CITY OF CARLSBAD RIGHT OF WAY - GENERAL OPERATING PERMIT
Submitted herewith is an approved General Operating Permit No.
11407 and supporting materials. This general operating permit is
now in effect per the permit issued date, and will remain in effect
until further notice.
As previously discussed with members of your district, this permit
allows your district to operate on a day-to-day basis in performing
routine maintenance and operational activities, localized testing
and repair of facilities and service lateral construction within
specific minimum guidelines set by the City Engineer. Along with
this permit goes the responsibility for the district to operate
within the guidelines of Engineering Department Policy No. 29 which
outlines specific traffic control requirements which are required
for all activities within the public rights-of-way. Further, the
district has the responsibility to telephone 438-3891 prior to 2:00
PM the day prior to scheduled work within a city street. A city
inspector will respond to your inspection request and issue an on-
site permit or will mail the permit to your district if field
contact is not made. Billing for inspection services will be
quarterly at $25.00 per permit.
Allow me to request that all personnel operating within the general
operating permit guidelines be fully aware of the conditions and
limitations of the permit. Work within the right of way which
exceeds the limits of this permit still requires a formal traffic
control submittal and permit application to be submitted at 2075
Las Palmas Drive.

Dear Ms. Geiselhart:
The City of Carlsbad for some time has been aware of the need to establish an
ongoing Right of Way Permit for special Districts and Utilities to streamline
permit processes. The purpose of this Permit is to allow certain minor routine
maintenance and construction operations to proceed as efficiently as possible
while allowing the City sufficient opportunity to insure public safety and
qua! ity control .

repairs to existing facilities.
Localized testing and repair of facilities not involving more than
100 square feet of excavation.
Service lateral construction not exceeding 150 -feet of length within
a public place or street right-of-way,
Work authorized under the Permit may proceed as authorized by the City's Right
of Way Inspector following receipt of a standard inspection request 24 hours in
advance of the maintenance or construction activity.
For purposes of billing, each work location shall constitute a permit under City
Ordinance, and a $25 charge will be assessed. Permits will be billed ..-on. a
quarterly basis.
For work covered by this Permit, a job-specific Traffic Control Plan (TCP) shall
be required for work on Circulation Element streets and as further stipulated
in Engineering Department Policy No. 29, copy enclosed. Where a detailed TCP
is required, no work shall proceed until the TCP has been approved and returned.
A minimum of 48 hours will be required to process a TCP. The TCP shall be
available at the work site at all times. TCP's submitted under this Permit will
be reviewed and approved by the City's Right of Way Inspector in consultation
with the Traffic Engineering Division.

In the event the permittee fails to adequately protect or restore public
improvements, the City Engineer at his sole discretion may proceed to effect
necessary repairs or install safety measures and recover costs from the
permittee.
Failure to comply with the provisions of this Permit may result in revocation
of the Permit.
In conformance with Municipal Code, Section 11.16.100(d), "The City Engineer
shall require as a condition of permit reinstatement payment of all charges
incurred by the City as a result of permit revocation including a $500 penalty
for violation."
Please complete the attached Right of Way Permit, sign and date and return to
this office. Upon receipt of the complete permit application, you will be
notified of a pre-construction conference where the permit will be issued. Upon
issuance, work may proceed in conformance with the Permit. For further
information, I've attached a copy of "Work in the Public Right of Way."

