of work. The minimum limits of liability Insurance are to be placed with insurers that have: (1) a rating in the most recent Best's Key Rating Guide of at least A-:V and (2) are admitted and authorized to transact the business of insurance in the State of California by the Insurance Commissioner. This causes the recurring requirement of clean outs, an ongoing expense. Proposal Overview Anue Water Technologies proposes to provide a mechanical solution which will increase aerobic activity as well as automate the clean out of FOG within "Simsbury" Lift Station. The EP-1110-P223 system will accomplish this through 4 beneficial actions: A. Agitation- Takes place when the EP-1110-P223 system is operational. This action breaks down and prevents biofilm and FOG formation. • Benefit: Layer build-ups that impede oxygen diffusion are removed and prevented from forming. B. Oxygenation- The EP-1110-P223 system hovers 4ft above the high water mark. A small fraction of wastewater is recycled into the well taking up oxygen in the process. • Benefit: Substantial increase of DO levels and corresponding increase of aerobic activity that enables solids breakdown. C. Homogenization- This action physically breaks down solids increasing available surface area as well as evenly dispersing solids, bacteria, and oxygen. • Benefit: The EP-1110-P223 system provides a mechanical catalyst for enabling aerobic metabolism. This in turn reduces effluent loads and increases capacity downstream. D. Cleaning- The EP-1110-P223 system effectively washes down the lift station, floats, pumps, and other equipment keeping them free of films and fats. • Benefit: Significantly reduced maintenance costs by eliminating vacuuming, pressurized cleaning, and dumping. The Anue system is designed to remove and prevent build-up of organic matter in the well including bio-film and FOG. Our performance guarantee is that after any given cycle these build-ups will be eliminated. We use a conservative and quantitative measure of 80% of the surface area. The system will remove any buildup on the pump rails, walls, and floats. Further there will be complete liquidity of any additional FOG and biofilm entering the wet well. In general, we expect 95%+ reduction in an application like "Simsbury" due to its smaller size. At the end of the fourth week of the installation the City of Carlsbad will either: Accept- user will agree to pay for the system Reject- Anue will remove the equipment with no charge to the user.
