Since the City Attorney is not a member of the Retirement System, he is not eligible for OASDI coverage under the City's agreement. If the individual occupying the position of City Attorney should become a member of the Retirement System in the future, his services would be covered under the OASDI program. The City should apply the 2$6 OASDI contributions from the first $4200 wages paid to a covered employee during a calendar year. This applies to all wages paid through. 1958. For wages paid in 1959 the City should deduct OASDI contributions of 2$$ from the first $4800 wages paid to eligible employees. The specific answer to your question is that you do not apply the rate to the monthly salary up to the $350 a month, but rather you apply the rate to the total monthly salary regardless of th.e amount until the City has reported the maximum for the individual employee. In the questionnaire the City indicated that the City Manager was appointed effective November 1, 19%. His services performed as Police Chief were not covered under the OASDI program, since individuals in policeman positions are mandatorily excluded from coverage under the OASDI program. However, his services would be covered under OASDI as of the date he occupied a miscellaneous position with the City, which in this case would be that of City Manager. Since he was not in an eligible position on May 2'7, 1958, the Division Date, he does not have the option to choose whether or not he desires OASDI coverage; he automatically receives OASDI coverage, on November 1, 1958. &Please explain the status of the City Attorney. individual*"& on a contractual basis. After much research and study, our Board of Administration has developed a coordinated program which modifies our two basic formulas, that is, the l/60 at 60 fornn&a and the l/70 at 65 formula--the modifica- tion consisting of a reduction of benefits and contributions on that portion of nwxthly salary which Is subject to the Social Security program. In the case of the l/60 at 60 formula, the reduction is by one-third. at 65 forwla, the reduction is by one-half. In the case of the l/70 ThislsatrriLycoordlnatedprcgrsm in that the SEW benefits are reduced on those wages vhich will be earning Social Security benefits, snd similarly the SERS contribution rates are reduced on those wages on which the Social. Security contributions are made. Your contract with the State Employees I Retirement System provides for the modification of your retirement benefits snd monthly contributions on the first $350 of final compensation and monthly salary, a6, at the time your contract went into effect, your employees were earning Social Security benefits and paying Social Security contributions on their first $k!OO of annual wages ($350, of course, is the nronthly equivalent of the $4200 anuusl wage). As you probably know, effective January 1, 1959, there has been a change in the Social. Security program so that your employees are nov paying Social Security contributions and earning Social Security benefits on their first $4800 of annual earnings. In order for your SERS benefits to continue to coordinate with the Social Security program, they should now be modified on the first $400 of final compensation and monthly salary. Although not specifically stated in your contract, this was the intent of the Board of Administration when the modified program was developed. .- - -2- -L. In the reporttothe Governor made by our Board onDecember1,19~,the problem of coordinating with Social Security is discussed in soauz detail. The # need for continuing coordination of the SERS and Social Security programs received attention when the Board, speaking in terms of the modification of the l/&l program to obtainthl/~-1160 program, had the following to say: “The l/go-l/60 coordination vith Social Security could beccase too costly for both the employee and the employer. Precaution should be taken to insure that costs do not autcmaticsLly exceed those presently contemplated. This csnbe partiallyaccomplishedbyprovldingthat the l/W modification be applied not only to the $400 monthly compensa- tion now subject to Social Security taxes, but that it be applied toward future increases in covered wsges. Failure to do this maybe inviting disastrous future costs.(l Because of the change In the Social Security program, your SEXS contribution8 should now be modified with regard to the first $400 of monthly salary. Your pay- roll for the month of January and in some cases for a portion of the month of February, has already been submitted and processed using a modification on the first $350 of monthly salary. Although the modification commencing January 1, 1959, should have been on the first $400 of monthly salary, we do not feel that it is desirable to go back and make any adjustments. Your employees will receive credit under the $350 modification for the periods during which their contributions wze made! on this basis. However, with respect to your payrolls for February and later, your employees' contributions to this System should be submitted on the basis of a emdification of the first $400 of monthly wages. Enclosed with this letter are instructions from Hr. Robert Hecht, Chief of our Accounting Division, on what changes will be necessary in your February payroll submission. If you have any questions with regard to these procedures, you should contact Hr. Hecht. We are also enclosing with this letter copies of an amendrnt to revise the wording of your contract so that it will IIy3re precisely reflect the intent to have your benefits coordinateduiththe Social Securityprogrsm. Your contract, as we ln- terpret it, already calls for modification of your benefits to coordinate with the social Security program. The new rates are effective with respect to wages paid on and after January 1, 1962. Maximum covered wages continue to be the first $4,800.00 paid in a calendar year. MJ3DICAL CARE FOR AGED BILL SHOULD BE WATCHED From all indications, medical care for the aged under the Social Security program will continue to have high priority on the administration's legislative program. Since the proposal contains