That the attached agreement regarding day use parking fees at Carlsbad State Beach is hereby approved. 11 2. 12 That the Mayor of the City of Carlsbad is hereby authorized and 13 directed to execute this agreement for and on behalf of the City of Carlsbad. 14 3. That the City Council approves and authorizes the disbursement of 15 $78,000 dollars from the Contingency Fund to the State of California I6 Department of Parks and Recreation to fund this agreement. , 17 4. This resolution shall not act in any way, or be deemed to be, a 18 19 waiver of any of the City’s rights or abilities to obtain or pursue legal, 2. legislative, or other methods to oppose the continued implementation of 21 parking fees. RECITALS 7. The STATE proposes to collect day use parking fees at the Tamarack Avenue parking lot at Carlsbad State Beach for the purpose of offsetting operation and maintenance costs of state beaches. 2. The C/N opposes imposition of fees at this location and has agreed to provide City funds to help offset operation and maintenance costs of state beaches for the remainder of fiscal year 7997-7992. AGREEMENTS 7. Term of Agreement: This Agreement shall begin on Februarv 4, 7992 and shall continue through June 30, 7992. 2. RECITALS 1. The STATE proposes to collect day use parking fees at the Tamarack Avenue parking lot at Carlsbad State Beach for the purpose of offsetting operation and maintenance costs of state beaches. 2. The CITY opposes imposition of fees at this location and has agreed to provide City funds to help offset operation and maintenance costs of state beaches for the fiscal year 1992-l 993. AGREEMENTS 1. Term of Agreement: This Agreement shall begin on July i, 1992 and shall continue through June 30, 1993. 2. Collection of Dav Use Parking Fees: The State shall not impose or collect day use parking fees at the Tamarack Avenue parking lot during fiscal year 1992-93. 3. City Funds: The City shall make quarterly payments to the State in the amount of $9,000 during fiscal year 1992-93. Payment shall be made within 30 days of the end of each quarter. Total payments shall not exceed $36,000. 4. Termination of Pavments: Quarterly payments and the City’s obligation to pay will cease if it is judicially determined that the imposition of day use parking fees at state beaches is improper. Indemnification: The State shall assume the defense of, pay all expenses of defense, and indemnify and hold harmless the City, and its officers and employees, from all claims, loss, damage, injury and liability of every kind, nature and description, howsoever the same may be caused, arising directly or indirectly from or in connection with the use of the property. The expenses of defense include all costs and expenses including attorney’s fees for litigation, arbitration or other dispute resolution method. State of California By: Claude A. RECITALS 1. The STATE proposes to collect day use parking fees at the Tamarack Avenue parking lot at Carlsbad State Beach for the purpose of offsetting operation and maintenance costs of state beaches. 2. The CITY opposes imposition of fees at this location and agrees to provide City funds to help offset operation and maintenance costs of state beaches and prevents the installation of fee collection devices for the fiscal year 1999 - 2000. AGREEMENTS 1. Term of Aoreement: This Agreement shall begin on July 1, 1999, and shall continue through June 30, 2000. 2. Collection of Dav Use Parking Fees: The STATE shall not impose or collect day use parking fees at the Tamarack Avenue parking lot through the term of this agreement and any extensions thereof. 3. CITY Payment: The CITY shall make quarterly payments of $9,000.00. Total payments shall not exceed $36,000.00 per year. The amount due and payable to the STATE for the time a valid Coastal Commission Permit was held for placing a fee collection device at the Tamarack Avenue beach parking lot. 4. Indemnification: The STATE shall assume the defense of, pay all expense of defense, and indemnify and hold harmless the CITY, and it’s officers and employees, from all claims, loss, damage, injury and liability of every kind, nature and description, howsoever the same may be caused, arising directly or indirectly from or in connections with the use of the property.
