An act to add Section 787 to the Public Utilities Code, relating to
public utilities.

SB 846, Bergeson. Public utilities: recycled soil.
Existing law requires cities and counties to reduce the amount of
solid waste.
This bill would permit any public utility, or its contractor, to
which an excavation permit has been issued by any local agency for the
installation, removal, maintenance, or repair of underground facilities
to backfill the permitted excavation in any public road or highway with
native spoil, if specified conditions are met.
The people of the State of California do enact as follows:
SECTION 1. The Legislature finds and declares all of the following:
(a) The State of California is experiencing a critical shortage of
'fill space for the state's solid waste.
•) Pursuant to Division 30 (commencing with Section 40000} of the
iC Resources Code, cities and counties are required to devise
-grams for their jurisdictions to reduce the amounts of solid waste
yoing to landfills.
(c) Current laws in many local jurisdictions require excavations to
be backfilled with slurry, and for the native spoil from the excavation
to be disposed.
(d) Frequently, the only disposal sites available for excavation
spoil are the state's landfills.
(e) Disposal in landfills of spoil that is competent for use as
backfill wastes a substantial amount of valuable landfill space.
(f) Allowing alternative uses for this spoil will assist cities and
counties in reaching the goals specified in the source reduction
component of their integrated waste management plans.
SEC. 2. Section 787 .aded to the Public Utilities Code, to read:

787. (a) Any public utility, or its contractor, to whom an
excavation permit has been issued by any local agency for the
installation, removal, maintenance, or repair of underground facilities
may backfill the permitted excavation in any public road or highway with
native spoil if all of the following conditions are met:
(1) The native spoil is competent spoil.
(2) Compaction meets the local agency's requirements using industry
standards for testing compaction.
(3) The public utility or its contractor has no physical evidence
of, or substantial reason to believe that there has been, contamination
of the soil from hazardous wastes.
(4) Within 30 days prior to compaction, a local agency has not
provided the public utility or its contractor with physical evidence of,
or substantial reason to believe that there has been, contamination of
the soil from hazardous wastes.
(b) If a local agency has determined through prior experience that
the public utility that is applying for, or benefiting from, the
excavation permit has previously neglected to adequately fill or compact
prior excavations, whether directly or through its contractors, the
local agency may, as a condition of the excavation permit do either or
both of the following:
(1) Require the public utility to post a bond, with a term not
exceeding one year, amounting to two times the cost for the local agency
to repair the backfill work, if done improperly, or any related
collateral damage.
{2} Require the public utility to submit a report from a registered
soils engineer that the proper compaction of the excavation has been

(c) For purposes of this section:
(1) "Competent spoil" means soils that can be treated to bring their
moisture content into the optimum range, and that can achieve the
compaction required by the local agency.
•"" "Local agency" means any city or county agency.
'Public utility" means any electrical corporation, gas
corpc.itlon, heat corporation, water corporation, telephone corporation,
pipeline corporation, sewer corporation, telegraph corporation, where
the service is performed for, or the commodity delivered to, the public
or any portion thereof.

Re: Parking vehicles on sidewalks
I received the attached letter from the City of Carlsbad reminding us that parking vehicles
on the sidewalk is prohibited.The letter was sent to all utilities as well as the City's work
force.
We should only have a vehicle on the sidewalk when absolutely necessary, such as pulling
cable in a manhole that can't be reached otherwise. Vehicles should not be parked on
sidewalk to avoid parking curbside and setting up proper traffic control.
If it is absolutely necessary to park on the sidewalk, you must first notify the City and be
able to address the issue of pedestrian safety.
Your cooperation in this matter is greatly appreciated.

CITY SIDEWALKS
This is a reminder that parking of equipment and or vehicles on City sidewalk is a violation
of the Carlsbad Municipal Code as well as the Vehicle Code. You are required to obey the
law while working within the City of Carlsbad under a right of way permit, this also applies
to your contractors and subcontractors.
Doing work under a yearly General Operating Permit (GOP) does not allow you or your
contractor to violated the law either. Parking on the sidewalk is illegal even under the
GOP. Continued disregard for this law may result in the cancellation of your permit or
cited for a violation by the Police or even both. Please inform the appropriate people within
your organization not to park on the sidewalks.

