1 RESOLUTION NO. . A RESOLUTION OF THE PLANNING COMMISSION ^ OF THE CITY OF CARLSBAD, CALIFORNIA, FINDING GENERAL PLAN CONSISTENCY FOR A COORDINATED PROGRAM OF PROPOSED PUBLIC WORKS WHEREAS, California Government Code Section 65401 provides g for the preparation of a coordinated program for proposed public Y works; and g WHEflEAS, the City of Carlsbad has officially adopted a g General Plan; and WHEREAS, Government Code Section 65401 provides that the ^•j^ governing bodies of any special district or school district whose ^2 jurisdiction lies whojly or par.tially within the City and whose ^2 functions include recommending, preparing plans for, or constructing major public works, shall submit a list of the proposed public works recommended for planning, initiation, or construction during the ensuing fiscal year to an agency designated by the Cit^ Council; and WHEREAS, on April 19, 1977 the City Council resolved as fol1ows: 1. That special districts and school districts located 19 20 g-j^ wholly or partially within the City of Carlsbad submit a list of ZZ 23 24 25 26 27 28 proposed public works recommended for planning, initiation, or construction during the ensuing fiscal year to the City Council of the City of Carlsbad prior to May 1 of each year. 2. That the City Manager cause to be prepared a coordinated program of proposed public works for submittal to the Planning Commission. 3. That the Planning Commission review the coordinated ^ program for conformity to the General Plan of the City of 2 Carlsbad and report its findings to the City Council. 2 WHEREAS, a coordinated program of public works has been ^ prepared and has been submitted to the Planning Commission for g review of conformity to the General Plan of the City of Carlsbad. g NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of Y the City of Carlsbad, California, as follows: o 1. -The coordinated program of proposed public works is consistent with the Carlsbad General Plan for reasons 9 10 outlined in Exhibit A, dated 9-14-77, attached hereto. 2. Said finding of conformity of the coordinated program of proposed public works shall be reported to the ^•^ City Council. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA PROVIDING FOR A COORDINATED PROGRAM OF PROPOSED PUBLIC VJORKS ' WHEREAS, Government Code Section 65401 provides for the preparation of a coordinated program for proposed public works; and . WHEREAS, the City of Carlsbad has officially adopted a General Plan; and WHEREAS, Government Code Section 65401 provides that the governing bodies of any special district or school district whose jurisdiction lies wholly or partially within the city and whose functions include recommending, preparing plans for, or constructing major public works, 'shall submit 'a list of the propo-^ed public v;orks recommended for planning, initiation, or construction during the ensuing fiscal year to an agency designated by the City Council; and V/HEREAS, the agency receiving the list of public works shall prepare a coordinated program of proposed public works to be submitted to the Plannirig Commission of the City of Carlsbad for review and report as to conformity with the General Plan; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California as follows: 1. Applications for building permits or any discretionary approvals such as subdivision tentative maps, minor subdivisions, conditional use permits, adjustment plats, variances, reversion to acreage, and certificates of compliance are not being accepted unless a determination is made by the City Manager that the application is exempted as outlined in said ordinances (see attached). Financial arrangements acceptable to the City must provide for "improvement security" (within the meaning of Section 66499 of. the Government Code of the State of California) in (a) an amount not less than 100 percent of the total estimated cost of the improvement, conditioned upon the faithful performance of the agreement or contract, and (b) an additional amount as determined by the governing body of not less than 50 percent of the total estimated cost of the Improvement, securing payment to the contractor, his subcontractors, and to persons renting equipment or furnishing labor or materials to them for the improvement. Surety in the amount of 25 percent of the total esti- mated cost of the improvement 1s held to warranty the work for one year following its completion or acceptance, according to local ordinance. We welcome this opportunity to give you specific information, and the following are details which were presented by telephone: 1. Palomar Airport Business Park - Participation and Reimbursement: This Is a budget item to cover the potential reimbursement to Palomar Airport Business Park for their oversizing of the trans- mission mains in Palomar Airport Road and El Camino Real. All of this construction took place during the development of their business and industrial park, which was formally approved by the City of Carlsbad. 2. Extension of 16" Line - El Camino Real: This is the completion of the 16" transmission main being built along the west side of El Camino Real to parallel the original water facilities built in 1959 and 1961. The Palomar Airport Business Park Subdivision and the Rancho La Cuesta Subdivision each extended a substantial segment of this pipeline, and the Water District will make the closure between the two segments which involve about 1,500 feet of pi peli ne. 3. High Pressure Water Main Extension - West of D Reservoir: This is a 12" water main extension involving some 2,500 feet. Standard Pacific of San Diego, developers of Spinnaker Hills, is building this pipeline as an "off-site" facility, and the District Is participating with the developer to take care of a local service area. "-^— Statement of the Matter The CarTsbcd Municipal Water District has recently completed development of a Water Master Plan for ID 3, generally the northeast quadrant of the City. Staff has provided information to the District relating to the future needs of the City service area in order that these considerations may be included. FROM: Director of Utilities & Maintenance SUBJECT: Review of CMl'iD Master Plan for I.D, #3 Staff of the Utilities &• Maintenance Department have provided information to the CMV/D District Engineer relating to the water needs in the Northeast quadrant of the City water service area. These needs were based on the current Land Use Element of the General Plan and used