HomeMy WebLinkAboutArtukovic Family 1999 Trust; 2008-12-26;AGREEMENT This Agreement is made and entered into as of the <£~ £ day of - 2Qcff, by and between the City of Carlsbad, a municipal corporation, ("City"), and Artukovic Family 1999 Trust, hereinafter referred to as "Owner". RECITALS 1. Property parcels 203-051-04 and 203-051-01 at 2550 and 2560 Carlsbad Boulevard ("Properties") in the City of Carlsbad held by the Owner contain an underground storm drain and sanitary sewer that convey flows from Carlsbad Boulevard across the Properties to North County Transit District (NCTD) Right-of-Way. 2. The storm drain has been in existence prior to the current Owner's acquisition of the property in 1976. 3. An easement for the storm drain could not be located at the County of San Diego Register's office. 4. The City asserts that it has a prescriptive easement for the storm drain. However, the owner disputes the existence of such a prescriptive easement. 5. The storm drain has failed and requires immediate repair. 6. The City requests the owner's permission to enter the above described property for the purposes of repairing and replacing the storm drain. The work may include clearing and grubbing, vehicle and equipment access, parking, materials and equipment storage, excavation, compaction, and other associated functions. All work performed by the City will be at no cost to the Owner. 7. A storage shed is located over a portion of the storm drain. 8. The storage shed crosses property lines between Owner and NCTD and is not a permitted structure. 9. The storage shed will have to be removed to repair the damage and install a new storm drain in the same alignment. 10. The City will remove the storage shed at no cost to the Owner. The City will compensate the Owner for the shed in the amount of one thousand dollars ($1,000). 11. The City desires to perfect the easement for the storm drain and adjacent sanitary sewer line. 12. Given the nature of the emergency, the City does not have the time to prepare the necessary easement documents before repair construction starts. 13. The new pipe will be placed where the existing pipe is as long as adjacent structures do not interfere with construction. In areas where this cannot be accomplished, the storm drain will be placed in a new alignment that is reasonable and acceptable to the owner. Owner will sign the plans showing the alignment as acceptable for alignment purposes before construction begins. 14. Once the replacement storm drain is in place, the City will survey the new alignment and prepare easement documents that are mutually acceptable to the Owner and the City for Owner's signature and recordation at the County of San Diego Recorder's office. 15. All work performed by the City on Owner's property should be completed within 100 working days. City will notify Owner if rain or other unforeseen events will delay the schedule past 100 working days. 16. Upon completion of the work, the City will return the property to its original condition within 30 working days with the exception of the shed. 17. The City will indemnify, defend and hold harmless the Owner concerning any liability that may arise from work done by the City. 18. The City will inspect the area and subsurface surrounding the storm drain to ensure ground stability as pertinent to the storm drain and work performed by the contractor as related to the storm drain failure and repairs. The City will provide to the Owner a geotechnical report documenting the ground surface and subsurface safety and stability in the area affected by the storm drain failure and repairs. NOW, THEREFORE, IT IS AGREED AS FOLLOWS: The Owner grants to the City and its contractor, permission to enter the property to construct the above mentioned improvements; That the Owner acknowledges the City's prescriptive easement for the storm drain and will sign a deed of easement for the storm drain and adjacent sewer line; That the City will remove the storage shed at no cost to the Owner; and That the City will survey the alignment of the new storm drain and prepare easement documents. The City shall perform all work in a professional manner per the approved plans and specifications. When completed, the City will restore the owner's real property to a condition similar to the existing condition, with the exception of the storage shed that will be removed, before the construction. Therefore, I hereby grant the City of Carlsbad, and its contractor, permission to enter my property to construct the above-mentioned improvements pursuant to the terms and conditions of the agreement between the City and the owner.
