Agricultural Conversion Mitigation Fee Balance
The current balance within the Agricultural Conversion Mitigation Fee account as of
August 18, 2008 was $5,967.511.59. Of that balance, approximately $5,256,5761 has
been encumbered due to City Council approval of projects for which grant funding has
been awarded, but has yet to be distributed for project implementation. In consideration
of both the current Agricultural Conversion Mitigation Fee balance and funds
encumbered/earmarked for use, staff estimates current funding available for additional
agricultural conversion mitigation projects at approximately $701,936.
Potential Fund Accrual and Augmentation:
Augmentation of the fund balance may take place due to two factors. First, the fund
balance may grow through the accrual of interest income which is likely to build at
unpredictable increments. During Fiscal Year 2007/2008, the account balance averaged
approximately $6 million and accrued $281,424.07 in interest income. Although it is
possible to report on interest income gained to date, staff is unable to forecast future
interest income because of the flexible nature of the fund balance. As disbursement of
previously encumbered funding is distributed to grantees of approved projects, the fund
balance will decrease, thereby reducing the accrual of interest income. Second, as
remaining coastal agricultural lands are developed with urban uses, mitigation fees are
collected for inclusion in the Agricultural Conversion Mitigation Fee fund. In return,
increases in fund balance result in proportional increases in future interest income.
Conversion of Agricultural Land and Fund Projection:
Of the approximate 957 acres of coastal agricultural land that is subject to the
Agricultural Conversion Mitigation Program, roughly 740 acres (or 77%) has already
been converted to urban uses and has either paid the conversion mitigation fee or
otherwise mitigated2• Of the 957 acres, the remaining 217 acres of land (or 23%) has

continued or renewed agriculture use is infeasible.
not converted to urban use and therefore has not been subject to payment of the
Agricultural Conversion Mitigation Fee or other mitigation. Exhibit 1 (appended
herewith) includes a map depicting those lands that have converted to urban uses--and
mitigated or paid the fee--as well as those lands that have not yet converted to urban
uses.
Fund Projection Estimates:
If the remaining 217 acres of land that is subject to the agricultural conversion program
were capable of fully developing with urban uses, then the Agricultural Conversion
Mitigation Fee fund would have the potential to increase by an additional $2,140,000.
The fund, however, is incapable of increasing by this amount in mitigatio.n fee collection
alone due to considerations that limit complete conversion of these properties to urban
uses. More specifically, since portions of these lands are constrained by such factors as
utility easements, right-of-way easements, slopes in excess of 40% and waterways, said
portions are precluded from fully converting to urban use and consequently will not be
subject to the Agricultural Conversion Mitigation Fee. Of the 217 acres, at least 21 acres
of land (or 10%) are identified as fully constrained and will not be subject to the fee.
Provided that all remaining portions of property (196 acres) are converted to urban uses,
the fund would increase by an additional $1.9 million. This however, is also unlikely
given the presence of other factors that will presumably preclude full conversion of the
remaining land. For example, unquantifiable factors such as the presence of sensitive or
significant resources onsite that may require permanent preservation, further preclude
development; and in turn, limit augmentation of the fund. Additionally, specific properties
identified as coastal agricultural lands may be precluded from developing with urban
uses due to planning and/or acquisition efforts currently being pursued by the state and
City. Examples of such properties include areas referred to as the Mitsuuchi property
and Proposition D. Lands as indicated in Exhibit 2.
Staff estimates that a conservative approach in consideration of constraints that are yet
to be realized might more reasonably result in approximately $1 -$1.5 million that would
enter the fund before coastal agricultural lands are fully converted to urban uses. In
consideration of such constraints, staff estimates that provided no immediate
encumbrances are established, the unencumbered balance within the Agricultural
Conversion Mitigation Fee fund may have potential to increase to approximately $1. 7 -
$2.2 million, notwithstanding additional potential for augmentation due to interest
income.
