A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD GRANTING AN APPEAL OF THE DECISION OF THE PLANNING COMMISSION USE PERMIT TO ALLOW CONSTRUCTION OF A MOBILE HOME PARK. REGARDING A PRE-ANNEXATION CONDITIONAL The City Council of the City of Carlsbad does hereby resolve 6 7 8 9 as follows: 1. Appellant MACCO CORPORATION appealed to the City Council .? the action of the Planning Commission regarding their herein loil mentioned application - Planning Commission Resolution No. 659. 2. A11 steps required by law in connection with said 13. application and appeal have been complied with. /I 14 15 3. Said appeal and application are granted and the following action in regard thereto is taken: Pre-Annexation Conditional Use Permit was granted to allow construction of a Mobile Homes Park. 4. In the opinion of the City Council the following facts I 17(i and reasons make the granting of said application necessary to 181/ carry out the general purpose of Ordinance No. 9060 as amended: (a) It will conform to the General Plan of the City. 30 31 32 5. Said action regarding said application is made subject to the following conditions and limitations: A. That the dwelling units not exceed 359, nor the density exceed 6.9 dwelling units per acre. B. That subject mobile homes park be developed in confor- mance with Exhibit A, dated $!arch 4, 1970, submitted as the developer's job No. 17. C. D. That those areas shown in GREEN on Exhibit A be function2 usable, open space areas, and be planted and maintained with combinations of trees, shrubs and groundcovers in conformance with a landscape and sprinkler plan to be approved by the City of Carlsbad P1 anni ng Department, prior to issuance of Permit. a Bui 1 ding E. That subject mobile homes park be developed in con- formance with the State of California Administrative Code, Title 25 Housing and Community Development, Chapter 25, Mibile Homes Parks. F. That the Conditional Use Permit approval is subject to annexation to the City of become void if substantia year after its granting. That a grading plan be submitted to the City Engineer and P1 anni ng Department for review and approval, prior to the issuance of any Bui 1 ding Permit. L. That all water, sewer and drainage facilities be construc ed in accordance with City Standard Design Criteria and, as approved the City Engineer. That sewer service shall be provided by the City of Carlsbad and that all trunk lines be constructed to ultimate size by the developer. Trunk lines shall be extended to the Southerly and Easterly exterior boundaries of the development, and the location of all trunk lines shall be subject to the approval of the City Engineer. -7 0. That the final alignments and construction details of a11 interior streets and Louder Lane shall be subject to approval of the Engineering Department. P. That Lowder Lane shall be dedicated as a public street and fully improved as a full-width street (84 ft. right-of-way maximum), between the Southerly boundary of Phase 1 of the proposed mobile homes park and the existing improved section of Lowder Lanes Northerly of the proposed park; 'chis shall be done prior to the issuance of an "Authorization to Occupy" any unit. 4. That portion adjacent to Phase 11 of proposed mobile homes park, shall be constructed at such time as the City Engineer determines the street is needed for traffic. 2.
