Engineer Statement of the Matter Mr. L. E. Liddle has .authorization to•subdivide and develop that property oh the east side of Monrpe Street between Park Drive and Karren Lane. (See Exhibit A PC Res. #671). A standard bonded, subdivision agreement is required for the street improvements. Also, an agreement for .the future installation of street light's is required as the installation of lights now would be "untimely. Exhibit Exhibit "A" - pjC.-Res. #671. Staff Recommendations . ' Adopt a motion authorizing the Mayor to execute on behalf of the City: 1. A standard subdivision improvement agreement with the developer of Parcel Split #122. 2. A standard agreement for the future installation of street lights as required by the City Engineer. AB No .Da t e :June 1, 1971 City Manager's Recommendation Concur with staff recommendatio'n Council Action 6-1-71 Authorization was given the Mayor to execute.on behalf of the City-- a) a standard subdivision improvement agreement b) a standard future street improvement agreement, as recommended by the City Eggineer. -2- >- 1 2 4 5 6| 7j 8; i9! 10! 12 13 14 23 24 25 PLANNING COMMISSION RESOLUTION NO.671 A RESOLUTION OF THE CARLSBAD CITY PLANNING COMMISSION GRANTING A VARIANCE ON PROPERTY LOCATED ON THE EASTERLY SIDE OF MONROE STREET, BETWEEN PARK DRIVE AND MAGNOLIA AVENUE, REDUCING THE REQUIRED FRONTAGE FROM 60 TO 20 FEET WHEREAS, pursuant to the provisions of Ordinance No. 9060, the Planning Commission of the City of Carlsbad did on August 11, 1970 hold a duly noticed public hearing to consider the application of THE CITY OF CARLSBAD and KATHRYN D. MC GINNIS, for a Variance in required lot width from 60.00 feet to 20.00 feet, to permit a "Panhandle" Lot Split, on property located on the East side of Monroe Street, between Magnolia Avenue and Park Drive, on the follow ing described property: A Portion of Tract 256, Thum Lands Map 1681, being Parcel 3, Book 205, Page 260 in the City of Carlsbad, County of San Diego, State of California, and more particularly described in application on file in the City Planning Office. WHEREAS, at said public hearing, upon hearing and considering 15 ' 16 17 18 19 20 21 the testimony and arguments, if any, of all persons who desired to be heard, said Commission did find the following facts and reasons to exist which make the granting of a Variance necessary to carry out the provisions and general purpose of Ordinance No. 9060: 1. The proposed division of land meets all requirements of the City Council policy regarding "Panhandle" Lot Splits. 2. The unusual configuration of subject parcel warrants the granting of a "Panhandle" variance. 22!3. The granting of such variance will not be materially detri- mental to the public welfare nor injurious to the property or improvements in such vicinity and zone in which this property is located. 4. That a Parcel Map shall be filed with the City Engineer; b. That the developer shall enter into a standard, bonded Subdivision Agreement for the construction of standard street improvements for that portion along the one-half of Monroe Street adjacent to subject property, as required by the City Engineer; c. That separate sewer and water services shall be provided for each lot; d. That the existing reservoir shall be removed within six (6) months of approval of this variance; e. That a park-in-lieu fee shall be paid; f. That frontline charges for water and sewer mains shall be paid for each lot created; g. That the developer shall have plans for public improve- ments prepared by a registered civil engineer. PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Planning Commission held on the llth day of August, 1970, by the following vote, to wit: AYES: Commissioners Palmateer, Gullett, Forman, Dewhurst, Little, and Hermsen NAVES: None ABSENT: Commissioner Jose.
