SEGREGATION OF ASSESSMENTS IN ASSESSMENT DISTRICTS
This 34th Pro'ect Task Description and Fee Allotment, is entered into on , pursuant to an Agreement between Galen N. Peterson, Consulting
Engin'eer, ("Contractor") and the City of Carlsbad, ("City") dated December 11 I 2000
(the "Agreement"), the terms of which are incorporated herein by this reference.

1. CONTRACTORS OBLIGATIONS
Contractor shall provide engineering coordination services in accordance with the "Project Engineer's Manual", 2001 edition, as published by the City's Engineering Department, City "Standards for Design & Construction of Public Works Improvements in the City of Carlsbad," and the proposal dated September 22, 2003, ("proposal"),
attached as Appendix "A" for the Consulting Engineering Services, (the "Project").
The Project services shall include, but not be limited to, the engineering services
required to segregate the assessments in Assessment District No. 2002-01 (Poinsettia
Lane East) and/or Assessment District No. 2003-01 (College Boulevard and Cannon
Road East).
2. PROGRESS AND COMPLETION
Contractor's receipt of this Project Task Description and Fee Allotment, signed by the
City Engineer and a Purchase Order from the City's Purchasing Department, constitutes
notification to proceed to the Contractor. Contractor shall begin work within two (2)
working days after receiving this fully executed document and a City Purchase Order.
Contractor shall complete the work by June 30, 2004. Working days are defined in section 6-7.2 "Working Day" of the Standard Specifications for Public Works
Construction (Green Book). In no event shall Contractor work beyond the term or
authorized compensation of the Agreement, as amended by this Project Task
Description and Fee Allotment.
3. FEES TO BE PAID TO THE CONTRACTOR
Contractor's compensation for the Project is shown in Table 1, "Fee Allotment", herein.
Fees shall be paid on the basis of lump sum according to the fee schedule included as
Appendix "A. Progress payments shall be based on the percentage of work completed.
Appendix "A, attached, prepared by Contractor and reviewed by City, shows the parties'
intent as to the elements, scope and extent of the tasks. Contractor acknowledges that performance of any and all tasks by the Contractor constitutes acknowledgment by Contractor that such tasks are those defined in Appendix "A".
Additional task groups, not shown in Table 1 or Appendix "A, will be performed by the Contractor only upon authorization of the City throuqh the mechanism of a separate Proiect Task Description and Fee Allotment and Purchase Order. In the event that City directs Contractor to curtail or eliminate all, or portions of the task groups identified in Table 1 or Appendix A, then the Contractor shall only invoice the City for work actually performed. The maximum total cost of Contractor's services for this Project Task
Description and Fee Allotment is $25,000.00.

PROJECT TASK FOR SEGREGATION OF ASSESSMENTS
At your request, I am pleased to present this proposal to assist the City in the
completion of proceedings for the apportionment of assessments, as required pursuant
to Division 10, Part 10.5, Alternative Procedure for Division of Land and Bond, Street
and Highways Code, State of California, being the “Improvement Bond Act of 1915”.
Enclosed are two exhibits, which provide my scope of services and a fee schedule for
my services. These exhibits are titled as follows:

Scope of Services for Segregation of Assessments

The segregation of assessments is required when a land division occurs and new
assessor parcel numbers are assigned. When such a land division occurs, the City will
verify if an application for segregation has been filed. If an application has been filed,
and authorization is given by the City to proceed, the segregation services will be
provided as follows:

Apportion assessment according to original assessment criteria.
Prepare amended assessment roll.
Prepare amended assessment diagram.
Prepare Notice to Bondholder.
Obtain cover letter and signatures necessary to mail Notice to Bondholder.
Mail Notice to Bond Holder (original bond purchaser), certified, return receipt.
If a request for a public hearing is not made by the bond holder within 14
days of the mailing, file amended assessment roll and diagram with the
Superintendent of Streets of the City of Carlsbad.
Record the amended diagram with the county recorder.
Record the amended roll and amended diagram with the county auditor-
controller.
10. File the completed original application for segregation, amended assessment
roll and assessment diagram, as recorded with the Superintendent of
Streets. File a copy of these documents with the City Clerk if required.

The following proposed fee schedule reflects the lump sum cost of providing
segregation services for each new final map.
Galen N. Peterson, Consulting Engineer shall submit monthly invoices to the City based
on the percent complete. A late payment finance charge will be applied to any unpaid
balance, commencing thirty (30) days after the date of the original invoice, at an interest
rate of ten (IO) percent per annum.
