HomeMy WebLinkAboutSan Diego Association of Governments - SANDAG MOU; 2016-02-22;MEMORANDUM OF UNDERSTANDING BETWEEN THE SAN DIEGO ASSOCIATION OF GOVERNMENTS AND THE CITY OF CARLSBAD REGARDING PREPARATION OF AN ECONOMIC ANALYSIS OF NORTH COUNTY TRANSIT DISTRICT DOUBLE TRACKING THROUGH CARLSBAD VILLAGE AGREEMENT NO. 5004797 This Memorandum of Understanding {"MOU") is made and entered into effective as of this 22"d day of February, 2016, by and between the San Diego Association of Governments ("SANDAG"), and the City of Carlsbad {"Carlsbad"). RECITALS WHEREAS, the Los Angeles-San Diego-San Luis Obispo (LOSSAN) Rail Corridor has served the region for over 130 years as a single track corridor; WHEREAS, the LOSSAN corridor will be transitioning to a double track rail corridor in the near future to address growing regional transportation needs; WHEREAS, the Los Angeles-San Diego Proposed Rail Corridor Improvement Studies Program Environmental Impact Report/Environmental Impact Statement includes rail improvement preferred alternatives for constructing double track in Carlsbad as either at grade or as grade separated in a trench; WHEREAS, Carlsbad desires that a comparison of the alternatives include a robust analysis of the economic benefits and impacts of the two preferred alternatives; WHEREAS, SANDAG has a transportation and economic analysis firm on call that is able and willing to provide the requested services; WHEREAS, Carlsbad is willing to reimburse SANDAG for the enhanced economic analysis; and WHEREAS, the parties wish to memorialize their agreement in this MOU to carry out the purposes set forth above. AGREEMENT NOW THEREFORE, in consideration of the mutual promises set forth herein, the parties agree as follows: SANDAG Agrees: 1. To execute a task order with Kimley, Horn and Associates (KHA) to perform transportation and economic analysis in general accordance with Attachment A, Task Order for Carlsbad Village Economic Study Assessing LOSSAN Rail Corridor Improvements Options ("Task Order"). The contract amount will not exceed the total cost stated in Attachment A without the written approval of the Carlsbad City Council. 2. To give Carlsbad full access to, and opportunity to provide comments on, all KHA work, including working documents. 3. Neither Carlsbad nor any officer thereof is responsible for any damage or liability occurring by reason of anything done· or omitted to be done by SANDAG under or in connection with any work, authority, or jurisdiction delegated to SANDAG under this MOU. It is understood and agreed that, pursuant to Government Code Section 895.4, SANDAG shall fully defend, indemnify, and save harmless Carlsbad, all officers and employees from all claims, suits or actions of every name, kind and description brought for or on account of injury (as defined in Government Code Section 810.8) occurring by reason of anything done or omitted to be done by SANDAG under or in connection with any work, authority, or jurisdiction delegated to SANDAG under this MOU. Carlsbad Agrees: 1. To reimburse SANDAG in an amount not to exceed $99,955.05 for all direct expenses from KHA, in general accordance with the attached Task Order (Attachment A), within 30 days of submittal to Carlsbad. 2. Neither SANDAG nor any officer thereof is responsible for any damage or liability occurring by reason of anything done or omitted to be done by Carlsbad under or in connection with any work, authority or jurisdiction delegated to Carlsbad under this MOU. It is understood and agreed that, pursuant to Government Code Section 895.4, Carlsbad shall fully defend, indemnify, and save harmless SANDAG, all officers and employees from all claims, suits or actions of every name, kind, and description brought for or on account of injury (as defined in Government Code Section 810.8) occurring by reason of anything done or omitted to be done by Carlsbad under or in connection with any work, authority or jurisdiction delegated to Carlsbad under this MOU. THE PARTIES MUTUALLY AGREE: 1. That all obligations of SANDAG under the terms of this MOU are subject to the appropriation of the required resources by SANDAG and the approval of the SANDAG Board of Directors. 