financing provisions calling for increases in OASDI contribution rates and maximal covered wages effective January 1, 1963, public agency budget or fiscal officials should follow its progress in Congress which will be reported in special bulletins next year. HR 4222 (King, California) is the major bill containing the medical care program introduced in the House of Repre- sentatives. It is presently before the House Ways and Means Comittee. STATE, UNIVERSITY OF CALIFORNIA EMPLOYEES TO BE COVERED BY SOCIAL SECURITY Effective December 31, 1961, State employees and employees of the University of California who are members of the State Employees' Retirement System will be under the OASDI program. Coverage is on the divided retirement system basis whereby current members of the Retirement System have an individual selection, with future members automatically covered by OASDI. ADDITIONAL COVERAGE OPPORTUNITY FOR CLASSIFIED SCHOOL EMPLOYEES In accordance with the provisions of 1961 State and Federal enabling legislation, an additional opportunity was extended to classified school employees who elected to remain out of the OASDI program when the Retirement System was divided with respect to such employees to transfer to the group covered by OASDI. Approximately 10% of those eligible to transfer took advantage of the new selection. BOARD TO CONSIDER CHANGE OF RULES The Board of Administration of the State hployees' Retirement System will meet in Sacramento on December 8. Among the items on the Board's agenda will be consider- ation of amendment to Section 599 of regulations included in the California Administrative Code. Section 599 relates to permitting public agencies (other than the State, the University of California, and school districts) to grant their employees a second chance to choose OA6DI coverage, where coverage was on the divided retirement system basis. The Board has received several requests to permit an additional opportunity for employees who have already had a second chance to transfer to the group covered by OASDI. As previously reported, the Social Security Act Amendments of 1961 extended Ret. OASDI 20 Rev. 10 (12-61) Annual Bulletin 2800 _.. c -. - _ -2- the deadline for transfer of employees who elected to remain out of OASDI at the time the retirement system involved was divided to transfer to the group covered by OASDI to December 31, 1962 or two years after coverage was obtained, whichever is the later. Comments are invited from interested parties. COVERAGE STATISTICS On December 1, 1961 there were 2,535 public agencies in California covered by OASDI, including 275 cities, 47 counties, 1,385 school districts, and 828 other local public agencies. Over 130,000 public employees in this State are covered under OASDI. Of this number, over 100,000 were also in jobs covered by a retirement system. CHANGES IN FEDERAL LAW GO INTO EFFECT, MONTHLY DEPOSITS PROPOSED Beginning with wages paid in 1962, public agencies will be favored with the same time limitations on assessments for unreported wages applicable to private employers. The general rule is that in the absence of fraud, no assessment can be made after the expiration of a period of three years, three months and fifteen days after the year in which the wages involved were paid, or three years after the contributions relating to the wages involved were due, whichever is the latest. The same general time limitation will apply to credits and refunds of overpayments relating to wages paid from 1962 on. 23-8 Cd, These provisions were incorporated in Section and (r) of the Social Security Act. Other legislation sponsored by the Conference of State Social Security Administrators, in which this State has membership, provides for a court procedure of decisions made by the Federal Government with respect to the OASDI program for public agencies. At its 1961 meeting in San Francisco, the Conference of State Social Security Administrators expressed strong opposition to any proposal which would require the States and local public agencies to make monthly deposits of OASDI contributions instead of paying contributions on the present quarterly basis. From al.1 indica- tions, the Federal Government will nevertheless continue to press for a monthly deposit procedure, despite the additional problems and work involved for State and local agency reporting officials. The position taken by the Conference indicates an all-out campaign in opposition may be launched on behalf of reporting entities now under OASDI coverage if any attempt is made to initiate the monthly deposit proced- ures . This State is represented on the Committee on Federal-State Procedures which represents the Conference in dealings with the Federal Government on matters affecting OASDI coverage for public employees. IMPORTANT REPORTING INSTRUCTIONS 1. Your attention is invited to Federal requirements that adjustment reports which show a reduction in the amount of wages previously reported must be accompanied by a statement giving an explanation of the correction. Currently, many agencies are filing adjustment reports (Forms OAR-S&) without the statement, and costly and time-consuming follow-up correspondence has been necessary to obtain the reason. The cooperation of all agencies in this matter will be appreciated and will be of valuable assistance in keeping the administrative costs of the OASDI program as low as possible. Ret. Persons entering employment subject to the System who are not members of the System and who continue in such employment through the first day of the following month become members on that date, except that on the request of the Governing body of any contracting agency, the first of the payroll period, as established for the agency, next succeeding such entry shall be substituted for the first of the calendar month. The request of the governing body shall specify the payroll period as established in the agency and shall be filed as a permanent record of the System. Upon the acceptance for filing of such request, the substitution shall be effective for all employees of the agency thereafter entering employment. 