AGREEMENT
PARTIES: The parties to this Agreement are the City of
Carlsbad, California, a Municipal Corporation, hereinafter refer-
red to as CITY; and Hisashi Honda and Kiyome Honda, hereinafter
jointly referred to as HONDA,
COVENANTS: It is mutually agreed between the parties heretc
as follows:
1, HONDA agrees to convey to CITY an easement for water
pipeline purposes across that certain property, located in the Cit,
of Carlsbad, County of San Diego, State of California, more par-
ticularly described- on Exhibit **A*’ attached hereto and by this
reference incorporated herein,
2, CITY shall remove the trees presently located on the
northerly 193.83 Ft. of said real property described on said Exhibj
If tt A.
3, CITY shall provide HONDA two (2) 2” water connections
together with meters at locations along said pipeline e’asement
designated by HONDA,

HISASHI HONDA AND KIYOME HONDA, husband and wife as joint,
tenants M the Grantor, does hereby grant to the City
of CarIsbad, the Grantee, a right of way easement twenty feet ( 20 ’ ) in width.

Commencing at the intersection of the centerline of Chestnut Avenue,
60.00 feet wide, and the centerline of Cameo Road as shown on Chest-
nut Heights Map No. 5320, as filed in the Office of said County Re-
corder: thence Westerly along said centerline of Chestnut Avenue,
south 79O 24':West 418.21 feet to the beginning of a 296.00 foot
radius curve, concave Southeasterly; thence continuing along said
centerline through a central angle of 3O 07' 30", a distance of
16.14 feet: thence radial to said centerline along a line bearing
North 13" 43’ 30” West, a distance of 30.00 feet to a point on the
Northerly right of way line of Chestnut Avenue; said point also
being the TRUE POINT OF BEGINNING of the centerline to be described

November 16, 1896, described as follows:
Beginning at the Southwest corner of said Lot "J" marked by a 6 inch galvan-
ized iron pipe filled with cement: thence North 23O 33' West along the South-
westerly boundary line of said Lot "J", a distance of 179.37 feet to a point
on the Northerly line of the County Road as shown on Licensed Surveyor's Map
No. 441; thence continuing North 23O 33' West along the Southwesterly boundaq
line of said Lot "J", a distance of 351.08 feet to the TRUE POINT OF BEGINNINC

in Book 2266, page 396 of Official Records of San Diego County, California;
thence along the Northerly line of said Roe land: south 66O 40' 50" West, a
distance of 323.03 feet to the Northwest corner thereof; thence along the
Westerly line of said Roe land, South 23O 19' 10" East, a distance of 322.13
feet to the Southwest corner of said Roe land, being a point in a curve on
the aforementioned County Road convave to the south and having a radius of
326.09 feet: said radius having a bearing of south 11" 28' 49" East: thence
Westerly along said curve through an angle of 4O 27' 28", a distance of
25.37 feet to a point on said curve whose radius is 326.09 feet, said radius
having a bearing of South 15O 57' 17" East: thence North 23O 19' 10" West,
a distance of 317.91 feet: thence South 66O 40' 50" West, a distance of