2. Any notice required or permitted under this MOU may be personally served on the other party, by the party giving notice, or may be served by certified mail, return-receipt-requested, to the following addresses: For SANDAG: 401 B Street, Suite 800 San Diego, CA 92101 Attn: Linda Culp For Carlsbad: 1635 Faraday Avenue Carlsbad, CA 92008 Attn: Glen K. Van Peski 3. That unless it is amended by the parties in writing, this MOU shall terminate on December 31, 2016, or on such earlier or later date as the parties may agree to in writing. Or This MOU shall continue in effect unless and until a party to the MOU gives 60 days written notice of its desire to withdraw from the MOU. If such notice is given, the MOU shall continue to be binding on those parties who have not formally withdrawn. 4. The indemnification provisions of this MOU shall survive termination of the MOU. 2 AnACHMENTA TASK ORDER FOR CARLSBAD VILLAGE ECONOMIC STUDY ASSESSING LOSSAN RAIL CORRIDOR IMPROVEMENTS OPTIONS See Next Page 4 Exhibits: 18l5cope of Work (Exhibit A) ~Payments (Exhibit B) ~Schedule (Exhibit C) 2 EXHIBIT A SCOPE OF WORK ECONOMIC STUDY ASSESSING LOSSAN RAIL CORRIDOR IMPROVEMENT OPTIONS PROJECT UNDERSTANDING Kimley-Horn & Associates (Kimley-Horn), Rosenow Spevacek Group, Inc. (RSG), and dBF Associates, Inc. (dBFA) (the "Consultant Team") will prepare an Economic Study to analyze the potential economic and financial impacts of railroad improvement alternatives for the Los Angeles-San Diego-San Luis Obispo (LOSSAN) rail corridor under the following three (3) alternatives: 1. At-grade double tracking from the Buena Vista Lagoon railroad bridge south to connect to existing double track just south of Carlsbad Village Drive. 2. Short trench beginning at the Carlsbad Boulevard/Highway 101 overpass south to end north of Tamarack Avenue. 3. Long trench beginning at the Carlsbad Boulevard/Highway 101overpass south to end just north of the Agua Hacienda Lagoon railroad bridge. The Consultant Team will prepare the Economic Study that would address four (4) principal types of impacts to the extent appropriate: 1. Impacts of noise and vibration on property values, particularly for residential and hospitality properties. 2. Impacts of increased connectivity between residential neighborhoods east of the tracks and the beach to the west. 3. Impacts of increased traffic congestion, particularly for commercial businesses. 4. Impacts resulting from the anticipated displacement of existing private development under each of the three (3) rail improvement options. 3 SCOPE OF SERVICES The scope of work shall consist of the following tasks and deliverables by the Consultant Team: TASK 1. PROJECT MANAGEMENT Task 1.1 Task Management RSG will supervise and coordinate the work of the Consultant Team and prepare and circulate monthly progress reports, correspondence and memos, as appropriate. Kimley-Horn will submit progress reports and invoices for the Consultant Team. Task 1.2 Meetings The Consultant Team will attend up to six (6) meetings with SANDAG, NCTD, and City staff on project details, including project initiation/kickoff and review of the Draft Economic Study. RSG will also provide summary minutes from each meeting. Task 1.3 Quality Assurance/Quality Control RSG will perform appropriate quality assurance and quality control on draft and final documents. Deliverables: 1. Monthly progress reports and invoices. 2. Project meeting minutes and materials. TASK 2. ECONOMIC STUDY RSG will complete an Economic Study of the three (3) rail improvement options for the project area defined as from the Buena Vista Lagoon to the north to Agua Hacienda Lagoon to the south along the LOSSAN rail corridor. The Study will not address capital and operating costs for the proposed rail infrastructure and future operations. It is expected that these factors will be incorporated into the Carlsbad Railroad Trench Feasibility Analysis, a separate but coordinated effort underway by SANDAG concurrent to this Study. The areas of study will include an assessment of economic impacts within the proposed project area. Appropriate study areas will be defined for the corridor as a whole, as well as smaller sub-areas surrounding each at-grade crossing. These study areas will be determined after project initiation, field reconnaissance, and discussions with SANDAG, NCTD, and the City. It is the intent that certain economic impacts are studied at the larger corridor level and others will be evaluated at the smaller sub-area level. RSG will prepare a preliminary matrix evaluation of potential economic impacts, the types of properties affected, and the most appropriate market and economic factors to be used to gauge these impacts. The following describes the various market and economic factors that will potentially be addressed in the study. However, a final determination regarding the major economic impacts, 4 the appropriate study areas, and optimal market and economic factors to be evaluated will be made after project initiation. RSG staff will conduct research on each of the items below and provide a professional opinion and comparison of the three (3) project options' effects on all relevant properties. 