Since our meeting of April 20, 197l when ne discussed the pros and
cons of an encroachment permit, I have come to the conclusion that
perhaps this Fs the best solution to our problem,
I therefore request the city of carlsbad to issue an encroachment
permit allowing me to grade, landscape, build retaining walls and a
garage on this property. It would be understood that if the city
of Carlsbad required a portion of this property for the possible
widening of Jefferson Street sometime in the future we would vacate it upon receipt of a reasonable notice.
We thankyou and your staff for the help you hsve given us in coming
up with the solution to a very frustrating problem

Statement of the Matter May 4, 1971
Mr. Vincent L. Hoppert has requested that he be allowed to construct
retaining walls and a garage on a portion of Jefferson Street not
currently being used for traffic purposes. The area in question is
’ the site of the approach to the old Jefferson Bridge over 1-5 which
was removed as part of the freeway construction. It is not currently
needed for street purposes but should be retained for use in the event
that Jefferson Street is widened in the future. The relationship be-
tween the right-of-way and the existing street is shown on attached
Exhibit I.
The location of the improvements proposed by Mr. Hoppert is shown on
attached Exhibit 11. Mr. Hoppert has indicated that he plans to
landscape and maintain the area during the duration of the permit.
It appears that the request is reasonable and approval would result in
a definite improvement to this portion of Jefferson Street.
The improvements would be removed by Mr. Hoppert at his expense at such
time as the right-of-way is needed for public purposes.
