Boundary Adjustment between City" of Oceanside

Statement of the Matter
The City Council has entered into an agreement with the City of Oceanside
concerning the construction of a wier at the mouth of the Buena Vista
Lagoon.- This agreement also provided for the adjustment of the mutual
boundary between Oceanside and Carlsbad. to the centerline of the -proposed
channel, as shown -on Exhibit "A", which is attached to both Exhibits 1)
and. 2) .
The boundary adjustment must be filed with LAFCO -and entails withdrawal
and annexation procedures. Resolutions authorizing these actions must
accompany application forms to be sent to LAFCO. .

City Manager's Recommendation
Concur with the staff recommendation. It^should be noted that this is
only one small section of an irregular and illogical boundary line sepa-
rating Oceanside and Carlsbad. It would be much more sensible for the
city limits of Oceanside to parallel the centerline of Buena Vista La-
goon and thence to the southerly boundary of Vista Way.
It is suggested in this regard we express to LAFCO our interest in their
good auspices in assisting in this matter with the City of Oceanside since
there seems to be considerable reluctance on their part to consider a more
rational boundary. The Council may not be aware that they have asked us
to bear all local costs of the Vista Way-El Camino interchange in regard
to traffic control.
Council Action
6-1-71 Resolution #1861, consenting to the detachment from the City of
Carlsbad of territory to be annexed to the city of Oceanside was
ready by title only and adopted.
Resolution #1862 consenting to the transfer to the City of Carlsbad
of property situated in the City of Oceanside, was read by title
only and adopted.

RESOLUTION NO. 1861
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD CONSENTING TO THE DETACHMENT FROM
THE CITY OF CARLSBAD OF TERRITORY TO BE ANNEXED
TO THE CITY OF OCEANSIDE - ARMY-NAVY ACADEMY
PROPERTY
WHEREAS, Army and Navy Academy, Carlsbad, California, a
California corporation, is the owner of property described in
Exhibit "B", attached hereto and incorporated herein by reference
thereto, and further shown on a map marked Exhibit "A" - Annexa-
tion Plat - attached hereto? and
WHEREAS, the said Academy desires to detach the said real
property from the corporate limits of the City of-Carlsbad and
transfer the said property to the corporate limits of the City
)
of Oceanside; and
WHEREAS, this transfer is part of an exchange of property
between the said Henry J. Tenaglia and Nancy Keith Tenaglia,
owners of property in the City of Oceanside? and
WHEREAS, the said properties to be exchanged lie adjoining
the boundaries of the City of Oceanside? and
WHEREAS, the said exchange is a part of a transaction
whereby a Weir dam is to be installed in a drainage channel at
the westerly end of the Buena Vista Lagoon? and
WHEREAS, the installation of the said Weir dam is proposed
as a water level control system for the Buena Vista Lagoon; and
WHEREAS, the centerline of the said drainage channel is
to become, as a result of the exchange of properties and the
detachment and annexation of the properties to the Cities of
Carlsbad and Oceanside, the boundary of the Cities in the area
of the property exchange; and
WHEREAS, the said Cities of Oceanside and Carlsbad have
entered into a Joint Powers Agreement whereby the said Cities
have agreed to donate funds to assist in the financing of the

construction of the said Weir and have further agreed to maintain
the said weir after its construction? and
WHEREAS, the detachment and annexation described above is
a part of the total transaction aimed at the installation of the
said weir, which is proposed to benefit the people of the ad-
joining cities by providing a water level control for the said
7 !| Lagoon which contains a nature conservancy area in the immediate
vicinity of the properties to be exchanged;
9 i; NOW, THEREFORE, The City Council of the City of Carlsbad

10 ! DOES RESOLVE, DETERMINE AND ORDER as follows:
SECTION 1. That the City Council of the City of Carlsbad
does hereby and herewith consent to the detachment of the real
property described in Exhibit "B" attached hereto, and shown on
Exhibit "A" - Annexation Plat - attached hereto, from the corpor-
ate limits of the city of Carlsbad, subject to the condition
that such detachment shall occur concurrently with the annexation
of the said real property to City of Oceanside, California.
SECTION 2. The City Clerk of the City of Carlsbad is hereby
directed to file a certified copy of this resolution with the
Executive Officer of the Local Agency Formation Commission of the
County of San Diego, State of California, and to further file a
certified copy of this resolution with the Clerk of the Board
of Supervisors of the County of San Diego, State of California.
PASSED AND ADOPTED by the City Council of the City of

