Da t:e: April 2, 1970 Cit:y Manager's Recommendation I recommend the passage of subject Resolution, Council Action Res. #1713 was adopted affirming City 1 s policy regarding occupancy of houses in subdivisions, prior to complettion of public improvements; Agenda Bill #116 adopted. -2- I ' l • :' ,, .d March 17, 1970 TO: CITY COUNCIL F£!')M: ACTING CITY MANAGER SUBJECT: Initial Occupancy of Houses in New Subdivisions RECOMMENDATION: Adopt a motion approving the present administrative policy regarding occupancy in new ~ubdivisions as the Official City Policy. DISCUSSION: The City h9s recently received several requests to permit occupancy of homes in new subdivisions prior to completion of public improvements. In order to clarify the City's position, it appears that a statement of policy by the City Council would be in order. The administrative policy at present is not to allow occupancy until: l. The house has been completed and approved by the Building Departme.-nt, 2. 3. The permanent sewer and water systems serving the house have been completed and have passed the required acceptance tests, and The streets connecting the particular house with a street outside the subdivision have been paved. This policy was developed after discussion with developers concerning the practical considerations of heavy construction in an inhabited area and upon the advice of the City Attorney regarding City liability in case of accident or fire. The policy is essentially identical to that followed by the City of Oceanside which has found it to be reasonable and prudent. Resp:c~f~ubmitted, I~~ ,✓ -WINDER F. The City Council of the City of Carlsbad does rezolve as follows: 1. No OCLUpancy of houses in new subdivisions shall be 5 6 7 8 9 allowed until all of the following conditJons have been met: 10. ll 12 13 14 15 (a) The houses have been completed and approved by the Building Departcient. (b) The permanent sewer and water systems serving the house have been complete<! and have passed the required· acceptance tests.
