The Confractor will provide ali equipment, material and labor necessary to install a 3 foot spot repair with laterai reinstatement at 790 Magnolia Avenue between manholes 16A-71 and 16A-87, Includes minor traffic confrol with flagger, one mobilization, one demoblllzatton, bypass pumping as needed, Cosmk; spot repair Installation (E-Glass, UV cure resin, epoxy adhesive, 3.5MM), hydro jet cleaning at repair area, pre & post CCTV video of repaired areas only, lateral reinstatement, permits, excludes major fraffic confrol per ttie Contractor's proposal dated June 13. 2013. and City specifteations, for a sum not to exceed two tfiousand seven hundred fifty dollars ($2,750). This worit Is to be completed within 30 working days after Issuance of a Purchase Order. Attachments: Proposal & Location Map ADPmONAL REQUIREMENTS 1. City of Carisbad Business License 2. The Contractor shall assume the defense of. pay all expenses of defense, and Indemnify and hoki harmless the City, and Its agents, officers and employees, firom all claims, loss, damage, Injury and liability of every kind, nature and descriptton, directly or Indirectiy arising from or In connection witti the performance of ttiis Contract or woric; or from any failure or alleged failure of the contractor to comply witti any appltoable law, rules or regulations Including tttose relating to safety and healtti; except for loss or danr»age whteh was caused solely by the active negligence of ttie City; and from any and ail claims, loss, damage, Injury and liability, howsoever ttie same may be caused, resulting directty or indirectly from the nature of ttie wort< covered by tiiis Contract, unless ttie loss or damage was caused solely by the active negligence of ttie City. The expenses of defense Include ail costs and expenses, including attorney's fees for litigatton, ari^ltration. or other dispute resoiutton method. 3. Contractor shall fumish policies of general liability insurance, automobile liability Insurance and a combined policy of wori<ers compensation and emptoyers liability in an Insurable amount of not less ttian five hundred tiiousand dollars ($500,000) each, unless a lower anrKxint Is approved by ttie Risk Manager or the City Manager. Said polteles shall name ttie City of Carisbad as a co-Insured or additional insured. Insurance Is to be placed with Insurers ttiat have (1) a rating In ttie most recent Best*s Key Rating gukle of at least A-:V. and (2) are admitted and auttiorized to transact ttie business of Insurance In the State of California by ttie Insurance Commissioner. Proof of all such Insurance shall be given by filing certificates of insurance with conttacting department prior to the signing of ttie contract by ttie City. 4. The Contractor shall be aware of and comply wrth all Federal, State. County and City Statues, Ordinances and Regulations, Including Workers Compensation laws (Division 4. Califbmia Labor Code) and ttie "Immigration Refomi and Control Act of 1986" (8USC, Sections 1101 ttirough 1525). to include but not limited to, verifying ttie ellglbllrty for employment of all agents, emptoyees. subcontractors and consultants ttiat are Included In this Contract. 5. The Contractor may be subject to civil penalties fbr ttie filing of false claims as set forth In ttie Califbmia False Claims Act.
