HomeMy WebLinkAboutAT & SF Railway Company; 1976-09-01;c - 11007608 SUPPLEMENTAL AGREEMENT, Made this 3rd day of September, 1991, between THE ATCHISON, TOPEKA AND SANTA FE RAILWAY COMPANY, Delaware corporation, (hereinafater called "Santa Fe") and CITY OF CARLSBAD, a municipal corporation of the State of California (hereinafter called "Second Party"). Santa Fe and Second Party are now parties to an agreement dated November 1, 1976, Santa Fe's Secretary's Contract No. 151014, together with any and all modifications, supplements and amendments thereto (hereinafter called "Original Contract"), relating to five pipelines located on Santa Fe's property at Carlsbad, San Diego County, California. Second Party desires to construct an additional 24-inch RCP storm water pipeline across Santa Fe's right-of-way at MP 230+0507.7 and connect into the existing 4' x 10' box culvert at Tamarack Avenue, and the parties hereto desire to modify the Original Contract as hereinafter provided. IN CONSIDERATION of the sum of One Hundred Fifty and No/100 Dollars ($150.00) to be paid to Santa Fe by Second Party upon execution of this Supplement Agreement as a one-time charge for preparation of the revised Exhibit "A" drawing and administration of this Supplemental Agreement, it is mutually agreed that the print hereto attached No. l-01194, dated August 26, 1991, is hereby made part of the Original Contract. As herein modified, the Original Contract shall continue in full force and effect. IN WITNESS WHEREOF, this Supplemental Agreement has been duly executed in duplicate by the parties hereto as of the day and year first above written. FILE NO. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 91-316 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING THE FIRST SUPPLEMENTAL AGREEMENT TO AN AGREEMENT BETWEEN THE CITY OF CARLSBAD AND THE ATCHISON, TOPEKA AND SANTA FE RAILWAY COMPANY FOR CONSTRUCTION OF STORM DRAIN UNDER THE RAILROAD AT TAMARACK AVENUE WHEREAS, the City Council of the City of Carlsbad does hereby resolve as follows 1. The First Supplemental Agreement to an agreement between the City of Carlsbad and the Atchison, Topeka and Santa Fe Railway Company for construction of underground storm drain is hereby approved. 2. The Mayor of the City of Carlsbad is hereby authorized and directed to execute such agreement for and on behalf of the City of Carlsbad. Following the execution of this agreement, the City Clerk is authorized and directed to return the "Santa Fe Original" copy of this agreement to the Municipal Projects Department for further processing. PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council held on the sday of September , 1991 by the following vote, to wit: AYES: Council Members Kulchin, Stanton and Nygaard NOES: None ABSENT: Council Members Lewis and Larson ATTEST: ALETHA L.
