SUBJECT: APPLICATION FOR APPROVAL OF A TENTATIVE SUBDIVISION
MAP FOR A 23-UNIT, 1-LOT CONDOMINIUM DEVELOPMENT
APPLICANT: R. J. KLITGAARD
Report submitted by: City Manager, Fire, Engineering, Building,
Parks & Recreation, and Planning Departments
General Discussion:
The subject property is located on the beachfront cliff on
the westerly side of Ocean Street at the foot of Beech Avenue.
The applicant's property, as well as adjacent properties,
is zoned for R-3 density development. This is consistent
with General Plan density projections.
The proposed project is for development of 23 condominium
living units to be accommodated through a one-building, one-
lot concept. Off-street parking will be provided at a ratio
of 2:1; building height will not exceed 35' above the center
line of Ocean Street and an eight foot (81) side yard dedica-
tion will be provided for public access to the beach. Public
utilities have been previously installed.
Recommendation:
The staff recommends approval of the proposed tentative
map for the following reasons and subject to the following
conditions:
Reasons for Approval:
1. The proposal is in the best interest of the City of Carlsbad
2. The proposal will not be detrimental to surrounding pro-
perties .
Conditions of Approval:
1. The developer shall offer for dedication to the City of
Carlsbad, an 8' public walkway adjacent and parallel to the
northerly property line.
2. Said dedication shall compensate for only a portion of the
land required by ordinance 9190 and fees-in-lieu of dedication
shall be paid for the balance.

3. Water system in this area is adequate for domestic fire
protection purposes. Fire hydrants and on-site fire protection
devices should be installed per requirements of the fire
department.
4. A holding tank for sanitary sewerage, sufficient for 24
hours minimum storage, shall be installed. A timing system,
satisfactory to the City Engineer, shall be provided to control
operation of the tank pumps to limit discharge to off peak
flow periods.
5. A grading and drainage plan shall be approved by the City
Engineer prior to any grading.
6. Full street improvements to the centerline of the street
shall be constructed in accordance with the Subdivision
Ordinance and requirements of the City Engineer. Improvement
plans shall be prepared by a Registered Civil Engineer.
7. Additional street right-of-ways up to 10' maximum as may
be required for street widening, shall be dedicated to the
City free of all liens and encumbrances. The required dedi-
cation will be used for sidewalk and/or landscaped parkway
easements.

A RESOLUTION OF THE CARLSBAD CITY PLANNING COMMISSION
RECOMMENDING TO THE CITY COUNCIL APPROVAL OF A TENTATIVE
MAP FOR CARLSBAD BEACH CLUB, CARLSBAD TRACT 72-5
WHEREAS, the Carlsbad City Planning Commission did receive on
April 25, 1972, a Tentative Map, to be known as Carlsbad Beach Club,
Carlsbad Tract 72-5, submitted by Klitgaard and Branson, Inc., owners
|and subdividers, on property located on Ocean Avenue, being Lots 23

through 29 Hays Land Co. Addition to Carlsbad, Map No. 1221.
WHEREAS, the Planning Commission did consider the Tentative Map
as submitted, comprised of one lot; and
WHEREAS, the Planning Commission did take into consideration the
reports of the various City agencies and utility companies;
NOW, THEREFORE, BE IT RESOLVED that the Tentative Map be approved
subject to the following conditions:
Reasons of Approval :
1. The proposal is in the best interest of the City of Carlsbad.
2. The proposal will not be detrimental to surrounding properties.
Conditions of Approval:

5 WHEREAS, the Planning Commission of the City of Carlsbad on
6 I April 25, 1972, recommended to the City Council that the tentative

map for Carlsbad Beach Club, Carlsbad Tract 72-5, be approved; and

WHEREAS, the City Council of the City of Carlsbad on the
9 2nd day of May, 1972, considered the recommendation of the Planning
10
Commission;

NOW, THEREFORE, BE IT RESOLVED by the City Council of the
12
City of Carlsbad the the City Council does hereby approve said
13
tentative map for Carlsbad Beach Club, comprised of one lot, located
14
on Ocean Avenue, lots 23 through 29 Hays Land Co. Addition to
15 Carlsbad, Map No. 1221, subject to the following conditions being

performed by the owner:

20 tentative map.

22 Carlsbad City Council held on the 2nd day of May, 1972, by the
2 following vote, to wit:
