Box 265 Carlsbad, California Attention: Mr. John Slater City Manager Gentlemen: This letter is written in reference to the City of Carlsbad's request to erect a 10-foot by 40-foot "Welcome to Carlsbad0 advertisement sign on property owned by the San Diego Gas & Electric Company located last of Highway 101 and North of Cannon Overpass. The location of the proposed signboard is more particularly shown on the drawing labeled Exhibit "A," attached hereto and by this reference made a part hereof. Upon considering your request, please be advised that the San Diego Gas & Electric Company hereby grants to the City of Carlsbad revocable permission to use the area shown upon Exhibit "A" for the location of a signboard only; subject, however, to the following terms and conditions: 1. That the area to be occupied by the signboard will be 30 feet in width and 50 feet in length and will b e located by the San Diego Gas & Electric Company upon request of the City of Carlsbad. 2. That no other structure will be permitted on the San Diego Gas & Electric Company property either on a permanent or a temporary basis. 3. That the City of Carlsbad will keep the land occupied by the signboard free from liens of labor and materialman, and will commit or suffer no waste thereon. 4. That the City of Carlsbad, its successors or assigns, agree to assume all risks incidental to the use of the property and to hold the San Diego Gas & Electric Company, its officers, agents and employees, harmless from and indemnified against any loss, damage, or expense resulting from injury to person or persons or loss of property caused in any manner by the construction and maintenance of said signboard, or caused in any manner by the San Diego Gas & Electric Company, its officers, agents and employees in the use of the said property. c City of Carlsbad Page 2 May 18, 1961 5. Tkat this letter of permit shall be revocable upon 30- days written notice by either party. 6. Permission is granted hereunder conditional upon the right of the San Diego Gas & Electric Company to commence or resume the use of the property hereinabove referred to whenever in the interest of its service to its patrons or consumers it shall appear necessary or desirable t© do s© as provided by General Order No. 69 of the Public Utilities Commission of the State of California, dated and effected November 1, 1923, which General Order No. 69 by this reference is hereby incorporated herein and made a part hereof. It is requested that you acknowledge your acceptance of the above conditions numbered one (1) through six (6) by signing the enclosed copy and returning same to the undersigned.
