Statement of the Matter
This matter came before the Council on August 3, 1971, and the City
Council referred the matter to the Planning Commission for report
and recommendation.
A report has been received from the Planning Commission, recommending
approval of the annexation of the Lanikai property. However, the
Commission felt the entire unincorporated area south of the Encina
Treatment Plant between Interstate 5 and Carlsbad Blvd. should be
included in the annexation.
Therefore, the staff has prepared the attached documents for your
review to include the area recommended by the Planning Commission.

Staff Recommendations
Adopt Resolution #1893, consenting to the annexation of properties to
the City of Carlsbad, and direct the staff to endeavor to obtain the
consent of those property owners in the remaining unincorporated area
recommended to be annexed.

the letter requesting annexation to the Planning
Commission for report and recommendation
At the regularly scheduled meeting of August 24, 1971, the
Planning Commission discussed the matter of Lanikai Annexation.
After comments by staff (memorandum included) and Mr. Jack Robin-
son, South Shores Development Corporation, the Planning Commission
felt that the entire unincorporated area south of the Encina treat-
ment plant between Interstate-5 and Carlsbad Boulevard should be
annexed. However, if it is not feasible to annex the uninhabited
properties north of the Lanikai holdings, the City should recommend
annexation of at least the Lanikai Lanes Mobile Home Park.
Enclosed is a map indicating the properties to be considered
for annexation.

South Shores Development Corporation, developers of the
Lanikai Mobile Home Park wish annexation to the City. They feel
that the annexation will be beneficial to the City as well as
themselves.
The precise location of properties involved in the request
are outlined on the attached map. Since the corporate boundaries
of the City of Carlsbad completely surround the Lanikai property,
as well as adjacent properties to the north, it seems advantageous
for the City to annex the Lanikai holdings. However, additional
properties south of the Encina Treatment Plant between Carlsbad
Boulevard and Interstate-5 right-of-way would be left in the County
Therefore, it would seem logical to annex these properties, which
are uninhabited, at the same time.
The City Council is referring this request to the Planning
Commission for a report and recommendation.

RESOLUTION NO. 1893.
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CONSENTING TO THE
ANNEXATION OF CERTAIN PROPERTY TO BE
KNOWN AS "SOUTH CARLSBAD ANNEXATION NO. 1.13".
WHEREAS, the proponents have filed a request for the City
Council's consent to annexation of certain property; and
WHEREAS, the City Council referred the matter to the Planning
Commission for report or recommendation; and
WHEREAS, the Planning Commission has considered the matter
and has made a recommendation to the City Council; and
WHEREAS, the area to be annexed is part of an island of un-
incorporated County area, and the Planning Commission recommends
that the entire island be annexed at this time;
THEREFORE, BE IT RESOLVED that the City Council of the City
of Carlsbad hereby consents to the annexation of all that property
described in Exhibit "A", attache'd hereto and made a part hereof.
PASSED, APPROVED AND ADOPTED by the City Council of the City
of Carlsbad at a regular meeting held on the 7th day of September,
1971, by the following vote, to wit:
AYES: Cmn. Dunne, McComas, Jardine, Castro and Lewis.
NOES: None.
ABSENT: None.

SOUTH CARLSBAD ANNEXATION NO. 1.13
All that unincorporated area in the County of San Diego, State
of California, being a portion of La Costa Downs Unit No. 1,
according to Map thereof No. 2013, filed in the Office of the
County Recorder of San Diego County, April 6, 1927, and a
portion of Sections 20 and 29 in the Township 12 South, Range
4 West, San Bernardino Base and Meridian, according to United
States Government Survey, approved October 25, 1875, and being
more particularly described as follows:
Beginning at a point on Southerly boundary of Rancho Agua
Hedionda, according to United States Survey Government Resurvey
of Subdivision of Township 12 South, Range 4 West, San Bernar-
dino Base and Meridian, by Owen approved September 17, 1915,
a copy of which was filed in the Office of the Recorder of
said County, June 21, 1920, as miscellaneous Map 29 and also
according to map marked "Plaintiff's Exhibit A" in Superior
Court Document No. 16830, dated May 6, 1916. Said point being
also on the westerly line of right of way of State Highway.
As shown on right of way map, District XI, County of San
Diego, Route 5, Sheet No. LO-3770;
Thence along Southerly boundary of said Rancho, South 89°27'10"
East 366.17 feet to the Easterly right of way line of said
State Highway;
Thence along the Easterly right of way line of said highway,
South 28014'56" East 326.28 feet (State distance 323.50 feet);
Thence continuing along said line South 24°40'18" East 2140.96
(State distance 2141.34 feet) to a point on the Northerly
section line of Section 29;
Thence leaving Easterly right of way line of State Highway
along said section line South 89°58'20" West 1226.03 feet to
the Northwest corner of the East half of the Northeast Quarter
of Section 29;
Thence South 0°02'20" East 1362.45 feet along Westerly line of
the East one-half of the Northeast Quarter of Section 29 to
the South line of Lot 1, of Section 29;

line of Rancho Agua Hedionda;

way 60.51 feet through a central angle of 57°35'50" to a
radial line from said point bears South 0°38'55" West;
Thence leaving said right of way North 61°51'00" East
292.78 feet to the Westerly right of way line of State
Highway XI-SD-Route 5, Sheet No. LO--3770;
Thence along the Westerly right of way line North 27°14'24"
West 652.95 feet to the TRUE POINT OF BEGINNING.