NUMBER:29 SUBJECT: TRAFFIC CONTROL, PLANS, APPLICATIONS
PROCEDURES, CASH DEPOSIT AND OPERATION'S
EFFECTIVE:
March 11, 1988

PURPOSE:
To establish a clear, uniform and correct procedure for the
design, application for approval of, and execution of temporary
traffic control facilities.
POLICY;
Traffic control facilities for construction and maintenance
work zones shall be constructed, operated and maintained in
accordance with Chapter 5 of the CALTRANS "Traffic Manual",
this policy, City of Carlsbad "Standard Design Criteria for
the Design of Public Works Improvements in the City of
Carlsbad", and to satisfaction of the City Engineer. The
plans, exhibits, applications and securities shall be submitted
in form, content and amount to the satisfaction of the City
Engineer, and as required herein prior to the start of any
construction or maintenance operations on, or effecting, any
city street, thoroughfare, or alley.
DEFINITIONS:
Right-of-way Permit - All documents, plans, calculations,
applications and securities that have been accepted, approved
and executed by the City Engineer in accordance with Section
No. 11.16.010 Et Seq. of the Carlsbad Municipal Code. A
right-of-way permit is the instrument used by the city to
control construction and maintenance activities within and
affecting public rights-of-way.
REQUIREMENTS:
A traffic control plan shall be provided by any person who
proposes construction within or otherwise affecting a public
right-of-way and by any person who proposes to guide, warn or
regulate traffic on public streets, or to enter onto or leave
the public right-of-way to or from private lands at any location
not having an approved driveway entrance onto a public street.
A location of on/off street traffic that has an existing
driveway will require a traffic control plan as a part of a
right-of way permit when the nature or intensity of traffic
using it is significantly increased, due to construction or
maintenance activities. When traffic control is reg_uired, a
right-of- way permit will be required even if no construction
will occur with the right-of-way.

in addition to drawings and documents detailing the construction
proposed with the public right-of-way and otherwise required
for a right-of-way permit, the applicant shall provide a
traffic control plan to accompany each right-of-way permit
application. No right-of-way permits will be issued without
an approved traffic control plan.
when any of the following conditions are proposed or exist, a
project specific drawing must be provided that shows traffic
control:
A. The work will require complete closure of any street;
B. The work will take place on circulation element streets;
C. The work will take place within an intersection (defined
as all that area of the public street bounded by a series
of lines connecting the points of tangentry of each curb
return);
D. The work will take place within travel lanes and within
200 feet of an arterial street, or within 200 feet of
any traffic signal;
E. The work, equipment, spoil or construction materials
preclude safe pedestrian traffic within the street right-
of-way on the side(s) of the street that said work,
equipment, spoil or construction materials may be located.
Pedestrian traffic within parking, bicycle, and traffic
lanes is defined as not safe;
F. The work will take place within 500 feet of boundary of
any school yard;
G. The work, equipment, spoil, or construction materials
will block any traffic or bicycle lane over night;
H. The work involves a detour; or
I. The City Engineer determines that some special circumstance
exists.
When none of the conditions listed above exist, the drawing
used to support the application may consist of page(s) of
figures copied from the latest edition and/or revision of the
"Manual of Traffic Controls for Construction and Maintenance
Work Zones" as published by CALTRANS. When a project specific
drawing is required, the following criteria must be met:
A. The drawing must be prepared in ink on 8V X 11" or 11"
X 17" size paper, except that drawings for more extensive
projects may be prepared on 24" X 36" paper. Three sets
of drawings shall be submitted, folded to a maximum
dimension of 8V X 11".
B. The drawings need not be to any specific scale, but must
be drawn so that the existing conditions, proposed work,
and traffic control facilities are clearly designated.