GENERAL OPERATING PERMIT - NO. 11405
Submitted herewith is an approved General Operating Permit No.
11405 and supporting material. This general operating permit will
remain valid until further notice or revocation.
Day-to-day general operating permit responsibilities are outlined
in the "General Utility Operating and Excavation Right-of-Way
Conditions", and "Engineering Department Policy No. 29" for traffic
control requirements within the public right-of-way. I submit a
copy of each for your review and distribution within Pacific Bell.
To clarify how the general operating permit requirements may
specifically apply to Pacific Bell operations, I submit the
following:
1. Routine maintenance and operational activities such as
dewatering vaults, vault repair, overhead line repair or
maintenance will require a site specific traffic control plan
and a 24 hour advance notification to Engineering Inspection.
This site specific traffic control plan, once approved, can
be given a number, become part of Pacific Bell's Standard
Trafic Control Manual, and be used whenever the same work is
required for that specific site.
2. Localized testing and repair of in-place facilities not
exceeding 100 square feet of excavation allows Pacific Bell
to excavate small trenches within sidewalks or streets,
replace existing facilities, pull cable and the like.
Again, a site specific traffic control plan and 24 hour
advance notification of work is required. This traffic
control plan may also be added to Pacific Bell's Standard
Traffic Control Manual and be reused.

During the course of replacement of sidewalk or base/paving,
a city inspector will need to be notified and inspect the site
prior to placing concrete or asphalt. Inspection will be
required prior to work and prior to replacement of city
facilities.
3. New construction of service laterals not exceeding 150 linear
feet of lateral excavation. Typical items of construction
include new installation of underground facilities, raising
vault lids after overlays, relocation of existing lines, etc.
For this type of operation, a sub-contractor or Pacific Bell
construction forces would be utilized. A site specific
traffic control plan will need prior approval and may be a
standard plan from the manual providing the work is conducted
on a residential or collector street, or on an arterial with
the following restrictions:
A. Construction is completed within one day.
B. Construction closes no more than one lane of traffic and
allows for the free flow of vehicular or pedestrian
traffic through the work zone.
C. Construction does not take place within an intersection
or within 200 feet of a traffic signal.
D. Construction does not involve a detour or weekend work.
Traffic control plans which are required for any of the above
restrictions should be submitted to Engineering Inspection 48
hours prior to scheduling any construction for review and
approval.
4. Emergency work conducted within the right-of-way shall proceed
as needed, with notification of ongoing work communicated to
Engineering Inspection at the earliest convenient time.
Traffic control shall be per previously approved site specific
plan or as required per latest edition of the Caltrans
"Traffic Manual".
It shall be Pacific Bell's responsibility to notify Engineering
Inspection prior to any work (except emergency) by telephoning 438-
3891 prior to 2:00 PM for next day inspection services. An
inspector will respond to the request and issue a site specific
permit, which will be billed quarterly to Pacific Bell at $25 per
work site. If an operation continues beyond one day or one site,
only one permit fee will be charged.
The city is presently exploring the possibility of charging a once-
a-year blanket fee rather than continuing the $25 per permit fee
for general operating permits. If and when a blanket fee is agreed
upon and initiated, site specific permits will still be issued in

response to an inspection request, but the fee and quarterly
billing will cease.
Allow me to request that all Pacific Bell personnel operating
within the General Operating Permit Guidelines be fully aware of
the conditions and limitations of this permit process. Work within
the right-of-way which exceeds the limits of this permit still
requires a formal traffic control submittal and permit application
to be submitted at 2075 Las Palmas Drive. A change on behalf of
the city now allows the Engineering Right-of-Way Inspector to
review utility company traffic control plans for a 48-72 hour turn
around, barring complications. This change should allow for
quicker processing of those traffic control plans which are
required for a right-of-way permit.
I truly appreciate all of the cooperation that you and your staff
have given myself and city staff in developing your part in the
City of Carlsbad General Operating Permit Program. We have met
many times to discuss the finer points of this program, and because
of those meetings I believe Pacific Bell and the City of Carlsbad
have come a long way toward achieving an operating program which
benefits both concerns. As the future need arises to further
coordinate the mechanics of this program, please feel free to
contact me at your convenience.

