A.—The Contractor shall keep himself fully informed of and at all times observe and comply with and shall cause all his agents and employees to^observe and comply with all state and national laws and county and municipal ordinances and regulations and orders of public bodies which in any manner affect those engaged or employed in the work, or the materials used in the work, or which in any way affect the conduct of the work. He shall protect and indemnify the State of California arid all officers and employees thereof, including buf~nqt limited to the Director and the State Highway Engineer, against any claim or liability arising from or based on the violation of any such law, ordinance, regulation, or order, whether by himself or his employees. If any discrepancy or any inconsistency is discovered in this contract in relation to any such law, ordinance, regulation, or order, he shall report the same to the Engineer in writing. B.—The attention of the Contractor is directed to, and he agrees to comply with, all of the applicable provisions of the Labor Code including those provisions requiring the payment of not less than the prevailing rate of wages; and prohibiitng the employment of aliens on public works; and further agrees to the forfeitures provided for in said Code in the event a violation of any of the provisions occurs in the execution of this contract, and particularly to the provision that the Contractor shall, as a penalty to the State of California, forfeit $25.00 for each workman employed in the execution of the contract by the contractor or by any subcontractor for each calendar day during which such workman is required or permitted to work more than eight hours in any one calendar day and 40 hours in any one calendar week in violation of the provisions of the Labor Code and in particular. Sections 1810 to 1815 inclusive thereof. C.—The attention of the Contractor is also called to and he agrees to comply with the provisions of the "Buy American" Act, Sections 4300 to 4305 of the Government Code, pertaining to use of materials and supplies produced or manufactured in the United States. D.—The mentioning of certain statutes in this contract shall not relieve the Contractor from the responsibility of com- plying with any other law applicable to the work to be done under the contract or to the service or equipment to be furnished hereunder. E.—It is understood that the Contractor assumes all responsibility for repairs to his equipment during its use under this contract, and he also assumes all responsibility which may be imposed according to law for property damage or personal injuries caused by his operations under this contract. F.—The cost of employer payments to or on behalf of employees, compensation insurance premiums, unemployment contributions, social security taxes, contract bond premiums, and any other taxes or assessments including sales taxes required by law or otherwise shall be included in the price bid and no additional allowance will be made therefor, except as otherwise specifically provided herein. G.—It is expressly agreed that all persons engaged on this work are employees of the Contractor and that none are employees of the Department of Public Works of the State of California. H.—Alterations, extensions of time, extra and additional work, and other authorized changes may be made without securing the consent of the sureties on the contract bonds. I.—The Contractor warrants, by execution of this contract, that no person or selling agency has been employed or retained to solicit or secure this contract upon an agreement or understanding for a commission, percentage, brokerage, or contingent fee, excepting bona fide employees or bona fide established commercial or selling agencies maintained by the Contractor for the purpose of securing business. For breach or violation of this warranty the State shall have the right to annul this contract without liability, paying only for the value of the work actually performed, or in its discretion to deduct from the contract prjce or consideration, or otherwise recover, the, full amount of such commission, percentage, brokerage or contingent fee. i .• '.i • '••:.'"..'. ' ' • . •. •,(••" •. / , ' . .', ' t J.—Pursuant to the authority contained in Section 591 of the Vehicle Code, the Department has determined that within such areas as are within the limits of the project and are open to public traffic, the Contractor shall comply with all of the requirements set forth in Divisions 11, 12, 13, 14 and 15 of the Vehicle Code. The Contractor shall take all necessary precautions for safe operation pf his equipment and the protection of the traveling-public from mjofy and damage from such equipment. "• ! ; . ,'