1. Property Values. In the real estate market for both residential and commercial, it is generally assumed that there is a diminution of value for noise, traffic, and circulation impacts. It is generally assumed that an increase in value will happen if existing noise, traffic, and circulation impacts are improved. The Village and Barrio Master Plan will be incorporated into this analysis. 2. Commercial Rental/Lease Rates and Job Creation/Loss. Commercial real estate has high variability based on what a property can lease for in the marketplace. Access and circulation to and from commercial properties is one of the main determinants of a property's value. The overall conditions, aesthetics, and desirability of an area are also major contributors to valuation. The Village and Barrio Master Plan will be incorporated into this analysis. 3. Sales Tax Generation and Land Use. Retail areas and the related land uses of an area with multiple rail lines at grade can be compared with retail areas and the related land uses of an area that has been grade-separated. 4. Transient Occupancy Tax (TOT). Visitor-serving properties and room rates in the City vary greatly. Noise and traffic impacts, as well as aesthetics and desirability of an area, can determine if a room rate is high or low. Carlsbad has a high degree of visitor-serving properties varying from large hotels to short-term vacation rental properties within close proximity of the rail corridor. Based on these areas of study, the Economic Study will include these Sub Tasks: Task 2,1. Industry Research RSG will review industry literature on the impacts of rail corridors (with specific emphasis on the three (3) options) and, to the extent possible, identify and profile relevant case studies where the impacts of at-grade versus grade-separated rail segments can be approximated. Case studies could include the impact experienced from the trenching of the rail corridor through the central portion of Solana Beach. This research will likely yield a qualitative measure of potential impacts, rather than specific quantification. Based on this initial research, RSG will formulate and propose a methodology to determine the probable economic impacts of the three (3) railroad alternatives. Task 2,2 Existing Conditions 1. RSG Tasks RSG will review existing conditions in the study area including the following: • Land use inventory and mix • Assessed value of properties 5 • Annual turnover • Building permits activity • Employment • Property tax • Retail sales tax • TOT • Business license revenues • Livability/walkability factors • Public safety/emergency response To the extent available, each of these indices will be profiled for each identified study area, with the most comprehensive review focused on Carlsbad Village. RSG will work with Kimley-Horn and the City to obtain projections of train volumes and traffic delays. 2. Kimley-Horn Tasks Kimley-Horn will provide RSG with levels of service and cumulative traffic delay times for each railroad crossing for each option. Additionally, Kimley-Horn will work with the City and SANDAG to review recent analyses conducted by the City in support of the Carlsbad Village/Barrio Master Plan, if available. Kimley-Horn will review available data on existing and proposed train volumes and associated traffic delays, and compile additional projections as needed. It is anticipated that there will be 24-hour traffic counts collected at three (3) at-grade crossings of the corridor. Two new roadway connections may be proposed as part of the improvements at Oak Avenue and Chestnut Avenue. Kimley-Horn will coordinate with RSG to develop traffic data requirements for the economic analysis. The specific tasks undertaken by Kim ley-Horn to accomplish the above include: Data Collection • Conduct three roadway volume counts (tube) conducted for each direction of travel for a one-week period. • Work with the City, SANDAG, NCTD to obtain: • Existing train frequency, schedules and typical gate down times for various types of train service (freight, Coaster Rail, Amtrak Rail). • Projected future train frequencies by type of train service. Data Analysis The following scenarios will be computed and compared: • Existing conditions (traffic volumes and train frequencies) with at-grade crossings. • Existing conditions with grade separated crossings. 