DAY TO DAY OPERATING PROCEDURES
FOR THE GEMERAL OPERATING PERMIT
I. UPON INITIATION OF WORK
1. Telephone 438-3891 prior to 2:00 PM for next day inspection
service. For emergency work, telephone above number at the first
opportunity during normal work hours. Required information to be
telephoned in:
A. Utility Company requesting inspection.
B. Approved traffic control plan to be used.
C. Location of work - nearest cross street or address.
D. Type of work.
E. Right of Way Permit number.
2. An inspector will receive your request for next day service.
3. If any questions arise, contact the city right of way inspector
direct by telephoning 438-3634 between 7:00 -7:30 AM or 3:30 - 4:00
PM.
II- COMMENCING WORK
1. Set up traffic control per approved plan and begin the work. An
inspector will stop by and issue to the field foreman a General
Operating On-Site Permit. This permit is your formal record of
city service and will need to be forwarded to your accounting
department.
2. The city will bill your utility quarterly at a rate of $^5.00 per
permit issued.
3. The right of way inspector will review the site to assure city
requirements are met, and will require your on-site foreman to sign
a Right of Way Pre-Con Agenda form.
III. PROJECT CONTINUATION/COMPLETION
1. Telephone 438-3891 to schedule inspection for construction of city
property. (i.e. subgrade, base grade, paving, concrete are
required inspections.)
2. Upon work completion, telephone above number to schedule final.
Carefully review the limitations of the General Operating Permit. If
work is scheduled/ongoing, which goes beyond these limitations, the city
inspector may need to halt all work until a formal right of way permit
is acquired.

INTRODUCTION
The City of Carlsbad recognizes the unique need of Utility companies to enter
upon the public right-of-way to maintain, operate, repair and make routine
connections to their facilities. In recognition of this unique status, the City
finds it convenient to establish a General Operating Permit to allow the
expeditious coordination of these activities while insuring the public health
and safety and maintaining the integrity of public improvements.
GENERAL CONDITIONS
This Permit is valid only for the following types of activity and construction
conducted by a Special District or Public Utility:
m Routine maintenance and operational activities involving minor repairs to
existing facilities
m Localized testing and repair of facilities not involving more than 100
square feet of excavation
H Service lateral construction not exceeding 150 feet of length within a
public place
Any work not meeting this criteria shall require a separate Right of Way Permit
in conformance with Municipal Code.
NOTICE TO PROCEED
Except for emergency situations, no work authorized under this Permit shall
commence until a proper inspection request has been made to the City's Right
of Way (ROW) Inspector and verbal authorization is issued to proceed.
A minimum of 24 hours prior to the scheduled beginning of any work, the District
or Utility shall notify the ROW Inspector of work contemplated. Notification
shall contain the location and description of the proposed work, when work is
planned to begin, and the applicant's contact person and phone number.
In case of emergency during normal working hours, the Utility shall notify the
Inspector by phone as the work is in progress. Within 48 hours of any emergency
work, the Utility shall notify the City in writing of such work. Said notice
shall include the location and description of the work performed and a
justification of the emergency nature of the work.

