Council Action 6-29-71 7.- 6 - 7 1 Following discussion, it was agreed that an encroachment permit be issued and recorded to preclude perscriptive rights. The City Attorney was instructed to investigate and report on aspects of liability. Final approval for an encroachment permit was given by the Council. The City Attorney was instructed to draw a covenant to include a hold harmless clause; an encumbrance on any future owners, binding to the-terms of t.he agreement with the present owner, and, a 30 day notice of termination clause.
