I propose to employ only skilled workers and to abide by all State and City of Carlsbad
Ordinances governing labor, including paying the general prevailing rate of wages for each craft
or type of worker needed to execute the contract.

Wage Rates:
The general prevailing rate of wages for each craft or type of worker needed to execute the
contract shall be those as determined by the Director of Industrial Relations pursuant to Sections
1770, 1773 and 1773.1 of the Labor Code. Pursuant to Section 1773.2 of the Labor Code, a
current copy of the applicable wage rates in on file in the Office of the City Engineer. The
contractor to whom the contract is awarded shall not pay less than the said specified prevailing
rates of wages to all workers employed by him or her in execution of the contract.
False Claims
Contract hereby agrees that any contract claim submitted to the City must be asserted as part of
the contract process as set forth in this agreement and not in anticipation of litigation or in
conjunction with litigation.
Contractor acknowledges that California Government Code sections 12650 et seq., the False
Claims Act, provides for civil penalties where a person knowingly submits a false claim to a public
entity. These provisions include false claims made with deliberate ignorance of the false
information or in reckless disregard of the truth or falsity of the information.
The provisions of Carlsbad Municipal Code sections 3.32.025, 3.32.026, 3.32.027 and 3.32.028
pertaining to false claims are incorporated herein by reference.
Contractor hereby acknowledges that the filing of a false claim may be subject to the contractor to
an administrative debarment proceeding wherein the contractor may be prevented from further
bidding on public contracts for a period of up to five years and that debarment by another
jurisdiction is grounds for the City of Carlsbad to disqualify the Contractor or subcontractor from
participating in contract bidding.

Commercial General Liability, Automobile Liability and Workers’ Compensation Insurance:
The successful contractor shall provide to the City of Carlsbad, a Certification of Commercial
General Liability and Property Damage Insurance and a Certificate of Workers’ Compensation
Insurance indicating coverage in a form approved by the California Insurance Commission. The
certificates shall indicate coverage during the period of the contract and must be furnished to the
City prior to the start of work. The minimum limits of liability Insurance are to be placed with
insurers that have: (1) a rating in the most recent Best’s Key Rating Guide of at least A-:V and (2)
are admitted and authorized to transact the business of insurance in the State of California by the
Insurance Commissioner.
Commercial General Liability Insurance of Injuries including accidental death, to any one person

whether scheduled or non-scheduled. The automobile insurance certificate must state the
coverage is for “any auto” and cannot be limited in any manner.
The above policies shall have non-cancellation clause providing that thirty (30) days written notice
shall be given to the City prior to such cancellation.
The policies shall name the City of Carlsbad as additional insured.
Indemnity:
The Contractor shall assume the defense of, pay all expenses of defense, and indemnify and
hold harmless the City, and its officers and employees, from all claims, loss, damage, injury and
liability of every kind, nature and description, directly or indirectly arising from or in connection
with the performance of the Contract or work; or from any failure or alleged failure of Contractor to
comply with any applicable law, rules or regulations including those related to safety and health;
and from any and all claims, loss, damages, injury and liability, howsoever the same may be
caused, resulting directly or indirectly from the nature of the work covered by the Contract, except
for loss or damage caused by the sole or active negligence or willful misconduct of the City. The
expenses of defense include all costs and expenses including attorneys’ fees for litigation,
arbitration, or other dispute resolution method.
Jurisdiction:
The Contractor agrees and hereby stipulates that the proper venue and jurisdiction for resolution
of any disputes between the parties arising out of this agreement is San Diego County, California.

