Blum, 1780 Buena Vista Way subject to the easement and sewer design being approved by the City Engineer, and the applicant entering into an agreement for participation in a future. sewer assessment district to - allow the property to be sewered by gravity. .. . -2- 1780 Buena Vista Way Carlsbad, California 92008 March 31, 1971 The Honorable Mayor and City Council 1200 Elm Avenue Carlsbad, California 92008 Gent1 emen: In June of 1965, I retired from the Military and selected the community of Carlsbad as the place I desired to live and have my children grow into young adulthood because of the ex- cellent schools, churches, and environmental surroundings. In September of the same year, I purchased the property at 1780 Buena Vista Way and have strived to make the property a comfortable home for my wife and three children. At the time of purchase, I was under the impression sewers would be forthcoming and the septic tank and cesspool on the property would not be needed. After five (5) years of waiting and having proposals for sewers in this area "turned down", I must make the following proposal for consideration of the City Council. It is requested I be granted permission to hook onto the sewer line which terminates at the conjunction of Wilson and Buena Vista Way. To aid you in your consideration, I submit the following: My cesspool has been pumped on several occasions and the septic tank on at least one occasion since I purchased the property. I have used the prescribed methods of utilization of chemicals at a considerable cost but to no avail. The cesspool is almost to an inoperative state and may cease at any time. In order to keep the cesspool operating, we have taken steps to curtail water usage. The two boys take showers at the High School after P.E. I shower at work most of the time. The bath tube is not used at all due to the amount of water required and showers for my wife and daughter are kept to a minimum and not taken on the same day. Dishes are washed once a day as a rule and local downtown laundramats are used for our laundry,.except for rare occasions, in order to keep the soaps and detergents from entering the cesspool. Page 2 March 31, 1971 The cost of all of the above mentioned items is without saying creating a hardship. After talking to my neighbor;,Mrs. Thelma Sowell, I'm sure an easement could be obtained from her to cross her property to hook onto the Wilson Street sewer line. Further, from time to time, an odor is given off from the vents on the roof that could be classified as extremely strong and could be offensive to my neighbors. I will, if granted permission, provide my own pump to handle the pumping of sewage.' This would eliminate my problem but other people living in this area (Basswood to Buena Vista Way on Valley) have the same basic problem my family has. We have been told this area drains badly because of the topography and the Street Department spent many hours and much labor trying to eliminate the "small lake" formed by showers at Buena Vista and Valley. The only alternative to problems faced by my neighbors and myself would be for the City to utilize the 1911 Act and correct the whole situation for all the residence in this area. My wife has carried a petition for a 1911 Act to the neigh- bors but due to the large agricultural holdings (over 50% of the area), she was unable to get the required response. If I am allowed to connect to the Wilson Street sewer, I agree to participate in any 1911 Act that would properly sewer my property from Buena Vista Way. Department has been contacted by us on several occasions to try to work something out. Further, I would like to point out that the Engineering Your consideration in this matter will be greatly appreciated. Sincerely,
