PUBLIC WORKS LETTER OF AGREEMENT Avenida Encinas Retaining Wall (PKRC514} This letter will serve as an agreement between Dan Vaughn Masonry and Concrete, a masonry and concrete company (Contractor) and the City of Carlsbad (City). The Contractor will provide all equipment, material and labor necessary to remove damaged retaining wall and rebuild using concrete btock, per the Contractor's proposaf dated February 15, 2012 and Crty spedfications, for a sum not to exceed Three Thousand Two Hundred Forty dollars ($3,240). This work is to be completed within 21 calendar days after issuance of a Purchase Order. ADDITIONAL REQUIREMENTS 1. City of Carlsbad Business License. Z. The Contractor shall assume the defense of, pay ali expenses of defense, and indemnify and hold harmless the City, and its agents, officers and employees, from ali claims, loss, damage, injury and liability of every kind, nature and description, directly or indirectly arising from or in connection with the performance of this Contract or worl^; or from any failure or aHeged failure of the contractor to comply with any applicable law, rules or regulations including those relating to safety and health; except for loss or damage which was caused solely by the active negligence of the City; and from any and all daims, loss, damage, injury and liability, howsoever the same may be caused, resulting directly or indirectly from the nature of the work covered by this Contract, unless the loss or damage was caused solely by the active negligence of the City. The expenses of defense indude all costs and expenses, induding attorney's fees for litigation, arbitration, or other dispute resolution method. 3. Contractor shall fumish polides of general liability insurance, automobile liability insurance and a combined policy of workers compensation and employer's liability in an insurable amount of not less than five hundred thousand dollars ($500,000) each, unless a lower amount is approved by the City Attomey or the City Manager. Said polides shall name the City of Carlsbad as a co-insured or additional insured. Insurance is to be placed with insurers that have (1) a rating in the most recent Best's Key Rating guide of at least A-:V, and (2) are admitted and authorized to transact the business of insurance in the State of Califomia by the Insurance Commissioner. Proof of aii such insurance shaM be given by fifing certificates of insurance with contracting department prior to the signing of the contrad by the City. I. The Contractor shall be aware of and comply with all Federal, State, County and City Statues, Ordinances and Regulations, including Workers Compensation laws (Division 4, Califomia Labor Code) and the "Immigration Reform and Control Ad of 1986" (8USC, Sections 1101 through 1525), to indude but not iimited to, verifying the eiigibiJity for employment of all agents, employees, subcontractors and consultants that are included in this Contract. 5. The Contrador shall be aware of and comply with Califomia Regional Water Quality Control Board, San Diego Region requirements. A. Contractor shall not allow any discharges from fhe construction site, which may have an adverse effed on receiving waters ofthe United States. Contrador shall not allow any groundwater extraction water to be discharged from construction site except in full compliance with the General Waste Discharge Requirements for Ground Water Extraction and Similar Discharges from Construdion and Remediation Projeds (Order No. 96-41) adopted by the Regional Board. A. «ti:iT 21 St q»d ii^-'^.^^ County of San Diego, Department of Plannmg and Land Use RETAINING WALLS WITH SLOPING BACKFILL Construction of retaining walls, except those less than 3 feet in height and not supporting surcharge, requires a permit and Is regulated by the 2007 Califomia Buifding Code (CBC) as amended and adopted by the County of San Diego, This form outlines the County's minimum requirements. Form DPLU #84 provides infonnation on retaining walls with level backfill. For site retaining walls proposed to be construded in a public way or associated with Department of Public Works grading. County of San Diego Regional Standards shali be used, I. INSPECTIONS Please call for inspections at the following times: 1. When the footing excavations have been compieted, tiie relnfordng steel has been securely tied into final position, and before the placement of concrete. 2. Wtren the block has been laid and the relnfordng stee? is In positfon, but before any grout has been placed. Steel is to be securely fastened in place to prevent movement during grouting. Lifts are not to exceed 6 feet high and blocks are not to be lakj higher than the grout pour. 3. After grouting is completed and after rock or rubble wall drains are in place, but before backfill is placed. 4. When a« work has been completed. II. WALL HBGHT „ Wall height is measured ftom the top of the footing to the lop of lhe waU. Walls that are not spedfically shown in this form must be designed by a Califbrnia Ircensed architect, dvil or stmctural engineer. No building foundation, driveway, parking or other loading on the upper levet is allowed within a (^stance equal to the height of ihe waJJ. Wails with such loading must be designed by a Califomia licensed archited, dvil or structural engineer III. BLOCK All concrete masonry unit blocks must be type "N" grouted solkl with /'^ = 1,500 psi. IV. CONCRETE MIX DESIGN The concrete mix for footings must meet a minimum compressive strength of f \, = 2,500 psi. V. iVIORTAR MIX DESIGN The moftar mix fbr block placement must meet a minimum compressive strength of 1.800 psi. Mortar shall conform to ASTM C 270 and shall conform to the proporttons spedficattons of CBC Table 2103.8(1) or the property specifications of CBC Table 2103.8(2). NOTE: Thm us0 af pfastic cement is not permitted for mortar, VI. GROUT MIX DESIGN Grout used for filling tslock cells musl meet a minimum compressive strength of 2,000 psi and shall conform to CBC Table 2103.12 or to ASTM C 476. Rod or vibrate grout Immediately. Re- rod or re-vibrate grout about 10 minutes after pouring to ensure solid consolidation. Stop gnxit 2" from top of masonry units when an additiona) grout lift is required.
