Statement of the Matter
The property proposed to be annexed to the City of Carlsbad is in
connection with the construction of the Wier wherein a boundary change
was negotiated with the City of Oceanside (See Agenda Bill #525)
The boundary change was approved by the Local Agency Formation Commission
and the Board of Supervisors on August 2, 1971, and authorized the
City Council to annex such territory without notice and hearing.

ORDINANCE NO. 1139
AN ORDINANCE OF THE CITY OF CARLSBAD
APPROVING ANNEXATION TO THE CITY OF
CARLSBAD OF CERTAIN PROPERTY DESIGNAT-
ED "NORTH CARLSBAD ANNEXATION NO. 1.1.
The City Council of the City of Carlsbad does ordain as
fol1ows:
SECTION 1. That said City Council does hereby find and
declare that all requirements of law necessary to the adoption
of this Ordinance pursuant to California Government Code Section
35314, have been complied with.
11 | SECTION 2. PROPERTY DESCRIPTION. The City Council of the
City of Carlsbad does hereby approve the annexation of all that
Portion of Lot 3, Section 1, Township 12 South, Range 5 West,
according to official plat thereof, in the City of Oceanside,
County of San Diego, State of California, lying Westerly of the
A.T. & S.F. Railroad right of way, and more particularly described
in Exhibit "A", attached hereto, and by this reference incorporated
herein, which said property is hereby designated "North Carlsbad
Annexation No. 1.1!!
SECTION 3. EFFECTIVE DATE. This Ordinance shall take effect
and be in force on the thirty-first day after its adoption.
SECTION 4. DATE OF PUBLICATION. The City Clerk of the City
of Carlsbad is hereby directed to cause this Ordinance to be pub-
lished once in the Carlsbad Journal, a newspaper published and of
general circulation in said City of Carlsbad, with fifteen (15)
days after its adoption.

INTRODUCED AND FIRST READ at a regular meeting of the City
Council held on the 7th day of September, 1971, and finally passed,j
approved and adopted at a regular meeting held on the 21st day of
September, 1971, by the following vote, to wit:
AYES: Cmn. Dunne, McComas , Jardine, Castro and Lewis.
NOES: None.
ABSENT: None.

All that portion of Lot 3, Section 1, Township 12 South, Range 5 '
West, according to official plat thereof, in the City of Oceanside,
County of San Diego, State of California, lying Westerly of the A.
T. & S. F. Railroad right of way, more particularly described as
follows:
Beginning at the intersection of said A. T. S. F. Railroad
right of way with the South line of Said Lot 3 of Section 1, being
a poing on the arc of a 1532.69 foot curve concave Northeasterly, a
radial to which bears South 47°28T23" West; thence along the arc of
said curve 34.61 feet, through a central angle of Viy'SS"; thence
tangent to said curve along said Westerly right of way line, North
41°13I59" West 521.47 feet to an intersection with the East line of
•said Lot 3, being the TRUE POINT HF BEGINNING; thence continuing
North 41° 13'59" West 112.80 feet to the centerline of an 80 foot wi'de
channel being the beginning of a 282.23 foot radius curve concave