6 • Future 2035 conditions (traffic volumes and train frequencies) with at-grade crossings. • Future 2035 conditions with grade separated crossings for short trench and long trench options. Develop a Spreadsheet Tool The spreadsheet tool will: • Compute vehicular delays for three (3) streets with existing at-grade crossings using train frequency schedules, gate down times, and traffic volume counts. • Distribute traffic by hour of the day and use random arrival estimation techniques to develop vehicular queues and delays related to anticipate rail service. Queues and delays will be estimated for each hour of a typical weekday, a Saturday and a Sunday. The typical I weekday delays would be multiplied by five (5) and then added to the Saturday and Sunday delays to obtain total delays at each of the crossings and total delays at all crossings. • Results will be compared to grade separated options. 3. dBFA Tasks dBFA will prepare an evaluation of noise and vibration factors of the LOSSAN Corridor Improvement Project within the City of Carlsbad from the Buena Vista Lagoon to the Agua Hacienda Lagoon to support the economic analysis. This evaluation will include the following tasks: • A site reconnaissance will be conducted • Three railroad configuration options with varying grade-separation characteristics will be assessed. Field data will be gathered from proto-typical examples of each option, preferably from local sites. • For each option, noise and/or vibration level increases and/or decreases at residential and hospitality land uses along the corridor will be aggregated from a focused review of the PEl RIElS. The variations between the short-trench and long- trench options will be interpolated from the PEl RIElS data. Task 2.3 Comparable Analysis 1. RSG Tasks RSG will attempt to profile and evaluate comparable at-grade versus grade-separated situations where real estate and economic development factors can be measured and compared. This task may include the following: • Research in various submarkets throughout Southern California. • Interviews with real estate appraisers. • Collection and review of empirical statistics such as property values, building 7 permits, and retail sales volumes. The purpose of this task is to hypothesize a quantitative measure of the relative impact on the project area resulting from an at-grade versus grade-separated rail segment. This task may also address potential value enhancements resulting from improved access across the rail corridor to the beach. Consideration will be given to the new Village and Barrio Master Plan. 2. Kimley-Horn Tasks Prepare a Technical Memorandum The analysis and methodology utilized will be presented in a memorandum containing a matrix that compares the results of the three scenarios evaluated. Task 2.4 Construction Impacts RSG will prepare a qualitative assessment of the potential economic impacts resulting from construction of the three (3) options. Key factors will be identified through discussions with Kim ley-Horn, the City, SANDAG, and NCTD and are likely to include the following: • Duration of construction • Temporary and permanent displacement • Utility relocations • Potential impacts to rail operations Information regarding the proposed construction impacts (e.g. road and lane closures, detours, temporary or permanent construct ion easements, etc.) will be provided from the concurrent work on the Carlsbad Railroad Trench Feasibility Analysis. RSG will prepare a matrix evaluation of each option describing the types of construction impacts anticipated and will prepare generalized estimates of the magnitude of economic impacts on study area businesses resulting from construction of each option, taking into account future land use development/redevelopment based on the new Village and Barrio Master Plan. Task 2.5 Projection of Economic Impacts Based on the foregoing research tasks, RSG will prepare order-of-magnitude estimates of key economic impacts for the three (3) options that will include employment, payroll, and tax revenues for each identified study area. All figures will be expressed in terms of annual impacts (in 2015 dollars) after completion and stabilization of the completed rail corridor improvements. By comparison of the economic impact projections, RSG will highlight the potential economic impact of each option and compare those impacts to recent cost estimates provided by SANDAG. Task 2.6 Reporting RSG will provide a Final Report that incorporates information and analysis results from the previous tasks.
