BETWEEN
ENClNlTAS UNION SCHOOL DISTRICT
AND
CITY OF CARLSBAD
The Carlsbad Police Department and the Encinitas Union School District desire to
assist students in recognizing and resisting the pressures exerted on them to
experiment with drugs. As such, the City and the School District find it would be
mutually beneficial to provide the Drug Abuse Resistance Education (D.A.R.E.)
program. Therefore, the Encinitas Union School District and the City of Carlsbad
have the following expectations and agree to undertake the listed responsibilities
to achieve these mutual objectives:
A. SCHOOL DISTRICT’S ROLE AND RESPONSIBILITY
1. To cooperate with and support in a proactive manner the City of
Carlsbad Police Department to ensure the success of the D.A.R.E.
program.
B. D.A.R.E. OFFICER’S ROLE AND RESPONSIBILITY
1. To present a seventeen-week course to students in their last year at
each elementary school. Topics covered will include, but are not limited
to: showing students how to stay away from drugs, gangs, and violence;
developing self-esteem; being assertive; understanding the social
pressures which encourage drug use; and learning positive things they
can do instead of using drugs.
2. To continue to work with community agencies and parenvteacher
groups throughout the school year as needed.
C. TERM OF AGREEMENT
This Memorandum of Understanding will remain in effect for the 2003-2004
public school fiscal year. Either party will have the right to cancel this
Memorandum of Understanding upon 90 days advance written notice during
the term of this agreement.

D. SPAN OF CONTROL/JURISDICTION
One police officer will be assigned to provide the D.A.R.E. program to each
of the Encinitas Union School District Elementary Schools.
The officers assigned to the D.A.R.E. program will remain under the direction
and control of the Carlsbad Police Department. Requests for work
assignments will be directed to the Family Services Sergeant of the Carlsbad
Police Department, who will thereafter assess the request and direct the
D.A.R.E. Officer to respond appropriately.
E. RESOURCE
Resource and local management will be coordinated at:
Encinitas Union School District, 101 S. Rancho Santa Fe Road, Encinitas,
California, 92024, (760) 944-4300.
City of Carlsbad Police Department, 2560 Orion Way, Carlsbad, California,
92008, (760) 931-2149.
F. COST
Cost sharing will be based upon the following: An officer will spend one day
a week at each of the schools for each of the lessons plus two days/weeks
for scheduling classes and conducting visitations, for a total of nineteen
weeks. Each day consists of ten working hours. This includes time allocated
for training, lesson preparation, presentation of the program, visitations,
meetings, culmination planning, PTA meetings, etc. The portion of costs
funded by the Encinitas Union School District will be one-half of the costs of
an officer based on 190 hours multiplied by the total hourly costs of a mid-
step sworn officer multiplied by the number of elementary schools in the
district. See Exhibit A for details.
This Memorandum of Understanding will be effective July 1, 2003, and the
Encinitas Union School District will pay to the Finance Director of the City of
Carlsbad the agreed amount as outlined in Exhibit A. If the agreement is
canceled as herein permitted, City shall return to the District the portion of
such payment allocable to the period of the term subsequent to the effective
date of cancellation.

G. CITY EMPLOYEES
City employees who perform duties under this agreement are not, for any
purposes whatsoever, employees of the School District.
