Contract No. 1044 Said work shall be performed in strict conformity with the specifi- cations therefor as approved by the City Council of the City of Carlsbad on file in the Engineering Department. Reference is here- by made to said specifications for full particulars and description of said work. No bid will be received unless it is made on a proposal form fur- nished by the Engineering Department. Each bid must be accompanied by cash, certified check or bidder's bond made payable to the City of Carlsbad for an amount equal to at least ten percent of the amount bid. Such guaranty to be forfeited should the bidder to whom the contract is awarded fail to furnish the required bonds and to enter into a contract with the City within the period of time provided by the bid requirements. f*"' The documents included within the sealed bids which require comple- tion and execution are the following: 1. Proposal - Page" 3 2. Designation of Subcontractors - Page 7. 3. Bidder's Bond - Page 6. 4. Contractor's Financial.Status - Page 8. Said documents shall be affixed with the appropriate notaried signa- tures and titles of the persons signing on behalf of the bidder. ;. For corporations, the signatures of the President or Vice-President and Secretary or Assistant Secretary are required and the corporate seal shall be affixed to all documents requiring signatures. In the case of a partnership, the signature of at least one general partner is required. All bids are to be compared on the basis of the Engineer's estimate. The estimated quantities are approximate only, being given solely as a basis for the comparison of bids. No bid will be accepted from a contractor who has not been licensed in accordance with the provisions of Chapter 9, Division 3 of the Business and Professions Code. The contractor shall state his license number and classification in the proposal. The estimated cost of the work is $10,000. Page 2 Plans, Special Provisions and Contract Documents may be obtained at the Engineering Department, City Hall, Carlsbad, California, at no Dst to licensed contractors. A nonrefundable charge of ~0_^ ill be required for each set of plans, special provisions and con- tract documents for other than licensed contractors. It is requested that the plans and special provisions be returned within two weeks after the bid opening. The City of Carlsbad reserves the right to reject any or all bids and to waive any minor irregularity or informality in such bids. A project tour will be conducted by the City of Carlsbad Engineering Department at 10:00 a.m. on any day requested . The general prevailing rate of wages for each craft or type of work- man needed to execute the contract shall be those as determined by the Director of Industrial Relations pursuant to the State of California Labor Code, Part 7, Chapter 1, Article 2, Sections 1770, 1773 and 1773.1. Pursuant to Section 1733.2 of said Labor Code, a current copy of applicable wage rates are on file in the Office of the City Clerk of the City of Carlsbad. It shall be mandatory upon the Contractor to whom the contract is awarded to pay not less than the said specified prevailing rates of • 'ages to all workmen employed by him in the*execution of the contract. V,,,' ' • .-.- Also, the prime contractor shall be responsible to insure compliance with provisions of Section 1777.5 of the Labor Code of the State of California for all occupations with apprenticeships as required on public works projects above thirty thousand dollars ($30,000) or twenty working days. The amount of the bond to be given for the faithful performance of the contract for the said work, shall be one hundred percent of the contract price therefor, and an additional bond in the amount equal -to fifty percent of the contract price for said work shall be given to secure the payment of the claims for any material or supplies furnished for the performance of the work contracted to be done by the contractor for any work or labor of any kind done thereon. In case of a discrepancy between words and figures, the words shall prevail. In case of an error in the extension of a unit price, the corrected extension shall be calculated and the bids will be computed as indicated above and compared on the basis of the corrected totals. The estimated quantities of work indicated in this proposal are approximate only, being given solely as a basis for comparison of bids . For and in consideration of the payments and agreements hereinafter mentioned to be made and performed by the City, the Con- tractor agrees with the City to furnish all materials and labor for: Removing existing carpet and installing new carpet in City Council Chambers and Police Department, Contract No. 1044 and to perform and complete in a good and workmanlike manner all the work pertaining thereto shown on the plans and specifications therefor; to furnish at his own proper cost and expense all tools, equipment, labor and materials necessary therefor, (except such materials, if any, as in the said specifications are stipulated to be furnished by the City) , and to do everything required by this agreement and the said plans and specifications. 