Cook Property; Request to Modify Conditions City Engineer Statement of the Matter The Council approved the subject permit May 19, 1970, subject to various conditions. Condition #16 reads as follows "That Lowder Lane -shall be dedicated as a public street and fully improved as a full-width•street (84 ft. right-of-way maximum), between the Southerly boundary of Phase 1 of the proposed mobile homes park and the existing improved section of Lowder Lane, Northerly of the proposed park; this shall be done prior to the issuance of an "Authorization to occupy" any unit. The owner has requested that the City revise Condition #16 to allow de- ferment of a portion of the public improvement on Lowder Lane until traffic.necessitates their construction or the adjacent property bor- dering the street is developed. The staff has no objection'to this ExHibit' (continued on attached page) 1) Location sketch Staff Recommendations if the Council desires to modify Condition #16, adopt a motion: 1) Revising Condition #16 to read as recommended above= AFFIXED ED BY CITY COUNCIL: WE Statement of the Matter (continued) Condition #16 should be revised to read as follows; "a) That Lowder Lane be dedicated as an 84' width public street between the existing improved section of Lowder Lane, northerly of the proposed park, and the southerly boundary of Phase I of the proposed mobile home park. b) That street improvements consisting of: (1) 36-foot wide structural section (2) Curb, gutter, sidewalk and street lights on the westerly side (3) Grading for ultimate width (4) Drainage facilities as may be reghredg design to be based on City Master Drainage Plan be constructed between existing Lowder Lane and the southerly boundary of Phase I of the proposed mobile home park, prior to the issuance of any occupancy authorization. c) That the remaining dedication of public improvements for the full street (841 right of way, 64' curb -curb) between existing Lowder Lane and the southerly boundary of the Ward/Lear property be constructed at such time as the adjacent property develops, or as the City Engineer de- termines the street is needed for traffic. d) That the owner enter into a separate guaranteed agreeme;lt, satisfactory to the City, assuring completion of the re- maining public improvements." r APPSiUJEQ BY CIiY COUNCIL IWE AB No. s, u 1 Date: March 2, 1971 City Manager's Recommendation Concur with applicant's request and staff recommendation.