582. BENEFICIARY DESIGNATIONS. A member may designate as beneficiary to receive any benefit payable to a member's designated beneficiary upon death before or after retirement, any person or persons, including a corporation, individually but not as trustee; provided, however, that a beneficiary designated to receive payments under an optional settlement based on life contingency may be only a natural person. The designation must be in writing, except as otherwise provided in this section, must give the name of the person and his address, and must be filed in the office of the Board in Sacramento, California. The right of a beneficiary to receive payment of a benefit is contingent on his survival at the time of the member's death, and the member may designate a beneficiary or beneficiaries on the contingency that the first beneficiary does not so qualify. A member may, subject to the conditions set forth in this parwraph, designate as beneficiaries or contingent beneficiaries, other than a beneficiary to receive payment under an optional settlement based on life contingency of the beneficiary, his children or his grandchildren by class rather than by naming the individuals as otherwise required in this section. For purposes of such designation, "children" shall mean natural or adopted children and "grandchildren" shall mean natural or adopted children of the member's "children", and shall include such children or Grandchildren in being at the time of the member's death or who are conceived before the member's death and born thereafter. Social Security coverage may be effected for persons in firemen and policemen positions should the City Council enter into an agreement to cover these positions. The Council could cover policemen positions separately, firemen positions separately, or the tG8$?&$~t~~ns could be combined in one coverage action. Coverage would be effective for all persons filling positions covered by the agreement if a majority of all eligible members of the State Bnployees' Retirement System in such positions voted in favor of OASDRI coverage. These procedures are called an "all or none" referendum. If the Social Security coverage is a full supplementation of the present Retirement System, there would be no change in the SERS contributions made by the individual employees. In addition to the contributions payable to the State Employees' Retirement System, each individual currently would pay 4.2% of his earnings for Social Security coverage. The City would also contribute k.2$ of reported wages as it does currently for the miscellaneous group. The coverage discussed in the proceeding paragraph would not require an amendment to the City's SERS agreement. The benefits provided by SERS for this group Would not be effected by the Social Security agreement entered into with this Division. Legislation which was effective following the last regular session of the Legislature, does provide for a modification of the SERS safety member formula that is currently in effect with the City of Carlsbad. However, after talking with our Actuarial and Contracts Division, we understand that should the SERS benefits to the firemen and policemen be modified under these provisions of law, there could be an impairment of benefits and the City could be subject to law suit by employees whose benefits were so knpalred. I would suggest if the City wishes to pursue this further, that you send a letter of inquiry to our -2- --. Actuarial and Contracts Division where more complete and detailed information on the subject would be available. OASDRI coverage could be retroactive or could be effected as of a current date. (Note that the referendum cannot be held less than 90 daya after notice of the referendum is given to the employees. A proposed explanatory statement to the employees to inform them of the rights and benefits which will accrue to them and their dependents and survivors, and the liabilities to which they will be subject, if their services are covered under the OASDI program. The statement must include a general explanation of the modification, if any, of the existing retirement system that may result from OASDI coverage. c. A proposed plan of procedure to be followed in the conduct of the referendum. d. A listing of all Policeman and/or Fireman positions established in the public agency, subject to the retirement system. 6. After receiving approval of the Notice, explanatory statement, and plan by the State Referendum Supervisor, the local referendum official issues the Notice and explanatory statement to members of the retirement system. If in doubt as to an employee's eligibility, a Notice and statement should be givan to him nevertheless; his status can be resolved before the referendum takes place. Under Section 596 of the California Administrative Code, notice must be given to eligible employees by personal delivery, or by first-class mail, and must be posted on all bulletin boards maintained by the public agency to give notices to employees. Notice should be given to members of the retirement system on leaves of absence. 7. At the time notice is given, a list of members of the retirement system potentially eligible to vote in the referendum is established by the local referendum official. This list will be adjusted during the period between the Notice and the referendum for resignations, dismissals, retirements, and other separations from service. 8. On the date established for the referendum an opportunity to vote is given to eligible members of the retirement system. To be eligible to vote in the referendum, an employee must be a member of the retirement system and in a Policeman and/or Mraman position covered by the retirement system on both the Notice date and the referendum date. There is no prescribed form for the ballot, but the question to be voted on must be in the same words as the question indicated on the Notice of Referendum. 