AGREEMENT BETWEEN CITY AND PALOMAR COLLEGE FOR LEASE OF SURPLUS POLICE VEHICLES
THIS AGREEMENT is made this A-- day of _ SU.NE , 1996,
-_ between the City of Carlsbad, a municipal corporation of the State of
California, hereinafter referred to as City, and Palomar College, herinafter
referred to as College.
RECITAL
WHEREAS,
September 1996:
WHEREAS,
College will offer a Basic Police Course beginning
and
the accreditation requirements of the program include a
demonstrated inventory of training equipment: and
WHEREAS, City has two surplus police vehicles which could be leased
to College for training purposes within the academy as well as other travel
needed in support of the Police Academy and the Administration of Justice
Program:
NOW, THEREFORE, in consideration of the above recitals, it is agreed
as follows:
1. City will lease two surplus police vehicles to College for a period of
twenty-four (24) months, commencing May’7996 and ending May 14, 1998.
2. As consideration for the lease of the vehicles College provide to City
the amount of one dollar ($1 .OO), due and payable upon delivery of the
vehicles to College.

3, College will paint and detail the vehklcs upon receiving them and
will be responsible for ensuring their maintenance and repair as needed
during the lease period and for the purchase of gas.
: 4. College agrees to indemnify and hold harmless the City of Carlsbad
and its officers. offkials, employees and volunteers from and against all
claims, damages, losses and expenses including attorney fees arising out of
its use of the vehicles described herein. College shall at its own expense,
upon written request by the City, dcfcnd any such suit or action brought
against the City, its ofkers. officiaIs, employees and volunteers arising from
the intentional misconduct ox negligent acts of the College.
5 College shall obtain and maintain for the duration of this
agreement and any extension thereof, automobile liability insurance with
minimum coverage of $l,OOO,OOO combined single limit per accident for
bodily injury and property d,amagc. The City shall bc named as an additIonal
insured on the polky, which shall not be canceled without 30 days prior
written notice to the City sent by certified mak
6. At the expiration of the lease term College will return the vehicles
to City and will have the option, upon mutual agreement of both parties, to
renew this agreement for an additional two-year pertod with two new
surplus vehicles.
7. A detailed description of the vehicles to be provided, includmg year
of make, license plate and VIN number is attached hereto as Exhibit A.
IN WITNESS, WHEREOF, the parties hereto have executed this agreement.

BETWEEN

AND
PALOMAR COMMUN=COLLEGE DISTRICT
FOR
SURPLUS POFE VEHICLES
THIS AGREEMENT is made effective May 15, 1998, between the City of Carlsbad, a
municipal corporation of the State of California, and the Palomar Community College
District, dba Palomar College, a public entity of post secondary education operating in
the State of California.
RECITALS
WHEREAS, the City of Carlsbad (hereinafter the “City”), and the Palomar Community
College District, dba Palomar College (hereinafter the “College”), entered into a lease of
City surplus police vehicles effective 13 June 1996; and,
WHEREAS, the term of the lease agreement ends on May 14, 1998, and the City and
College desire to extend the agreement by an additional two year period; and,
WHEREAS, the City continues to carry the subject vehicles on its inventory as “surplus”
and does not have a present need to use these vehicles in its Police or law enforcement
efforts; and,
WHEREAS, the College has a continuing need to use the subject vehicles in its Police
Training Programs, and in the Administration of Justice program;
NOW THEREFORE, in consideration of the above recitals, the substance of which is
incorporated herein by this reference, City and College agree:
1. The term of the lease, which expires May 14, 1998, is hereby extended for
additional two calendar years, and shall now expire on May 13, 2000.
2. As additional consideration for the lease of the subject vehicles, receipt of which
is hereby acknowledged, the College pays to the City the sum of one dollar
($1 .OO) for both vehicles for the additional two year term.

3. The terms and conditions of the original lease shall remain the same, and by this
reference are incorporated herein as though set forth in full here at.
IN WITNESS, WHEREOF, the parties through their duly authorized representatives,
have executed this agreement effective the date first written above.

RE: EXTENSION OF VEHICLE LEASE AGREEMENT
Enclosed for your reference are copies of Council Agenda Bill No. 14,731 and
Resolution No. 98-197. These documents went before the Carlsbad City Council on
June 16,1998, when they were adopted.
Also enclosed is one signed original lease agreement, extending for two additional
years the existing lease of two police vehicles.