ANNEXATION PARCEL Tp CITY OF OCEANSIDE .
All that portion of Lot A as shown on Granville Park No. 2 Subdivi-
sion Map No. 2037, filed June 18, 1927 in the City of Carlsbad, County
of San Diego, State of California, more particularly described as
follows:
Commencing at the Northeasterly corner of said Lot A, said
point being also on the Southerly line of Lot 2 of Section 1, T12S,
R5W, S.B.B.M. ; thence North 89°53T45" West along the Northerly line
of said Lot A and the Southerly line of said Lot 2 of Section 1, a
distance of 365.82 feet to the Southeast corner of Lot 3 of said
Section 1, said point being a point in the boundary of the City of
Oceanside; thence continuing North 89°53'45" West 495.51 feet along
the Southerly line of said Lot 3, Section 1 and the Northerly line
of said Lot 2, Granville Part to an intersection with the centerline

RESOLUTION NO. 1862
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD CONSENTING TO THE TRANSFER TO THE
CITY OF CARLSBAD OF PROPERTY SITUATED IN THE
CITY OF PCBANSIDE - TENAGLIA PROPERTY
WHEREAS, Henry J. Tenaglia and Nancy Keith Tenaglia are
the owners of property described 'in Exhibit "B", attached hereto
and incorporated herein by reference thereto/ and shown on a map
marked Exhibit "A" - Annexation Plat - attached hereto; and
WHEREAS, the said owners desire to detach the said real
property from the corporate limits of the City of Oceanside; and
WHEREAS, this property is a portion of the parcel of prop-
erty owned by Henry J. Tenaglia and Nancy Keith Tenanglia ad-
joining the boundary of the City of Oceanside and the City of
Carlsbad; and
WHEREAS, the said owners have heretofore entered into
agreements with Army and Navy Academy, a non-profit corporation,
contemplating the exchange of the land described in Exhibit "B"
attached hereto, for a parcel of land adjoining the boundary
between the Cities of Oceanside and Carlsbad, which exchange is
a part of a total transaction which ultimately contemplates the
installation of a weir dam to be constructed in a drainage ease-
ment, the centerline of which will ultimately become the boundary
between the two cities in the area of the properties to be ex-
changed in this transaction? and
WHEREAS, the Cities of Oceanside and Carlsbad have entered
into a Joint Powers Agreement, whereby the Cities have agreed to
contribute money to the construction of the Weir dam to act as
a water level control in the Buena Vista Lagoon, and have further
agreed to maintain the said Weir dam; and
WHEREAS, the proposed property exchange will facilitate the
creation of a boundary serving the interests of the adjoining
cities;

NOW, THEREFORE, the City Council of the City of Carlsbad
DOES RESOLVE, DETERMINE AND ORDER as follows:
SECTION 1. That the City Council of the City of Carlsbad
does hereby and herewith consent to the transfer of the real
property described in Exhibit "B" attached hereto, from the City
of Oceanside to the corporate limits of the City of Carlsbad,
and does further resolve that the necessary annexation procedures
will be initiated to annex the said real property described in
Exhibit "B" to the City of Carlsbad upon the approval of the
Local Agency Formation Commission of the County of San Diego,
having been given to such detachment and annexation.
SECTION 2. The City Clerk of the City of Carlsbad is
hereby directed to file a certified copy of this resolution with
the Executive Officer of the Local Agency Formation Commission
of the County of San Diego, State of California/ and to further
file a certified copy of this resolution with the Clerk of the
Board of Supervisors of the County of San Diego/ State of
California.
PASSED AND ADOPTED by the City Council of the City of
Carlsbad, this 1st day of June , 1971, by the fol-
lowing vote:

All that portion of Lot 3, Section 1, Township 12 South, Range 5
West, according to official plat thereof, in the City of Oceanside,
County of San Diego, State of California, lying Westerly of the A.
T. & S. F. Railroad right of way, more particularly described as
follows:
Beginning at the intersection of said A. T. S. F. Railroad
right of way with the South line of Said Lot 3 of Section 1, being
a poing on the arc of a 1532.69 foot curve concave Northeasterly, a
radial to which bears South 47°28t23" West; thence along the arc of
said curve 34.61 feet, through a central angle of 1C17'38"; thence
tangent to said curve along said Westerly right of way line, North
41°13'59" West 521.47 feet to an intersection with the East line of
said Lot 3, being the TRUE POINT OF BEGINNING; thence continuing
North 41°13'59" West 112.80 feet to the centerline of an 80 foot wide
channel being the beginning of a 282.23 foot radius curve concave