PERFORMANCE
All work within the public right-of-way shall be in conformance with the City
of Carlsbad Municipal Code, Standard Drawings, the APWA Standard Specifications
for Public Works Construction (Green Book) and San Diego County Regional Standard
Drawings.
The permittee shall be responsible for the restoration and repair of failed
trenches, damaged streets, curbs and gutters, driveways, traffic control loop
detectors and other public facilities, all to the satisfaction of the City
Engineer, and warrant said work for its effective life.
In the event the permittee fails to protect or restore public improvements, the
City Engineer at his sole discretion may proceed to effect necessary repairs or
install safety measures and recover costs.
Failure to comply with the provisions of this Permit may result in revocation
of the Permit. In conformance with Municipal Code, Section 11.16.100 (d), *
The City Engineer shall require as a condition of permit reinstatement payment
of all charges incurred by the City as a result of permit revocation Including
a $500 penalty for violation."
TRAFFIC CONTROL PLAN
All work performed shall be in conformance with CALTRANS Manual of Traffic
Control Devices for Construction and Maintenance Work Zones. Individual Traffic
Controls Plans (TCP) will be required as stipulated in the provisions of
Engineering Department Policy No. 29. All required TCP's shall be submitted to
the ROW Inspector, and work shall not proceed until the plan is approved.
Approved TCP's shall be held at the work site at all times. A minimum of 48
hours will be required to review any individual TCP.
PERMIT FEES
City Council resolution provides for a fee of $2% for each Right of Way Permit.
For purposes of the General Utility Operating and Excavation Right of Way
Permit, it is agreed that the initial inspection request for each work location
shall constitute an individual Right of Way Permit. The City shall quarterly
summarize such notices and bill the Utility for all permits issued during the
previous quarter. Failure to render payment within 45 days shall constitute a
violation of this Permit, providing sufficient cause for revocation.

PURPOSE!
To establish a clear, uniform and correct procedure for the
design, application for approval of, and execution of temporary
traffic control facilities.POLICY!
Traffic control facilities for construction and maintenance
work zones shall be constructed, operated and maintained in
accordance with Chapter 5 of the CALTRANS "Traffic Manual",
this policy, City of Carlsbad "Standard Design Criteria for
the Design of Public Works Improvements in the City of
Carlsbad", and to satisfaction of the City Engineer. The
plans, exhibits, applications and securities shall be submitted
in form, content and amount to the satisfaction of the City
Engineer, and as required herein prior, to the start of any
construction or maintenance operations on, or effecting, any
city street, thoroughfare, or alley.
DEFINITIONS:
Right-of-way Permit - All documents, plans, calculations,
applications and securities that have been accepted, approved
and executed by the City Engineer in accordance with Section
No. 11.16.010 Et Seq. of the Carlsbad Municipal Code. A
right-of-way permit is the instrument used by the city to
control construction and maintenance activities within and
affecting public rights-of-way.
REQUIREMENTS:
A traffic control plan shall be provided by any person who
proposes construction within or otherwise affecting a public
right-of-way and by any person who proposes to guide, warn or
regulate traffic on public streets, or to enter onto or leave
the public right-of-way to or from private lands at any location
not having an approved driveway entrance onto a public street.
A location of on/off street traffic that has an existing
driveway will require a traffic control plan as a part of a
right-of way permit when the nature or intensity of traffic
using it is significantly increased, due to construction or
maintenance activities. When traffic control is required, a
right-of- way permit will be required even if no construction
will occur with the right-of-way.

In addition to drawings and documents detailing the construction
proposed with the public right-of-way and otherwise required
for a right-of-way permit, the applicant shall provide a
traffic control plan to accompany each right-of-way permit
application. No right-of-way permits will be issued without
an approved traffic control plan.
When any of the following conditions are proposed or exist, a
project specific drawing must be provided that shows traffic
control:
A. The work will require complete closure of any street;
B. The work will take place on circulation element streets;
C. The work will take place within an intersection (defined
as all that area of the public street bounded by a series
of lines connecting the points of tangentry of each curb
return);
D. The work will take place within travel lanes and within
200 feet of an arterial street, or within 200 feet of
any traffic signal;
E. The work, equipment, spoil or construction materials
preclude safe pedestrian traffic within the street right-
of-way on the side(s) of the street that said work,
equipment, spoil or construction materials may be located.
Pedestrian traffic within parking, bicycle, and traffic
lanes is defined as not safe;
F. The work will take place within 500 feet of boundary of
any school yard;
G. The work, equipment, spoil, or construction materials
will block any traffic or bicycle lane over night;
H. The work involves a detour; or
I. The City Engineer determines that some special circumstance
exists.
When none of the conditions listed above exist, the drawing
used to support the application may consist of page(s) of
figures copied from the latest edition and/or revision of the
"Manual of Traffic Controls for Construction and Maintenance
Work Zones" as published by CALTRANS. When a project specific
drawing is required, the following criteria must be met:
A. The drawing must be prepared in ink on 8V X 11" or 11"
X 17" size paper, except that drawings for more extensive
projects may be prepared on 24" X 36" paper. Three sets
of drawings shall be submitted, folded to a maximum
dimension of 8V X 11".
B. The drawings need not be to any specific scale, but must
be drawn so that the existing conditions, proposed work,
and traffic control facilities are clearly designated.

