Topics Project - Consultant's Agr'eement for City Engineer Design of Traffic Signal Installation at Carlsbad Blvd. and Tamarack Ave. -- - Statement of the Matter -. The Division of. Highways has notified the.Engineering Department that the subject project has been approved and qualifies for. the Federal funds. This means that Federal Topics Funds in the amount of 70% of the construction -costs will be available if a contract is entered into prior to June 30, 1972. In order to'meet tks deadline, it is necessary to complete the design by February, 1972. Because of the specialized nature of the project, it is necessary'to engage a consultant for che design. 'VTN Corporation is a firm well qualified in.this type of work and has successfully completed a Topics - project design for the City of Vista. The firm has submitted a'proposal to do the design work for a fee not to exceed $3400. This maximum is within the guidelines established by ASCE'for projects of this type. The work will be coordinated by the firm's Vista Office, with design to be performed by the Orange'County Office.' . Sufficiekt funds are available for this work within the current budget. Es- timated cost of the construction is $35,000. This Fgreeaent is made and entered into on this I day of , 19 , by and between VTN Orange County, hereinafter referred to as "Engineer" and the City of Carlsbad, A Municipal Corporation, hereinafter referred to as "City". RECITALS -_I City proposes to widen the intersection of Tamarack Avenue and i Carlsbad Boulevard and install a traffic signal in accordance with Federal requirements under the Topics Program. Engineer has submitted a proposal dated November 9, 1971, to prepare plans, specifications and estimate for the traffic signal in- I I stallation and street widening in conformance with Division of Highways Standards for Topics Projects. AGREEMENT 1) City engages Engineer to furnish services hereinafter men- tioned at and for the compensation herein stipulated, and the Engineer accepts said engagement upon terms hereinafter set forth. 2) Engineer shall: a) Submit a conceptual signal layout for approval of the City Engineer. Complete detailed plans for this project based on the approved concept. Pl3ns shall be in ink on linen or mylar with appropriate City tit le block. b) Complete detailed specifications and contract pro- posal in typed form suitable for use in soliciting competitive bids. c) Supply a detailed cost estimate sufficient to analyze and evaluate the bids. d) Follow Division of Highways Standards for Topics EXHIBIT 1 'I Pro j ects . 26 e) Consult with the City Engineer and representatives of i i j the Division of Highways as maybe required from time to time. 27 28 29 30 31 32 3)' City shall provide Engineer with: 1 1 ! 1 ! a) Field survey data b) Existing plans and maps c) City utility locations d) Consultation as needed to accomplish design e) Reimbursement for reproduction of said plans, specifi- cations and recorded documents. 4) Original drawings, maps, descriptions and other documents shall becorne the property of the City and may be reproduce< by the City Engineer. 5) City reserves the right to terminate the Agreement, at any time by written notice to the Engineer. In the event the City terminates this Agreement, it shall reimburse the En- gineer a portion of his fee based on City Engineer's es- timated percentage of the work done and estimated value of the work. 6) All plans, specifications and other documents for the project shall be completed to the satisfaction of the City Engineer and Division of Highways and delivered to City Engineer by February 1, 1972. 7) In consideration of the performance of the above described engineering services, City agrees to pay the Engineer an amount based on Standard fee schedule included in En- gineer's proposal dated November 9, 1971, but in no event shall this amount exceed $3,400.00. The location of your beach facilities and parking lot entrance at this intersection were hportant factors in the selectim of this oroject for Federd fundivg. Preliminarv design work on this nroject has been comFlete8. A sketch is enclosed for your comments. Final design of this Droject is dependent upon acquisition of the necessary right of way. The required right of way was originally part of Old Highway 101. It was relinquished shortly after the discontinuance of use of this road as a State Highway. It is therefore recruested that the Stcte grant an easement for the remired right of w~y to the City of Carlsbad. 9ur present schedule calls for completion of design in February, and completion of the construction by summer time would be desirable. Timing is necessvily contingent on com- rleting the necessary right of way processing. Your early response to this request will be aFpreciated.