2. For furnishing all said materials and labor, tools and equip- ment, and doing all the work contemplated and embraced in this agreement, also for all loss and damage arising out of the nature of the work aforesaid, or from the action of the elements, or from any unforeseen difficulties which may arise or be encountered in the prosecution of the work until its acceptance by the City, and for all risks of every description connected with the work; also, for all expenses incurred by or in consequence of the suspension or discontinuance of work, except such as in said specifications are expressly stipulated to be borne by the City; and for well and faithfully completing the work and the whole thereof, in the manner shown and described in the said plans and specifications, the City will pay and the Contractor shall receive in full compensation therefor the lump sum price, or if the bid is on the unit price basis, the total price for the several items furnished pursuant to the specifications, named in the bidding sheet of the proposal, as the case may be. 3. The City hereby promises and agrees with the said Contractor to employ, and does hereby employ the said Contractor to provide the materials and to do the work according to the terms and conditions herein contained and referred to for the price aforesaid and hereby conditions set forth in the specifications; and the said parties for themselves, their heirs, executors, administrators, successors and assigns, do hereby agree to the full performance of the covenants herein contained. 4. Pursuant to the Labor Code of the State of California, the City.Council has ascertained the general prevailing rates of per diem wages for each craft or type of workman needed to execute the contract and a schedule containing such information is included in the Notice Inviting Bids and is incorporated by reference herein. 6. The Contractor shall assume the defense of and indemnify and save harmless the City, the City Engineer, and their officers and employees, from all claims, loss, damage, injury and liability of every kind, nature and description, directly or indirectly arising from the performance of the contract or work, regardless of responsi- bility for negligence; and from any and all claims, loss, damage, injury and liability, howsoever the same may be caused, resulting directly or indirectly from the nature of the work covered by the contract, regardless of responsibility for negligence. Scope of Work The work includes all labor, material and equipment to remove and replace the existing carpet in the City Council Chambers and Police Department. B. Location of Work Work under this contract is located at the Carlsbad City Hall/ 1200 Elm Avenue, Carlsbad, California, 92008. C. Work Schedule Work in the Council Chambers must be performed during a two-week period between City Council meetings, which are held on the first and third Tuesdays of the month. This building cannot be closed for a longer period of time. Work in the Police Department must be closely coor- dinated with this department's work operations. Indi- vidual offices can be closed down for a one-day period except for the main area occupied by the dispatcher and watch commander, which cannot be shut down. This area must be maintained in service during the removal and re- placement of carpeting. Page 16 The Contractor shall submit a work schedule to the Project Manager prior to the pre-construction conference. , This schedule shall identify the dates on which each area will be carpeted. No work will proceed until this schedule has been ap- proved and a Notice to Proceed issued. D. Allowed Construction Time The work shall be completed within forty-five (45) calendar days. E. Moving of Equipment and Furniture Areas to be carpeted will be cleared of furniture and equipment by City personnel. After the installation of the new carpeting, City personnel will move furniture and equipment back to their original locations. F. Drawings Drawings which form a part of this contract consist of Exhibits "A" and "B". The dimensions shown on these exhibits are approximate only. Each bidder should examine the areas to be carpeted and take their own measurements to determine the quanti- ties. G. Permits and Licenses Contractor shall be required to obtain a City Business License. No building permits will be required. II. WORKMANSHIP A. Surface Preparation In areas which are presently carpeted, all carpet is to be removed. All adhesive, sponge backing, or other materials Page 17 adhering to concrete surfaces, shall be removed. Any large cracks or chips in floor surfaces shall be repaired with an acceptable filler material. Floor surfaces shall be smooth, clean and ready to receive adhesive. B. Installation Carpet shall be laid out and cut in such a manner as to create a minimum of seams; said seams to be located in inconspicuous places. Seams shall be made by butting factory edges or lap cutting to make a perfect match. Ex- treme care shall be used in glueing and fitting seams to make them as inconspicuous as possible. Carpeting is to be coved in all areas. Metal end strips (gold colored) are to be used in areas where floor- ing changes from carpeting to tile. C. Cleanup All debris, rubbish and dirt are to be removed from the premises and placed in a disposal area designated by the City. Old carpets shall be rolled and tied in neat bundles and placed in the same disposal area. The work areas are to be left in a neat and clean con- dition. Any dirt or adhesive on the new carpeting shall be removed. III. MATERIAL Carpeting shall be commercial-type carpet having excellent ratings for cleanability, soil resistance, surface texture re- tention and colorfastness and meeting the following specifications A. BID SUBMITTALS Each bid shall be accompanied by the following submittals: A. Name and address of the manufacturer B. Manufacturer's specifications C. Samples and color charts Bids submitted without the above information will be considered non-responsive. V. EXTRA STOCK Upon completion of the carpet installation, Contractor shall deliver six swatches of carpeting to the City's Building Mainten- ance Department for use in case of repairs. Each swatch shall be at least one square yard and at least 18" wide.