9. After the votes are counted by or under the supervision of the local referendum official, all ballots cast are sent to the State Referendum Supervisor. Also, if the governing body of the public agency decides to request OASDI coverage, the local referendum official will make the certifications required by Section 598 of the California Administrative Code. The only information which can be furnished regarding costs pertains to the member contribution rates. A copy of these contribution rates computed at example ages is enclosed. The agency contributions will increase by an amount at least equal to the increase in members contributions and in most cases by a somewhat greater amount due to the fact that the adjustment in member contributions can only be made on a prospective basis, whereas, the agency contributions must make up the deficiency in previous member contributions as well as bearing its share of the cost for benefit formula improvement. Before the System can make any calculations to determine the agency contri- bution rate, it will be necessary to develop the valuation factors required for such calculations. For this reason, the System will not be in a position to effect amendments or contracts to the one-half pay at 50 formula until sometime after the middle of next year. Yours truly, Donald W. Adopted uniform contribution rate for all employers of school members as 6.814s of School Member Payroll, effective July 1, 1967. 2. Adopted the following administrative costs to public agencies contracting for retirement coverage, for the Fiscal Year 1967-68: $1.00 per member for employers who have been under contract with the System two years or more, and for University members under Federal contract; $5 .OO per member for employers in the first or second year of contract irrespective of the date of entry during the fiscal year or level of benefits contracted for; $2.00 additional per member, as a one-time charge, for all employers who divide their retirement systems for the purpose of obtaining Social Security coverage retroactively. Confirmed the Executive Officer's action of reducing the State's contri- bution to the State Employees' Contingency Reserve Fund under the Meyers- Geddes State Employees' Medical and Hospital Care program, from 3% to 2% for the months of April, May and June of 1967, and authorized the Executive Officer to re-establish the contribution to 3yh of premiums paid under the Meyers-Geddes health benefits program, commencing July 1, 1967. 4. Established the rate of contribution to the Contingency Reserve Fund for administrative expenses under the Meyers-Geddes State Employees' Medical and Hospital Care Act as 0.774 of the total contributions made by the employee or annuitant, and the State on behalf of the employee or annuitant, for the 1967-68 Fiscal Year. -l- 5. Under the provisions of the Social Security Act, Section 2.18 (d)(6)(E), an individual who is in a position covered by a retirement system, and who is not a member of such system, but is eligible to becoane a member thereof, is regarded as a member of such system providing the State so desires. Under the Government Code, Section 22015, (excerpts enclosed) the State of California provided for such coverage; therefore, the elective officers in the City would be covered under Social Security even though they didn't elect to become members in the State Rnployees' Retirement System. Section 20361 of the California Government Code contains provisions for elective officials, such as the councilmen, to choose to be members of SERB. The date the councilmen started to receive compensation for services as members of the City Council the members became 'kktionals" i,e. eligible to choose membership in SEX@ as provided in Section 20361 of the Code. Under the provisions of the California Government Code, Section 20814 (excerpt enclosed), a person serv5ng as an electfve officer is deemed to be serving in a full time position and fs credtiedoae year of service for each year of tenure in stih office, providing he is receivin@ any compensation for his services in his official capacfty, and if he elects to became a member of the Retirement system. Under present provisions of the Social Security Act, the City cannot amend its agreement to exclude part-time employees. Since the City Councilmen are covered under the Ciy's Social Security agreement, a wage adjustment report, Form OAR-S&, should be submitted for any compensation paid the City Councilmen for services rendered in their official capacity, retroactive to January 1, 1964. Wages prior to January 1, 1964 can not be adjusted due to the Statute of Limitations. Public law 86-778 fixed a time limit beyond which a public agency would not be liable for amounts due with respect to wages paid individuals under the Social Security agreement. These sections offer local policemen provisions which have been in the law since 1953 for local fire- men. The only definitive information which we can furnish on costs pertains to member contributions. Member contributions required under this formula will be from 30% to 50% greater, in most cases, than those required under the "one-half pay at 55" formula. Copies of the rate chart and printed comparison charts are enclosed for this formula. We anticipate that agency contribution rates for the safety category will increase approximately 50% to 75'% depending upon the characteristics of your membership. This sizeable increase in the employer rate is due to the fact that adjustment in member contributions can only be made on a pros- pective basis. The agency must make up the deficiency in previous member contributions as well as bear its share of the cost for the benefit formula improvement. The actuarial i+terest rate was changed to 6% (from 5-3/4%). New salary scales assuming a 9% increase in salaries per year for the first S years of employment and a 4% per year incrcese thereafter were adopted. The term of the incumbent, Malvern W. Aust, expires on January15, 1979. The new term of office will begin January 16, 1979 and run through January 15,1983. City of Carlsbad A total of 97 local safety members of the City of Carlsbad participated in an election to determine the approval or disapproval of amending the contract with the Board of Administration of the Public Employee's Retirement System to provide 2% at 50 benefits for all local safety members of the City of Carlsbad.