maximum population densities of that plan to provide the basis for the water planning efforts for the City Service area. Topographical considerations were also con- sidered to determine optimum interconnection points with the CMWD system in that area. Normal engineering assumptions regarding per capita use and required fire flows were utilized in making these determinations. The plan has been reviewed and the following comments are provided: 1. The plan provides for a second route of supply to the entire City Service area. As you are aware, our present source of v/ater is from Squires Dam or via a by-pass directly to the aquaduct from a line in Palomar Airport Road. Should there be a casualty to this link, water can be provided on a temporary basis from Oceanside through an intertie at El Camino Real and • Hiway 78. Our present storage capacity (Ellery, Elm and Skyline tanks) is sufficient for only 2+ days under normal demands. It Is my opinion that the proposed plan adds, a considerable degree of reliability to our system. 2. The plan will call for delivery of water generally to the intersection of Elm Avenue and our service area at pressure corresponding to elevation 620. This pressure will provide for delivery of water to the Ellery pump zone without the necessity of pumping from Ellery Reservoir. The Ellery pumps can, therefore, be placed on standby which will result in decreased power costs. 3. Connections at Elm Avenue and at Kelly Drive will provide for about 6 cfs (2700 gallon/minute) delivery to our system. 4. The plan is sufficiently flexible that it can accommodate future City requirements for additional storage (5 MG) in the NE corner of our service area (vicinity of the present mm B tank). - CMWD Master Plan ID3 (continued) -2- November 30, 1977 The Planning Commission has indicated that the plan is consistent with the General Plan, I believe the plan has used reasonable planning parameters for service to the I.D. 3 area, although it may be somewhat oversized to the real requirements of the area which cannot be established until the master Dlans for Calavera Hills and other developments have been reviewed. It' should be pointed out that the Master Plan for I.D, 3 does n^^t include any time schedule for implementation, although it is my understanding that the portion described as the Tri-Agencies Pipeline will be constructed during 1978-79, I presume that the remainder of the system will be completed as development occurs, therefore, various parts of the system will be reviev/ed as a part of the usual development process. In this regard, it is considered that the plan will track somewhat closely with the City's Public Facilities Program, ROGP^ W. By letter dated December 1, 1977, Mr. Roger W. Greer, Director of Utilities and Maintenance, has advised the District that the City of Carlsbad's technical staff has participated in the development of the Water District Master Plan and has also reviewed the drafted document. In addition, we understand that the City Planning Com- mission has reviewed our draft Master Plan and have found the report to be in compliance with the general Plan. Our District fully comprehends the role of the City of Carlsbad's Planning Commission and City Council with respect to the general Plan of the City, and the relationship of a long-range public utility such as our water system and the overall developments of the area. Our District has received the full measure of assistance. Input and commentary in this regard. What we have not re^ceived as yet is a specific statement relating to the Ci'ty of Carlsbad's Water Department, as to their view of what the Water District is providing. Our Water District has been privileged to work with the La Costa Land Company from the inception of their substantial community development program. We are gratified that you would invite our participation in your project and look forward to your study program activities. The following is a summary of our discussions and we welcome the opportunity to pursue various questions as they arise: 1. The La Costa Land Company and the Water District mutually agreed at the beginning of our programs that long range planning was appropriate so that the goals of the Water District and the development should be reached on a mutually agreeable basis. Among the corner stones of our working program together was the fact that any development of such magnitude must have as an initial beginning a reasonable start for development of a complete water system keeping in mind that 1ncremental growth of the service area should be matched by water system capability. A good example of this concept was the fact that for initial development purposes, elevation storage was provided by a back-up system from the main transmission facility of the Water District. Subsequently, in a timely way La Costa Land Company provided a reservoir site, the piping arrangements and the Water District constructed the first storage reservoir within the development area itself. Because the general planning for the development area demanded a certain amount of flexibility, our District master planning for the public water system was continually analyzed so that there would be a complete correlation. 2. Another important facet of the development program was the In Orange County, Santa Ana REC'D/=7"™ MAY 977 • NOINKKIta McDonald & Grefe May 5, 1977 Page 2 specific policy guidelines of the Board of Directors as to the scope of financial responsibility for the development itself as well as the financial responsibilities of the Water District in the expansion of the Public Water System. Again in this arena, the District de- veloped guidelines that have proved to be very successful in the La Costa Development program. 3. Insofar as the current specific study being conducted by your firm, our District is moving ahead rapidly with the various public water system expansion needs for the La Costa Development pursuant to the terms and conditions of the agreements we now have for public water service. Our District is doing the necessary advanced planning to fulfill our responsibilities and various alternatives for the funding of these projects are now under consideration. In summary, insofar as the Carlsbad Water District service area of the La Costa development is concerned, we are confident of our ability to provide the necessary level of public water service to be in complete concert with the general plan as approved by the City of Carlsbad.