Detour routes and signage must be similarly drawn when
used.
A separate reversal, or switch over plan, shall be provided
when the applicant proposes to move traffic lanes during
the traffic control effort.
Each project specific drawing shall, as a minimum, show
the following data:
1. North arrow;
2. Street name(s);
3. Existing and temporary striping;
4. Location and spacing of signs, cones, delineators,
barricades, flashers, and all other facilities that
the applicant proposes to use (graphic location and
spacing will suffice) ;
5. Proposed hours of operation of the traffic control
operation;
6. Mounting method for signs:
a. When signs will be in place during Saturday,
Sunday or holidays, the signs shall be post
mounted unless the street will be completely
cleaned, cleared, and restored on or before
3:00 P.M. each day.
b. When not required to be mounted as noted above,
signs shall be supported in a manner appropriate
for the location, road geometry, traffic density,
and weather conditions.
7. Flagger location(s);
8. Cross reference numbers of projects that are related
to, or that the traffic control plan is a part of;
9. Arrows designating traffic flow;
10. Specific location of work area;
11. Date of preparation; and
12.- Name, address, and telephone number of individual who
: . prepared the plan. Because of complexity of design
or high potential for risk to the public, the city
Engineer may require some traffic control plans to
be prepared under the responsible charge, signature,
and seal of a registered professional engineer.
All traffic control shall be designed and provided in
accordance with City Ordinances and Standards, State
Law, and specifically, in accordance with the most recent
edition of "Manual of Traffic Controls for Construction
and Maintenance Work Zones", as published by CALTRANS.
CASH SECURITY:
The applicant shall deposit cash security for the purpose of
guaranteeing the continuous operation of the traffic control
operation, as approved by the City Engineer, throughout the

time the work is within or affects the public way. The cash
shall be deposited with the City prior to issuance of the
right-of-way permit. The amount of the cash security shall
be based on the cost to the City of making immediate repairs
to City streets, and adequately warn and route traffic through
or around construction and maintenance work that affects city
Streets. Specific amounts for traffic control cash deposits
shall equal $1,050.00 plus $3.50 per linear foot of working
zone. The deposit amount shall be used only for providing,
enhancing, or restoring traffic control facilities recommended
in the guideline provided by "Manual of Traffic Controls for
Construction and Maintenance Work Zones", as published by
CALTRANS or as may be directed by the City Engineer. It is
the intent of the City to require the applicant to provide
and maintain temporary traffic control facilities required by
this policy. The city proposes to initiate, maintain or
restore temporary traffic control facilities only as an
emergency procedure of short duration when the applicant
fails to assure a safe and expedient flow of traffic. The
applicant will be notified, in writing, as soon as practicable
after the initiation of the procedure. The cost of the City
involvement will be deducted from the applicant's cash deposit.
The applicant shall promptly restore the balance of the cash
deposit. Failure to do so within a ten (10) calendar day
period will constitute reason for revocation of the right-of-
way permit and the immediate removal of the applicant's equi-
pment and materials from the public right-of-way and forfeiture
of all deposits necessary to effect such removal and to restore
the work area to City standards.
Unless otherwise specifically noted on the right-of-way permit,
the traffic control plan will be valid unless revoked by the
City Engineer for a period equal to the duration of the right-
of-way permit, until the work for which the right-of-way permit
is issued is completed, or six months, whichever is less.
When the applicant has completed all work permitted by the
right-of-way permit, or when the traffic control plan has
expired or been revoked and the work within the right-of-way
has received a final inspection, has no outstanding corrections
to be made, and the applicant has made written application
for refund in accordance with Community Development Policy
Number 1, the unused portion of the cash deposit to secure
traffic control will be refunded.
