This Agreemnt, made and entered into this first day of July, 1988, by andbetweenthe CITY OF CARISEAD, hereinafter referredto as "the CityVV, and the CXXTNTYOFSAND~, hereinafterreferredtoas Vounty~~.
WITNESSETH
WHEREAS, theCcuntyisauthorizedtore&re innlates/wards to perform wcrk under Sections 1203.1, 4017 and 4014.2 of && Rmal Code, Sections 25359 and 36904 of the Gcv erxment Code, and Sections 730, 731, 731.5 and 883 of the Welfare and Institutions Code.
WHEREAS, thecityhas responsibility for the operation ard maintenance of -,F-~apenspace areastidesirestocontractwiththeCountyfor thesupplyingofcertainservices;
NOW, THEREFORE, it is mutually agreed as follows:
1. UponreguestoftheCityandattimsthataren&uallyagreeable totheCityandcounty,coUntyshallsupplythehereinafterdescribed~rk crews toperfonnwork forthecity. IheCityanticipatesthatthework will consist primarily of cleaning trash and weeds frm along roadway, maintenanceofparksandapenspaceareasaradgeneralclean-up.
2. The City agrees tc reimburse County for administrative costs incurredinthe amount of $260 a day for each full crew. Afullcrewis designatedat ormorepersons for8hours.
3. TheCity shall be responsibletothe extentprcvidedbylaw for injuryto irmratesorpublicsewice~r~orcounty~layeescausedby intentional actsornegligenceoftheCity~spersonnelorbydangerouscondi- tioris on the City's pm. The Cit-- shall hold County hamless from liability or damages resulting fmpropertydamage orpersonal injury to any personcausedby said intentional acts, negligence ordangercus conditions.
4. Coun.t3yshallberesponsibletotheextentprovidedbylaw for propertydamageor injurytctheCityts qloyees ormembers ofthegeneral public who are utilizing the City's facilities when such damage or injury is causedbythe intentionalactsornegligenceof inmates 0rCcuntymployeesor public serviceworkers. County shall hold the City harmless from liability or damagesrefllltingframprapertydamageorpersonalinjurytoanypersoncaused by said intentional acts or negligence.

5. TheCity shallprc~videaleadpersontodesignatewlorksites, give directionsastoworkperformance andprovideassistanceandentrytothe grounds for the imatecrewandAdult Institutions crew supervisors.
6. ~~shallprwide~~laborframthe~~onDeparbnentts Adult Institutions or the Public Service Fmgram in a manageable crew size. AdultInstitutionst staff shallberesponsible fortheactual anddirect supervisionand security of inmatesorpublicserviceworkers incarryingout theworkinstructions.
7. Inprcnridingfllcht~r>rkcrews,caurrtyshallplrlcwideandbe responsible for the following:
a. Pmvidethepmpermmberofstafftoacccmpaqand supervise tites.
b. Have full responsibility for the custody and supervision oftheworkcrew.
C. pravide necessarytransportation.
8. 'Ihe-w recognizesnoworkments coqensatim liability for in- mates/wardswho arenotinvolved in firesuppressionactivities.
9. Allworktobeperformdwillbeof suchnatureas tonot supplant workperfornmdbyregularenqloyees ofthecity.
10. County shall invoicetheCityonamonthlybasis foranyreimbuxse- mentdueuMerthetennsofthisAgmemmt.
11. The City will notify County at least two weeks in advancewhenwork crews areneeded, andCountywillscheduleworkcrews onanas available basis.
12. This agreement shall become effective July 1, 1988, and shall remain in effect until amended bymt=al consentofthepartieshereto or terminated by either of the parties by giving fifteen (15) days notice in writing.
IN WITNESS WHEEBIF, the duly authorized officials of the parties hereunto have, intheirrepresentativecapacities, settheirhands as ofthedate first hereinabovewritten.

Re: Increase in Cost-Recovery Crew Fees
Dear Mr. Frank Mannen:
The Probation Department is not allowed to make a profit from the labors of individuals assigned by the courts. There is, however, an expense incurred by this department to administer, assemble, equip, transport, supervise, and insure our Work Crews.
Periodically it is necessary for us to review these expenses, to insure that we are in fact passing on the appropriate costs to those non-county government agencies, or functions utilizing our crews.
It has been four years since the last review resulted in our current fee schedule. Over that period expenses have increased, and at present we are under charging for crew services.
Effective with the work day of Monday, July 1, 1991, the fees charged to user agencies will be increased to recover our current expenses of $310.00 per crew day.
It will not be necessary to execute a new contract between our agencies to reflect this change. There may, however, be some internal changes you wish to consider in your administration, scheduling, and expensing processes. Crew services requested, and utilized after the effective date will be invoiced and billed at the new rate.
