HomeMy WebLinkAboutSan Diego, County of; 1988-08-15;1 e CO dbb, RaTIVE AGREEMENT BETWEEN .- -a* THE REDEVELOPMENT AGENCY OF THE CITY OF CARLSBAD AND THE COUNTY Ol SAN DIEGO REGARDING THE MOBILEHOHE OCCUPANT ASSISTANCE PROGRAM I. THIS COOPERATIVE AGREEMENT is hereby made and entered into as of August , 1988, by and between the REDEVELOPMENT AGENCY OF THE CITY OF CARLSBAD (the "Agency"), and the COUNTY OF SAN DIEGO, a legal subdivision and body corporate and politic of the State of California (the "County") - W I T N E S S E T 11: WHEREAS, the County has established the Mobilehome Occupant Assistance Program (the "MOAP Program") to fund loans to reduce the monthly housing costs for low income residents in mobilehome parks purchased by the residents; and WHEREAS, the Agency has received a request for financial assistance from a mobilehome park in the City of Carlsbad desiring to convert to resident ownership; and WHEREAS, the Agency has approved t'ne use ef tax increment redevelopment funds specifically designated to provide housing assistance for low and moderate income households as a source of financial assistance for eligible mobilehome parks wishing to convert from rental to resident ownership within the City's jurisdiction; and WHEREAS, the Agency desires to adopt and use the County's Mobilehome Occupant Assistance Program as the vehicle for technical servicns in connection with financial assistance to mobilehome parks within the City of Carlsbad; and WHEREAS, the County has successfully operated the MOAP program and desires to provide such mr>hilehorne park tschnical serqices and implementation of MOAP Program guidelines as may be required by the Agency. NOW, THEREFORE, BE IT RESOLVED, as follows: 1. WORK TO RE PERFORMED: County agrees to provide technical services and to implement the Mobilehome Occupant Assistance Program as may be required by the Agency. The scope of such services, including both the development and ongoing implementation of MOAP, is described in Attachment A to this Agreement, and is incorporated herein by reference. 2. COMPENSATION: For the implementation of the Agency's MOAP program, County shall be paid by the Agency for its proportionate share of the total administrative costs, an estimate of which is computed as follows: JL 'b&d *AT LLe &.A+%, -4 "%? Costs $8,480 City Share $3,547 The estimated total administrative costs is based on 191.5 hours of base salary at the Housing Program Analyst level plus benefits and administrative overhead, 45 hours of base salary at the Housing Manager level plus benefits and administrative overhead, and 101 hours of base salary at the Housing Aid level plus benefits and administrative overhead. 3. TERM: The Term of this Agreement will be a period of one year, with automatic renewal, unless either party desires termination. Agency or the County nay terminate this Agreement at any time by giving the other party written notification at least thirty (30) days in advance of said termination date. 4. AMENDMENTS: This Agreement may be modified or amended only upon the written approval of the County and the Agency. 5. CONTRACT ADMINISTRATION: The Director, Department of Housing and Corrmunity Development shall adninister this agreement on behalf of the County. The Executive Director, Redevelopment Agency of the City of Carlsbad shall administer this Agreement on behalf of the Agency. 6. RECORDS AND REPORTS: All records of the County respecting the provided assistance shall be made available to the Agency. 7. INDEMNIFICATION: To the extent authorized by law, each party shall at all times indemnify and save harmless the other party against and pzy in full any and all loss, damage or expense that the other party nay sustain, incur, c.r become liable for resulting in any manner from, or connected with, the implementation of the Agreement, including any loss, damage or expense arisicg out of, loss of, or damage to property and injury to or death of persons excepting any lcss, damage or expense and claims for loss, damage or expense resulting in any manner from the negligent act or acts of the other party, its contractors, offices, agents, or employees. 8. NOTICE: Any notice or notices required or permitted to be given pursuant to this Agreement may be personally served on the other party by the party giving such notice or may be served by certified maiL. The Agency will adopt the County's MOAP Program as the basis for providing financial assistance for low income households in mobilehome parks converting to resident ownership. IMPLEMENTATION 11. ONGOING IMPLEMENTATION OF EOAP A. ELIGIBILITY FOR AGENCY MOAP PROGRAM 1. Screen for eligibility. a- Mail appointment letters- b- Meet with referred residents. c. Collect required verifications. Analyze financial assistance based on number and income of eligible low income residents. Prepare recommendation of appropriate City MOAP funding level - 2. 3. B. PERMANENT FINANCING 1. Meet with individual residents to coordinate all funding Coordinate with all private and gGvernmenta1 financing sources. 2. 3. Coordinate with otner igvolved parties (title ccmpany; escrow, park officers, eligible residents). 4. Cause to collect required registrations and title certificates from eligible residents. 5. Prepare Documents (Escrow instructions, Trust Deeds, Security Agreements, Promissory Notes, Truth-in-Lending Disclosures) - C- LOAN FILES 1. Pr&pare individual loan files and return to Agency for servicing of loans.