testing of vapor transmission and
alkalinity rates (levels) of the con-
crete slab, the selection of finished
floor covering material, and floor-
ing surface end use. Water vapor
emitting from a concrete slab can
be measured in pounds (kg), which
is the equivalent weight of water
evaporating from one thousand
square feet (90 m’) of concrete sur-
face area over a twenty-four hour
period. A calcium chloride test is
the industry standard for determin-
ing pounds (kg) measurement. (Re-
fer to Pre-installation Testing
narration as part of 5. Installation
herein.)
Each water vapor control system
is designed to reduce vapor emis-
sion to below the three pound
(1.35 kg) upward limit required by
most flooring covering manufactur-
ers. Floor Seal Technology, inc. has
created a series of product/process
systems designed to topically stabi-
lize, suppress and disperse vapor
volume, ensuring long-term bond
integrity. Floor Seal Technology, Inc.
water vapor emission control sys-
tems are designed to facilitate the
installation of floor covering mate-
rials without loss (Adhesion failure)
as a result of moisture vapor trans-
mission. The vapor control systems
are reliant totally on mechanical
bond and not reliant on chemical
reactions with unknown quantities
of free agents residing in the con-
crete. Each system component has a
specific basic use as follows:
Penetrants: Enter into the con-
crete slab surface to stabilize hu-
midity and immobilize mineral
migration byfillingthecavitieswith
a restrictive, non-impermeable
agent.
Coatings: Coat the concrete slab
surface to suppress moisture vapor

physical layer on the concrete slab
surface to disperse moisture vapor

Prescribed Treatment Combina-

employs MES Penetrant alone and
is for suspended slabs only. Pen-
etrant control of vapor emission up
to 6.0 pounds (2.7 kg) can be safely
executed on suspended slabs with-

are a result of slab youth, not vapor
pressure differentials.
System I/ Treatment: Treatment
begins with application of MES Pen-

Coating in order to ensure a thor-

process, with the addition of the
MES Membrane to enhance the dis-

Compositionand Materials: MES
Penetrant is a special blend, two component, VOC-compliant, low
viscosity, water-based modified
epoxy formulation developed un-
der quality control standards to pen-
etrate the concrete surface and
restrict the pores of the concrete.
MES Coating is the same chemi-
cal formulation as MES Penetrant.
Condensed moisture can not pool
through to the surface and is re-
cycled back into the slab.
MES Membrane is a modified
MES coating to perform as a mem-
brane by addition of specialized
inorganic compounds, which en-
hancestheeffectivenessof Fiberseal
by providing more physical capac-
ity for dispersement, and allows a
higher volume of moisture vapor to
be controlled.

5. INSTALLATION
Pre-lnstallationTestingPre-instal-
lation testing ofthe concrete slab by a
calcium chloride test must be done
prior to the selection and applica-
tion of Floor Seal Technology Water
Vapor Emission Control System
Treatments, and testing should be
performed by qualified testing per-
sonnel and agency. The suggested test method was developed by the
Rubber Manufacturers Association
for moisture testing in the 1950s
and has been widely accepted by
the flooring industry as a quantita-
tive measure of slab moisture. This
test works by a change in weight of
moisture-absorbing anhydrous cal-
cium chloride and represents the
amountofmoisturetransmittingout
of a large concrete slab area. The
value expressed by this test is called
“pounds” and is the equivalent
weight of the water that is emitted
from a 1,000 square foot (90 m’)
concrete slab surface area in a 24
hour period of time.
Protection: Prior to installation
of vapor control system, walls and
previously installed floor coverings
should be protected from the effects
of scarification and vapor control
system installation.
Surface Preparation: Surfaces to
receive vapor control system must
contain scarification by shot blast-
ing prior to installation of moisture
vapor control system. Cracks, con-
troljoints and coldjoints should be
prepared and treated in accordance
with vapor control system require-
ments. Surface to receive vapor con-
trol system should be cleaned and
surface irregularities treated with a
100% Portland Cement based patch- irgcompoundandcementitiousfill
compatible with vapor control
system. Methods of Appkation: Pen-
etrants and Coatings are applied by
roller application method to satu- rate the concrete surface.

7. WARRANTY
Floor Seal Technology, Inc. prod-
ucts are warranted to be free of de-
fects in manufacturing and

Floor Seal Technology, Inc. warrants
againstanyfailureofthe(finish)floor-
ing system due to concrete water
vaporemissiontothesystem installed
for a period of ten years. Should such
failure occur, Floor Seal Technology,
Inc. will replace me (finish) flooring
material, adhesive, Floor Seal Vapor
Control System, andall laborcostsfor
removal and replacement of those
products, providing failure is due to
vapor emissions within the limits of
the installed system.
8. MAINTENANCE
Floor Seal Technology, Inc. Va-
por Control Systems after installa-
tion are covered by a cementitious
underlayment and finish flooring
system, and therefore require no
maintenance.
