This' work modifies an existing encroachment . There appears .to be no conflict with exi-sting or proposed However, the existing over- head electrical sewice must be raisgd 'to' provide adequate clearance as required in the Bui'lding Code. Modify existing service ,drop to provide adequate clearance as required by Building Code. 2. Submit a release satisfactory to the City Attorney, holding City harmless from any liability incurred due to the encroachment. Council Action .- 6-15-71 Council granted encroachment permit subject to conditions .recommended by the staff. -2- -2 [' t ... # j ie SINCE 10tl .. .- HOLD HARMLESS AGREEMENT Hughes Tool Company, Aircraft Division, in consideration of permission granted by the City of Carlsbad to use its facilities at Lake Calavera during the period from the date hereof to December 31, 1971, in connection with the testing of helicopter floats, does hereby agree for itself, its successors and assigns, by operation of law or otherwise, except as hereinafter provided, to hold harmless the City of Carlsbad and to assume full responsibility for and to defend, pay, or otherwise settle any and all claims, demands, actions or cause of action of every nature and character whatsoever in law or equity for loss, damage or injury to any and all persons or property arising out of such use by Hughes Tool Company, Aircraft Division. Aircraft Division, agrees to carry comprehensive liability insurance in an amount not less than $1,000,000.00 under which the City of Carlsbad will be an insured covering the activities of Hughes Tool Company, Aircraft Division, at the facilities described herein. Hughes Tool Company, Aircraft Division, further agrees to release and discharge the City of Carlsbad, its agents and employees, their heirs, successors, executors, administrators, or assigns from any and all liabilities, claims, demands, action or cause of action, of every nature whatsoever arising out of such use by it, and to indemnify and hold harmless the City of Carlsbad, its agents and employees, their heirs, successors, executors, administrators, or assigns from loss or damage suffered by reason of such use by it. Hughes Tool Company, It is understood and agreed that the City of Carlsbad assumes no responsibility for the condition of the facilities at Lake Calavera.
