TERMS OF WRITTEN AGREEMENT OF DATE JUNE 16,1954
BETWEEN THE CITY OF OCEANSIDE AND THE CARLSBAD
MUNICIPAL WATER DISTRICT.
THIS AGREEMENT made and entered into as of June 17, 1955 between
CITY OF OCEANSIDE, a municipal corporation located in San Diego County,
California, party of the first part, hereinafter referred to as "City",
and CARLSBAD MUNICIPAL WATER DISTRICT, a municipal corporation also
located in the County of San Diego, California, hereinafter referred to
as "District",
WITNESSETH:
WHEREAS, the parties hereto under date of June 16, 1954 executed
a written agreement, effective for the period of one year from the date
thereof, under the terms of which District for certain considerations
was permitted to use the City's Aqueduct Supply Pipeline for the purpose
of conveying and transporting water purchased by District from San Diego
County Water Authority; and
WHEREAS, it is the desire of said parties to extend for a period
of one year only, subject to thd modifications and changes hereafter
stated, the privileges and obligations of said written agreement;
NOW, THEREFORE, in consideration of the mutual promises of the
parties herein undertaken and agreed upon and the fulfillment of such
promises, the City and the District agree that said written agreement
of June 16, 1954, as herein modified and changed, is extended for the
period of one year from the date thereof, subject to the following terms,
conditions, modifications and changes:
1. The consideration for the privilege of transporting water
through said pipeline shall be changed and increased from the sum of
$5.00 for each acre foot of water conveyed through said pipeline by the
District to the sum of $6.14 for each acre foot of water so conveyed.
2. The City of Oceanside will deliver water that has a chlorine
concentration of not to exceed .5 of one part per million at the points
of delivery to the Carlsbad Mutual Water Company.

5. The City has exercised its option to purchase the cjjlorination
equipment consisting of
1. One pumping unit - 85 gallons per minute against a
600 foot head capacity,
2. One set of platform scales, 5,000 pound capacity.
5. One set of two ton chain falls.
The foregoing chlorinating equipment shall be delivered to and pur-
chased by the City for 85% of the purchase price paid for said equip-
ment, viz., the original Invoice prices thereof.
4. In the event of a mechanical failure of the City's
8 inch meter located at Hunsaker and California Streets in said City,
or in the event said meter becomes congested with debris and the
District's check meter, also located near said Hunsaker and California
Streets, records less water than said City meter for any calendar day,
the District's check meter reading shall be used for recording purposes.
The City and the District immediately upon the execution of this agree-
ment shall cause their respective meters above identified to be tested
by the meter manufacturers and shall exchange copies of the written re-
port of such tests.
5. To become effective this agreement to extend, modify and
change said written agreement of June 16, 1954 must be approved by the
San Diego County Water Authority within a period of thirty days from the
date hereof.
6. This agreement shall not be subject to renewal.
On behalf of the City this contract is signed and executed by
its Mayor aid its City Clerk pursuant to resolution of its City CoQncil.

On behalf of the District this contract is signed and executed
by its President and its Secretary pursuant to resolution of its
Board of Directors.
Dated at Oceanside, California as of the 17th day of
June, 1955.