C. Detour routes and signage must be similarly drawn when
used.
D. A separate reversal, or switch over plan, shall be provided
when the applicant proposes to move traffic lanes during
the traffic control effort.
E. Each project specific drawing shall, as a minimum, show
the following data:
1. North arrow;
2. Street name(s);
3. Existing and temporary striping;
4. Location and spacing of signs, cones, delineators,
barricades, flashers, and all other facilities that
the applicant proposes to use (graphic location and
spacing will suffice);
5. Proposed hours of operation of the traffic control
operation;
6. Mounting method for signs:
a. When signs will be in place during Saturday,
Sunday or holidays, the signs shall be post
mounted unless the street will be completely
cleaned, cleared, and restored on or before
3:00 P.M. each day.
b. When not required to be mounted as noted above,
signs shall be supported in a manner appropriate
for the location, road geometry, traffic density,
and weather conditions.
7. Flagger location(s);
8. cross reference numbers of projects that are related
to, or that the traffic control plan is a part of;
9. Arrows designating traffic flow;
10. Specific location of work area;
11. Date of preparation; and
12. Name, address, and telephone number of individual who
prepared the plan. Because of complexity of design
or high potential for risk to the public, the City
Engineer may require some traffic control plans to
be prepared under the responsible charge, signature,
and seal of a registered professional engineer.
F. All traffic control shall be designed and provided in
accordance with City Ordinances and Standards, State
Law, and specifically, in accordance with the most recent
edition of "Manual of Traffic Controls for Construction
and Maintenance Work Zones", as published by CALTRANS.
CASH SECURITY:
The applicant shall deposit cash security for the purpose of
guaranteeing the continuous operation of the traffic control
operation, as approved by the City Engineer, throughout the

time the work is within or affects the public way. The cash
shall be deposited with the City prior to issuance of the
right-of-way permit. The amount of the cash security shall
be based on the cost to the City of making immediate repairs
to City streets, and adequately warn and route traffic through
or around construction and maintenance work that affects City
Streets. Specific amounts for traffic control cash deposits
shall equal $1,050.00 plus $3.50 per linear foot of working
zone. The deposit amount shall be used only for providing,
enhancing, or restoring traffic control facilities recommended
in the guideline provided by "Manual of Traffic controls for
Construction and Maintenance Work Zones", as published by
CALTRANS or as may be directed by the City Engineer. It is
the intent of the city to require the applicant to provide
and maintain temporary traffic control facilities required by
this policy. The City proposes to initiate, maintain or
restore temporary traffic control facilities only as an
emergency procedure of shor.t duration when the applicant
fails to assure a safe and expedient flow of traffic. The
applicant will be notified, in writing, as soon as practicable
after the initiation of the procedure. The cost of the City
involvement will be deducted from the applicant's cash deposit.
The applicant shall promptly restore the balance of the cash
deposit. Failure to do so within a ten (10) calendar day
period will constitute reason for revocation of the right-of-
way permit and the immediate removal of the applicant's equi-
pment and materials from the public right-of-way and forfeiture
of all deposits necessary to effect such removal and to restore
the work area to City standards.
Unless otherwise specifically noted on the right-of-way permit,
the traffic control plan will be valid unless revoked by the
City Engineer for a period equal to the duration of the right-
of-vay permit, until the work for which the right-of-way permit
is issued is completed, or six months, whichever is less.
When the applicant has completed all work permitted by the
right-of-way permit, or when the traffic control plan has
expired or been revoked and the work within the right-of-way
has received a final inspection, has no outstanding corrections
to be made, and the applicant has made written application
for refund in accordance with community Development Policy
Number 1, the unused portion of the cash deposit to secure
traffic control will be refunded.

Re: Routine Sewer Line Cleaning Operations
Dear Mr. Cook;
Recently a question was raised by your staff regarding LCWD's General
Operating Permit #11407 and its application to our sewer line cleaning opera-
tions. The District's position on this matter is that the provisions of our
present permit not be interpreted to include routine line cleaning. When this
operation is in progress, the work crew's location is changing continuously due
to conditions or emergency situations that may arise. To require on-site
inspection of this work would be impractical and less than efficient utilization
of both LCWD personnel and Carlsbad's city inspectors.
I assure you that LCWD personnel are working in accordance with traffic
control procedures for right-of-way work as outlined in Caltran's "Manual of
Traffic Controls for Construction and Maintenance Work Zones".
Therefore, to facilitate the efficient utilization of LCWD maintenance
personnel, I am requesting that our 6.0,P. be modified to allow normal line
cleaning operations to take place without falling under the provisions of the
G.O.P.
