Statement of the Matter
The attached exhibits are self-explanatory of the proposed amendment
to the P-C Zone, involving two items, i.e., permitted uses, and off-
street parking requirements.

2-2-71; The public hearing was continued at the request of Cmn. Lewis
for further investigation and contact with citizens directly
affected by the proposed change.
2-16-71 Res. #1823 was adopted, making findings and concurring with the
Planning Commission to amend Article 13.75, Section 1375 and 1377
• of Ordinance 9060. A first reading was given Ord. #9262, amending
Article 13.75, Sections 1375 and 1377 of Ordinance 9060 re:
Planned Community Zone.
Cmn. Lewis and City Manager tov/work out Council Policy Statement
for the Council's consideration regarding procedure for notify-
ing interested citizens on any major changes to City Ordinances.

SUBJECT: Proposed Amendment to P-C(Planned Community) Zone,
Ordinance No.9060, Article 13.75, Section 1375 - Item
b. and Section 1377 - Item c
Reference: Attached copy of Resolution of Intention No. 76
In working with developers in the preparation of Specific
Plans for areas in the City already zoned P-C(Planned Community)
Zone, it has become obvious that certain changes within this
ordinance would be appropriate. The suggested changes and the
reasons therefore are as follows:
1. Article 13.75, Section 1375, Item
Commercial uses in the P-C Zone;
b pertaining to allowed
Change "Uses permitted in C-l Zone, provided such uses
are established to provide a service primarily for
residents of the P-C Zone." - to "Uses permitted in C-2
Zone, provided such uses are established to provide a
service primarily for residents of the P-C Zone."
Reasons for Change:
A. Will add more flexibility to P-C Zone; Example: Cocktail
Lounges - even if developed in conjunction with a golf
course clubhouse cannot be permitted in a C-l Zone.
B. Planning Commission and City Council do not lose control
of Commercial uses permitted, inasmuch as Item c, Section
13.79 requires that economic justification of all
commercial use be included as part of the master plan
submittal.
2. Section 1377, Article 13.75, Item c pertaining to parking
requirements in the P-C Zone:
Change "Parking as follows: 1. There shall be at least two(2)
offstreet parking spaces for each dwelling unit." - to "Parking
as follows: 1. Required offstreet parking per unit shall be
as follows:

Reasons for Change:
A. The proposed schedule of parking is more realistic,
inasmuch as it keys to a bedroom count which normally
relates more closely to numbers of people, family types,
and cars.
B. The existing requirement is leading to excessive use of
"blacktop" grading and loss of greenery in higher density
areas which normally have smaller bedroom and family size
counts .
The suggested revisions will provide for more flexibility
within in the P-C Zone without the loss of land use control and,
will correct deficiences in the existing ordinance which have been
discovered through it's utilization.
Planning Commission Resolution of Intention No. 76 is provided
for your consideration.

A RESOLUTION RECOMMENDING TO THE CITY COUNCIL OF THE
CITY OF CARLSBAD AN AMENDMENT TO ARTICLE 13.75 OF

2 WHEREAS, pursuant to the provisions of Ordinance ffo. 9060,
5 the Planning Commission of the City of Carlsbad did on January 12,
4 1971, hold a duly noticed public hearing to consider Planning Com
5 mission Resolution of Intention No. 76, regarding certain items to
be amended as follows:
7 I. Item B, Section 1375, Article 13.75 of Ordinance No. 9060,
Q reading as follows: "Uses permitted in C-l Zone, provided
9 such uses are established to provide a service primarily for
10 residents of the P-C Zone."

WHEREAS, at said public hearing the Planning Commission

1. The proposed amendments will allow more flexibility and
29 better utilization of the Planned Community Zone.

NOW, THEREFORE, SB IT RESOLVED that said amendment to Article
13.75 of Ordinance No. 9060, is hereby recommended for approval,
and that a copy of this resolution shall be forwarded to the City
Council for its attention, in the manner prescribed by law.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Planning Commission, held on the 12th day of January,
1971, by the following vote, to wit:

RESOLUTION NO. 1823
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF CARLSBAD, ANNOUNCING FIN -
INGS AND DECISION REGARDING AMENDMENT
TO ARTICLE 13.75 OF ORDINANCE NO. 9060
(PLANNED COMMUNITY ZONE).
WHEREAS, on the 12th day of January, 1971, the Carlsbad City
lanning Commission adopted Resolution No. 686, which is herewith
referred to and made a part hereof; and
WHEREAS, on the 2nd day of February, 1971, at a duly advertised
public hearing, the City Council of the City of Carlsbad considered
the Planning Commission's Resolution No. 686; and
WHEREAS, at said hearing the City Council heard all persons
interested in or opposed to the recommendations of the Planning
Commission as set forth in Resolution No. 686.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the
City of Carlsbad does hereby find that public necessity, convenience
and general welfare require the amendment of Article 13.75 of
Ordinance No. 9060 (Planned Community Zone) as hereinafter stated.
BE IT FURTHER RESOLVED AND DECLARED that the City Council hereby
certifies that the approval of the amendment to Ordinance 9060, as
approved by the Planning Commission, is necessary to carry out the
general purpose of Ordinance No. 9060.
BE IT FURTHER RESOLVED that the City Council does hereby declare
its intention to adopt an ordinance to effectuate the change in
Ordinance No. 9060.
25 BE IT FURTHER DECLARED AND ORDERED that the City Attorney is
26; hereby instructed to prepare an ordinance amending Article 13.75

ORDINANCE NO. 9262
AN ORDINANCE OF THE CITY OF CARLSBAD
AMENDING SECTIONS 1375 AND 1377, ARTICLE 13.75
OF ORDINANCE NO. 9060(PLANNED COMMUNITY ZONE).
The City Council of the City of Carlsbad does ordain as follows:
SECTION 1. ITEM B. SECTION 1375, ARTICLE 13.75 OF
ORDINANCE NO. 9060 AMENDED. Item B, Section 1375, Article 13.75
of Ordinance No. 9060 is hereby amended to read as follows:
"Item B. Uses permitted in C-2 Zone, provided
such uses are established to provide a service primarily
for residents of the P-C Zone."
SECTION 2. ITEM C, SECTION 1377. ARTICLE 13.75 OF
ORDINANCE NO. 9060 AMENDED. Item C, Section 1377, Article 13.75
of Ordinance No. 9060 is hereby amended to read as follows:
"Item C. Parking as follows: 1. Required off-
street parking per unit shall be, (a) Studio or Efficiency
Unit - 1 Space; (b) One-bedroom Unit - 1.25 Spaces; (c)
Two-bedroom Unit - 1.50 Spaces; and (d) Three or more
bedroom Unit - 2.00 Spaces."
SECTION 3. EFFECTIVE DATE. This ordinance shall take
effect and be in force on the thirty-first day from and after its
adoption.
SECTION 4. PUBLICATION. The City Clerk of the City of
Carlsbad is hereby directed to cause this ordinance to be publishec
once in the Carlsbad Journal, a newspaper published and of general
circulation in said City of Carlsbad.
