HomeMy WebLinkAboutLA POSADA - CATHOLIC CHARITIES; 2009-04-22;ity of Carlsbad Planning Department Sister RayMonda DuVall Catholic Charities 349 Cedar Street San Diego, CA 92101-3112 SUBJECT: AGRICULTURAL CONVERSION MITIGATION FEE GRANT FUNDING AGREEMENT Dear Sister DuVall, I am pleased to inform you that the Carlsbad City Council approved the Agricultural Conversion Mitigation Fee Ad Hoc Citizens Committee's recommendation to encumber your organization's entire funding request of $2,000,000 in Agricultural Conversion Mitigation Fee Grant funding, with the stipulation that, among other things, only $108,500 of that amount be authorized for disbursement at present to allow for design work. The grant funding is to be used for the following purpose(s): to construct a new permanent facility to accommodate farm workers and homeless individuals at Casa de Campensinos at La Posada de Guadalupe as described in your Grant Proposal No. AGP 06-16 - La Posada Farm Worker Housing, and as revised in your letter of April 20, 2007, that provides clarification on your request (see attached). The City Council resolution approving the funding and fully describing the stipulation is enclosed. This letter is to serve as a Letter of Agreement for disbursement of up to $108,500 ofthe grant only. Disbursement of the balance of funds will be subject to satisfaction of the conditions of City Council Resolution 2008-050, as well as Agricultural Conversion Mitigation Fee Ad Hoc Citizens Advisory Committee and City Council review of an updated project schedule and funding plan to be incorporated into a new funding agreement. The grant funds will be disbursed in increments and upon the achievement of milestones according to the updated project budget and schedule. Any project that is awarded funds will be required to meet agreed-upon milestones. If you need to make changes in your grant proposal project or schedule, please contact the Planning Department. Please provide an updated project budget and schedule that describes the work tasks, estimated cost, completion dates and requested disbursement schedule. In addition, please provide for the City's review and acceptance a funding plan that adequately outlines the means by which you anticipate acquiring the remaining funds necessary to support construction and ongoing operation of the project. City staff will then forward the Agreement to the Mayor for signature. Once the agreement has been signed by the applicants and the Mayor, we will begin the initial release of funds according to the approved milestones/funding schedule. If the funds are not spent for this specific purpose, they must be returned to the City. In addition, failure to satisfy the agreed-upon milestones will result in project reconsideration and possible cessation of funding. Grant recipients are required to recognize on all printed material that the project is funded in part or in full by the City of Carlsbad. A final report on how the funds were spent and what the project accomplished must be filed with the City of Carlsbad once the funds are spent or within one year of receipt of the last scheduled disbursement, whichever comes first. In addition, the grant recipient agrees to maintain original records (i.e., receipts) for at least five years from the date on which final grant funds are disbursed and agrees to make them available to the City should the City request to audit them. The total grant encumbered for Catholic Charities was 2 million dollars. A City Council action allowed Catholic Charities to draw from this grant up to $108,500 for design development. The intention of this allocation is to determine whether or not the envisioned project is viable. Catholic Charities is requesting the first, and perhaps the only draw, of^i^i8Mx)m the preliminary design fund. This design will generate a conceptual construction estimate and an overall project development schedule. The $54,000 will be used: • to develop schematic site plans and floor plans, building schematic elevations including architectural features, engineering scopes and extent of Structural, Mechanical, Electrical and Plumbing design. A review of Code issues and approval processes. $44,400 • to complete soils tests. $6,000 estimated • to complete the biology report. $4,000 estimated I estimate that all of the foregoing items can be completed within 45 days of receiving the requested draw. Any funds intended for preliminary design that are not used for this purpose will be used for construction. It is the intention of Catholic Charities to use CDBG funding ($205,000) for additional predevelopment and permitting costs. We understand that once the preliminary design is complete we will need to come back to the Advisory Committee and the City Council for approval of funding for the overall project. At that time we plan to provide an updated budget, project milestones, and an update on where we stand on overall funding for the project, including funding for operating costs. It is also our understanding that if for some reason the overall project is not approved or we decide we cannot move forward, then Catholic Charities will have no obligation to re-pay the $54,400 first draw, so long 6 Catholic Charities ^^'^^'^ California 92101-3197 * Tel. We do understand that we will be required return any unused portions of the first draw if they have not been spent on the items listed above. After the preliminary drawings are reviewed and discretionary permits are approved by Catholic Charities and the City, a general contractor will be engaged who will join the construction team. This team will work to complete and refine the design, cost estimate and construction schedule. As we discussed at our meeting, in addition to the Agricultural Mitigation Fee Grant, Catholic Charities has obtained a CDBG award for $205,000 for construction. We have also secured a grant of $150,000 from a private family foundation and have received donations of approximately $25,000 from about 70 local businesses, churches and individuals for operating costs. We are actively seeking funding from several additional sources with the help of Caring Residents of Carlsbad. Once Catholic Charities has evaluated the projected construction costs along with our fundraising efforts I will provide an update before we seek the balance of our $2,000,000 funding request. We believe our fundraising efforts will become even more effective once we have design drawings and a budget we can share with potential donors and other funding sources. Hopefully this letter provides you with all of the information you need to now forward the Funding Agreement on to the Mayor for signature and proceed with funding the first draw.
